Administrative Subdivision Request by Kevin Meland
Request
The Council is asked to approve an administrative subdivision to split Lot 1, Block 1
Dunham Addition into two parcels; one of which will be added to Lot 2, Block 1 Dunham
Addition.

Analysis
The City approved the plat of Dunham Addition in 1997 under the "4 per 40" split
regulations. The original plat included four lots and one of the conditions of approval was
that a deed restriction for Lot 1 that restricts further subdivision of that lot. The applicant,
Kevin Meland, is purchasing a portion of Lot 1, Block 1 from the original owner, Howard
Dunham, in order to resolve a mortgage foredosure issue, which was inappropriately applied
to a portion of Lot 1.
The proposed administrative subdivision would carve a new parcel for an existing
homestead out of Lot 1, Block 1. This lot will be 10 acres in area and will have the required
300-foot lot width as required by ordinance. The remainder of Lot 1 will then be combined
with and added to Lot 2, resulting a net number of lots equaling 4, which is consistent with
the original plat approval in 1997.

This request does not qualify for a subdivision exemption due to the nature of the lot being
created. The City Attorney has reviewed this request and has indicated that as long as the
net result is four lots, it is not violating the deed restriction for Lot 1.
Recommendation
Staff recommends that the City Council approve the Administrative Subdivision request by
Kevin Meland with the following condition:
1. THE APPROPRIATE EASEMENTS SHALL BE GRANTED ALONG ALL LOT
LINES AS REQUIRED BY CITY ORDINANCE.
