The parking lot is paved and provides 114 spaces. The interior will be altered to support the go-kart track. Cosmetic improvements such as parking lot repair and painting of the building are proposed for the exterior. Rezoning Request It appears that there is a discrepancy between the land use designation and the zoning designation of the site. The land use designation is clearly Highway Business with the zoning indicating multiple family. Ron's Foods, a retail facility, has occupied the site for a number of years, including prior to the most recent update to the City's Comprehensive Plan. It appears that the zoning designation of R4 Multiple Family is in fact a map error and approval of this rezoning request would make the zoning and land use designations consistent with each other. Conditional Use Permit The applicant proposes to convert the existing interior of the building into a motorized Go- Kart facility. Proposed is a Go-Kart track, pit area, bathrooms, meeting room, and ticket/concession area. Packaged foods such as pop and chips will be sold at the concession area. Video games are also proposed along one wall of the facility. The applicant anticipates the following hours of operation: Monday -Thursday: Friday: Saturday: Sunday: 11:00 a.m. to 11:00 p.m. 11:00 a.m. to 12 midnight 9:00 a.m. to 12 midnight 9:00 a.m. to 11:00 p.m. The applicant should be required to enforce the City's curfew requirements as the age of the clientele will be those 16 years and older. The zoning code does not identify the specific number of spaces required for this proposed use. General recreation parking standards require one space four each four patrons when full. During the staff review, there were no adverse comments other than a concern in regards to adequate ventilation in order to remove the exhaust of the Go-Kart motors. The applicant will be required to comply all building code requirements in this regard. Planning Commission Action The Planning Commission conducted a public hearing at its May 28, 2002 meeting. Several persons spoke for and against the proposal. He felt that it would cause a decrease in property values in the area. Greg Bossany, 304 Baldwin stated that he visited other sites and they were very dirty and that he could hear the screeching tires from the operation. He stated that in the past, kids had asked if they could smoke in his yard. Adam Harrison, 11084 190th Avenue stated that he had visited and participated at Thunder Alley, and there was no noise in the parking lot. Ken Jordan, 18990 Twin Lakes Road, expressed concern about the hours of operation and the potential to create a "kid hangout". Recommendation Staff and the Planning Commission recommend that the City Council approve the rezoning request with the following findings: APPROVAL OF THE ZONING REQUEST WILL NOT HAVE ADVERSE IMPACTS ON ADJACENT USES. THE ZONING REQUEST IS CONSISTENT WITH THE LAND USE DESIGNATION OF THE COMPREHENSIVE PLAN. Zerwas, Chief of Police June 11,2002 Proposed Indoor Speedway It is my understanding that the City has received a request to authorize an indoor speedway in the vacant Ron's Foods building located in Elk River. I have contacted the Brooklyn Center Police Department where an existing indoor speedway has been conducting business since the last part of December (Thunder Alley). This race track was built in a vacant K-Mart building. The BCPD informed me that there have not been any complaints made regarding this business. I also spoke with an employee of Thunder Alley who advised me that there are txvo (2) race tracks at their facility; one for licensed drivers and one for juveniles over 48" tall. The karts have a maximum speed of forty (40) miles per hour and t~velve (12) miles per hour respectively. They also advised me that the majority of patrons are in this younger group. They are open seven (7) days a week and their hours are Monday through Thursday (9:30 a.m. - 11:00 p.m.), Friday through Saturday (9:30 a.m. - midnight), and Sunday (9:30 a.m. - 10:00 p.m.). There has been some resistance from the neighborhood in the area of the vacant Ron's Foods building where there is a concern that this may become a "hangout" for our youth. I am stressing that the City put restrictions on this new business regarding the activity in the parking lot.
