BACKGROUND/DISCUSSION At the October 8, 2012, City Council meeting, staff,along with Sherburne County Auditor Diane Arnold and Sherburne County Ditch Inspector Mike Lindenau, requested direction on whether the city would Eke to continue paying for ongoing ditch maintenance or assess it to the property owners like other cities and townships in the county. The assessments are based on actual drainage issues directly affecting the benefited property. In most cases, the homeowner is experiencing an issue and requires the county to proceed with an emergency repair which will be assessed back. The county has approached this so far on a reactive basis in comparison our street assessments which are on a proactive basis. The City Council requested the county prepare a listing of what the assessed costs to the city and property owners would have been for the past several years. The attached document indicates what the assessed costs would have been. County records indicate that 1992 was the last year the county assessed Elk River residents for county ditch work. In 1996, the City of Elk River started paying ditch assessments for work done on the ditch system within the city limits. Sherburne County Attorney Kathleen Heaney, Sherburne County Auditor Diane Arnold, and Sherburne County Ditch Inspector Mike Lindenau will be present at the meeting to answer any questions. Staff is seeking direction to proceed with drafting an MOU with Sherburne County to return the ditch assessment process back to the county as originally established. BAC KG ROUN DID ISCU SSION The Sherburne County Auditor's office contacted the city questioning why we pay ditch repair costs when other cities in Sherburne County assess it to the property owners. Staff researched the question and determined that the City Council completed a study in the early 1990's regarding charging developers a surface water management fee similar to a park dedication fee. Since most ditches in Flk River abut and benefit single family residential properties, it appears that the city chose to utilise funds from surface water management fees instead of a ditch assessment. As you know,with very little new development,increasing needs for stormwater improvements and anticipated stormwater management mandates, the Stormwater Management Fund is nearly depleted and a larger general property tax levy will be needed to pay for the costs of stormwater management. The Council has discussed a Stormwater UUtihty, but has not taken action. Sherburne County Auditor Diane Arnold will be present to discuss how other Sherburne County cities handle ditch work to determine if the city would like to continue covering all of the costs or assess property owners for work on ditches affecting their property.
