P 02-09 May 17, 2002 Page 2 Zoning/Land Use Rla (Single Family Residential, 2 ~ Acre Minimum Area) / LR (Low Density Residential) Overview The subject property is 15.74 acres and has extremely rolling, wooded topography covering the site. The entire eastern edge fronts County Road 77 (Proctor Avenue). Ridgewood 1x & 2nd Additions abut the subject property to the north and west. A single family home and accessory structure are located on the property. The accessory structure is shown to be removed. Analysis The preliminary plat is comprised of 5 lots, one of which will contain the existing dwelling, arranged around a cul-de-sac. The cul-de-sac street, 197th Court, is approximately 550' in length, which does not exceed the City's maximum length for a cul-de-sac. Included in the plat is Outlot A (1.5-acres) that will provide a trail corridor from Big Tooth Ridge Park to County Road 77. The lot sizes range from 2.5 to 2.65 acres. The proposed lots meet the minimum 160-foot required widths. The lots show a 35-foot front yard setback, which meets the Rla district requirements. Landscaping The landscape plan submitted by the developer complies with the ordinance. Park Dedication The Park and Recreation Commission reviewed this plat at its April 10, 2002 meeting and recommended that the dedication be in land to provide a trail corridor from Big Tooth Ridge Park to County Road 77. Prior to the April 10, 2002 meeting, staff walked the site with the applicant and the property owner to review the best location for this corridor. Staff will continue to work with the developer in locating this corridor somewhere along the south edge (Outlot A) of the plat. Gradin~ The City Engineer has addressed grading in his memo. Utilities Each lot will have its own private well and septic system. Commissioner Baker reviewed an e-mail letter received by staff and the applicant responded to the e-mail concerns. There was some discussion on drainage and septic issues. Terry Maurer, the City Engineer, explained the comments outlined in his memo that referenced these issues. The Planning Commission voted unanimously to recommend approval of the Preliminary Plat of Echo Hill. Recommendation Staff and the Planning Commission recommend the City Council approve the Preliminary and Final Plats of Echo Hill with the following conditions: 1. ALL COMMENTS OF THE CITY ENGINEER SHALL BE ADDRESSED. 2. ALL COMMENTS OF SHERBURNE COUNTY SHALL BE ADDRESSED. 3. STREET LIGHTS SHALL BE INSTALLED AS REQUIRED BY ELK RIVER MUNICIPAL UTILITIES. 4. A SEALCOAT FEE SHALL BE PAID PRIOR TO RELEASING THE PLAT FOR RECORDING. 5. A LETTER OF CREDIT IN THE AMOUNT OF 100% OF THE COST OF THE IMPROVEMENTS SHALL BE SUBMITTED PRIOR TO RELEASING THE PLAT FOR RECORDING. 6. THE APPLICANT SHALL EXECUTE A DEVELOPER'S AGREEMENT OUTLINING THE TERMS AND CONDITIONS OF APPROVAL. 7. The information we received was prepared by Bogart Pederson & Associates, Inc., and dated March 14, 2002. It contained a preliminary plat, preliminary grading and erosion control plan, preliminary landscape and lighting plan, and a 1992 aerial photo. In addition, drainage calculations were submitted for the proposed development. We also received a revised grading plan, undated, in late April. Based on our review and comments received at the staff review meeting, we would offer the following comments: The entrance road off of Proctor Avenue is a relatively steep grade exceeding 9%. The City Ordinance for public streets requires a maximum grade of 8%. However, in this circumstance, there would be a devastating effect on the wooded area adjacent to the road. If the road needs to be cut down to meet the maximum 8% grade contained in the ordinance, the grading limits will expand north and south, dictating the removal of a significant number of trees. Lot 5, Block 1, has an existing home and an additional building on the site. The additional building is shown to be removed. The location of the septic system for the existing home on Lot 5, Block 1, should be noted on the plan to be sure that it falls within the newly created building lot. The revised grading plan shows the house pad on each lot set back from the street at a location where a reasonable driveway can be constructed. It will be important that the development plan indicates these are the approved home locations and styles relative to floor elevations. At the staff review meeting, the comment was made that perhaps a requirement of this plat should be to build the septic site prior to home construction, in an effort to minimize the removal and disruption of trees. If the septic site is built first, access to that site could be accomplished through the home building site. Storm runoff from the street is collected in the cul-de-sac and at the intersection with Proctor Avenue and conveyed to natural Iow areas with no outlet. The inlet and storm sewer system from the cul-de- sac will be down a very steep grade. It will be difficult to maintain that grade after the trees are removed. Detail needs to be provided as to how this slope will be maintained during and after construction. The same is true for both storm sewer systems at the outlet. The velocity of the water will be very great and a detail will need to be provided concerning erosion protection methods at the outlets. This elevation will inundate an area of property extending into two lots to the east. However, given the natural topography of the area, this area has probably always seen runoff from snow melt and rain events. The storm sewer system from the cul-de-sac to the natural Iow area only has one catch basin. If this catch basin is plugged, the natural overflow will be through Lot 3, Block 1. An easement will be needed to encompass the emergency overflow area. In addition, we would recommend that a second catch basin be installed in the cul-de-sac to add additional inlet capacity and lessen the opportunity for a plugged catch basin to cause water to overflow the curb line. As you are aware, this is a small addition consisting of five lots located just west of Proctor Avenue. The only comments we have relative to the final plat concern drainage and utility easements. We believe that an additional five-foot drainage and utility easement should be shown along Outlot A at the rear of Lots 4 and 5. Also, there is a natural swale through the eastern portion of Outlot A adjacent to Proctor Avenue. We would suggest that the entire eastern portion of Outlot A be designated a drainage and utility easement. We would suggest that this designation run southwesterly to the south plat boundary off of the line that measures 166.94 feet. Finally, we would suggest that additional drainage and utility easements be placed in Lots 1 and 2 to cover the natural swales that convey drainage from Ridgewood First Addition to the north through these two lots. This plat must be carefully reviewed because it does appear to be sub standard because of the following major points. Site For Septic Systems The slope in which the septic sites are being located are very steep. In fact the slope on lot 3 is the steepest slope in Elk River and will almost certainly cause erosion and future septic problems. Note: The elevation changes on septic sites for lot 3 are 12 feet. In fact it is probably quite dangerous to operate machinery on slopes of this nature. 2.) Building Pads The location of two building pads are within 100 feet of the back edge of the property. This, we feel, is not a good planning practice because of impact it may have upon present landowners. Many of the present landowners' adjacent properties suffer from poor planning of the past and therefore have houses on the back edge of their lots. It is important that the city address this issue for the quality of life for its constituents. 3.) Erosion Issue The construction will extensively alter the character of a very dynamic place through the construction of roads, house pads and driveways. Erosion will be a serious issue and the City of Elk River should take a stand on this issue through trying to minimize excavation activities. Please carefully review this plat for the present and future residents of Elk River. I did want to let you know, thai I did have at toast 5 neighbors who would be willing to discuss this project, however, with conflicting schedules, I'm not sure if they will make tonight's meeting. I do know they did wan: to meet the developer. They may have more issues to discuss that differ from mine. On a personnel note: I think the City is eager to have lots of development, however they do not lock at all the problems/consequences that might effect the rest of the communib/. This property is in a sunken area what type of ground suppo~ will be in place? What kind of impact will removing trees have on my property (example: irrigation) 5Wild Animals What b/pe of impact will this development have on the wildlife? 6 Proctor Avenue This road is a 2 lane road with no sidewalks. High School kids walk to and from If this construction is being done during school are these kids at risk to be struck by a car or truck, since there will be tots of trucks coming and going on this road. What will the construction schedule be? The site of this development is also off the road which is on a curve. Proctor is also a no passing zone area. There will be limes when traffic will be affected by this construction. Will there be a flag person directing traffic? 7 Schools Eik River Schools are past full capacity.. With the bond and levy not passing this past 'all class sizes are in trouble this year. My call was never returned. 9 Previous owner used site for dump. As of January 2002 there are still appliances in the woods. What type of testing has been done to make sure ground water and area is safe? On April 29, 2002 I contacted Chris Leeseberg of the planning commission regarding this issue. He told me, he did not think the city would need to do testing but probably developer would. He said he would check and get back to me. May 26, 2002 I left Chris another message regarding testing. May 28, 2002 Chris called and told me that he was not sure if any testing was done on the site and said that he believed the Developer may have.
