Analysis
The subject property, totaling 27 acres, is currently unused farmland. This preliminary plat is
the third phase of Mississippi Oaks originally proposed in 1993. In 1996, Mississippi Oaks
2na Addition was approved by the City Council.
Layout
The preliminary plat includes an extension of Concord Street out of Mississippi Oaks 2na
Addition, connected to County Road 30 by Denver Street. Two cul-de-sacs are proposed,
Riverview Court and Concord Court.
District Requirements
The 51 lots as proposed meet the minimum lot area requirements and width requirements
for the Rlb and Rlc Zoning Districts. The minimum lot area is 12,000 square feet with the
minimum lot width requirement being 80 feet. The smallest lot in the plat is 12,000 square
feet, Lot 21, Block 2 and the largest being 52,860 square feet, Lot 26, Block 2.
Access
The plat provides access to Mississippi Road at Denver Street and connection to the existing
subdivisions on Concord Street. During the staff review and as indicated in Bruce West's
May 6th memo, the Fire Department requested that Concord Street be connected to
Mississippi Road in order to eliminate a cul-de-sac, which exceeds 700 feet (as shown on the
original concept plan). There is a concern on the part of the Planning and Engineering staff,
however, that this will create a "short cut" situation with that portion of Concord Street
lying north of Mississippi Road. Residents could travel from Orono Parkway through
Concord Street to Mississippi Oaks 3ra Addition and in the reverse to access Highway 10.
An alternative to that recommended by the Fire Department would be to provide a
connection to Denver Street to Concord in an alternate alignment. This would remove a
few lots from the proposed subdivision. The cul-de-sac could also be shortened
Grading and Utilities
These are addressed in the City Engineer's memo.
Park Dedication
At its May 8, 2002 meeting, the Park and Recreation Commission reviewed the original park
dedication requirements from 1993 (see attached minutes). The Commission walked the site
and recommended that the developer dedicate the land below the bluff behind Lots 25-29,
Block 2. Access to the parcel will be provided by Outlot A proposed on the plat. The
Commission is requesting 2.7 acres; if this area is not that large, the rest of the requirement
will be met in cash. The lots will need to be revised to meet this requirement.

Planning Commission Action
The Planning Commission held a public hearing on May 28, 2002 regarding the request.
The developer and members of his family spoke vehemently against the requirement of 2.7
acres of parkland for dedication even though the land being requested is in the floodplain.
Staff would note that for this credit, the applicant is not being required to pay $78,540 in
park dedication fees, which normally would have been required for accepting land in the
floodplain. Nor is the applicant losing any lots in the subdivision to accommodate this
request.
The Commission added a condition requiring sidewalks on Denver and Concord Streets.
Recommendation
Staff and the Planning Commission recommend that the City Council approve the
preliminary plat of Mississippi Oaks 3rd Addition with the following conditions:
1. ALL COMMENTS OF THE CITY ENGINEER SHALL BE ADDRESSED.
2. STREET LIGHTS SHALL BE INSTALLED AS REQUIRED BY ELK
RIVER MUNICIPAL UTILITIES.
3. A SEALCOAT FEE SHALL BE PAID PRIOR TO RELEASING THE
PLAT FOR RECORDING.

Dear Ms. McPherson and City Planners
As the homeowners of Mississippi Oaks we all have questions on the planning of Phase III of Mississippi
Oaks. As you have well been made aware for years, Mr. Moldenhaurer needs to be followed closely,
very closely when developing his development. We have questions that we all feel need to be looked at
before he should be allowed to continue.
· Mr. Moldenhaurer has not followed city codes. Example:
· Driveway widths etc. Knew what it should be, but did what he wanted it to be
· Lot size - - told it was this size, when comes to have it staked out-completely in-correct.
· Cutting of river trees etc. DNR was involved. Has he completed his requirements? He should be
accounted for his large and costly mistake to nature. We were made aware by letter from the city
stating that he would like to put in "walk-ins" along the river banks. He was told NO, but went ahead
and proceeded to chop down trees along the bank and down the banks for his own good, not
following city orders etc.
· Allowing dumping of material in empty field by citizens of Elk River-not Mississippi Oaks Homeowners
As discussed at your last planning meeting, in the beginning 6 years ago he had given the city 2 acres,
correct me 2 acres along the back waters of the river to be left alone? Now it seems he has changed it to
only 1 ? Wasn't this in the plan from the beginning of the "development" of Mississippi Oaks? His signs say
bike paths, that would be a nice walking or bike path along the banks. If he said 2 then 2 it should be.
There are drainage culverts in the development that run along property lines in which are very necessary.
Six years and still as of today many home back yards fill with water because the lock of proper drainage
and grading. In the first purposed plan he has some of this left alone, (meaning drainage areas) now
from the looks of things homes will be on the drainage path. Will this be allowed?
We laugh because the" Mississippi Oaks" development name really is like "Mississippi No Oaks" from all
of the trees which have come out or taken out by Mr. Moldenhaurer. Please consider some of the past
problems when deciding his purposed plan. He has already taken the first action with or with out your
recommendation in preparing his land. Please consider when making your decision the lack of respect Mr.
Moldenhaurer has shown toward the city and his development homeowners.

Dear Ms. McPhearson:
As requested, we have reviewed the submittal package for the proposed Mississippi Oaks 3rd Addition. This is
the third and final phase of a project located adjacent to County Road 30 (Mississippi Road) that was begun
approximately ten years ago. Based on our review and comments received at the staff review meeting we
would offer the following comments:
The submittal package consisted of a preliminary plat, preliminary grading drainage and erosion control
plan, and preliminary utility plan. All three were prepared by John Oliver and Associates, the first two
were dated April 26, 2002; the final one was dated April 30, 2002.
The proposed plat consists of fifty-one single-family tots. A portion of the lots are located along the
Mississippi River bluff line. All the plans should clearly identify the bluff line.
The plat shows one access on to County Road 30 at Denver Street. Concord Street ends in a cul-de-sac
that is approximately 850 feet long, slightly longer than the city ordinance allows rather than also
accessing Mississippi Road. At the staff review meeting there was substantial discussion relative to
whether or not Concord Street should also make a connection with Mississippi Road.
From Sherburne County's perspective, which is jurisdictionally responsible for Mississippi Road, they will
allow a new access, which creates a four-legged intersection at any existing "tee" intersection. Therefore,
Concord Street could access Mississippi Road adjacent to the existing Concord Street on the north side.
From a Fire Department perspective this would make for an easier route to get an emergency vehicle into
this development assuming the new Public Safety Building is constructed at the City Hall site. The
emergency vehicle could simply come down Orono Parkway, turn on Concord Street, cross Mississippi
Road and be in the Mississippi Oaks 3rd Addition. From a general transportation route perspective, I am
concerned a connection at Concord Street would lead to vehicles wanting to access T.H. 10 to the west,
to head out Concord Street, cross Mississippi Road and travel through essentially a residential
neighborhood to get to Orono Parkway. From Orono Parkway they could travel west to Joplin Street and
then north to the signalized intersection at T.H. 10. I believe that the access at Denver Street will cause
the trips wanting to head west on T.H. 10 to head west on Mississippi Road first to Joplin Street and then
north to the signalized intersection at T.H. 10. I am concerned that the City would see a number of
complaints from the existing neighborhood north of Mississippi Road about vehicles traveling through their
neighborhood if a connection is made at Concord Street.
From a public works perspective, Phil Hals expressed concern about the maintenance of a cul-de-sac
versus the maintenance of a through street connecting at Mississippi Road. However, his concerns were
minimized when the consensus of the group was that if a connection is made at Concord Street there

would still be a cul-de-sac somewhere in this general area to maximize the number of lots in the
development.
There were no drainage calculations provided with the submittal package. Drainage calculations will have
to be submitted, reviewed, and approved prior to final acceptance of the proposed development.
There is a drainage and utility easement shown over a wetland area in the rear of Lots 11 and 12 Block 2.
If this area fills too full there is an emergency overflow set at elevation 870.0 where water from the wetland
could spill out into the street. The two houses adjacent to this emergency overflow have a lowest opening
of 871.0; this all meets the city requirements. However, if the catch basins in the street were to plug water
would spill back into the wetland/ponding area behind Lots 11 and 12. It could then rise to an elevation of
872.1, which is the high point in Concord Street. As the drainage calculations are prepared for this
development special care should be taken to look at this situation and to address this concern.
Lots 13 through 22 in BIock 2 are shown as lookout lots. The elevations in the front and rear of the homes
would indicate full basement lots. A correction should be made to these lots.
Lots 18 through 29 Block 2, and Lots 1 and 2 Block 3, are shown to have a lowest floor one foot above the
100-year flood elevation of 868.5. In fact, the City's policy has always been to have a lowest floor two feet
above a 100-year flood elevation, and a lowest opening one-foot above an emergency overflow elevation.
Each of the lots in question should be reanalyzed to ensure that the lowest floor is two feet above the 100-
year flood elevation.
The typical lot detail shows a designation for a full basement half walkout, and a full basement split
walkout. It is unclear what these designations represent relative to house style. Clarification on these two
designations is needed.
The water main shown on the utility plan in Riverview Court and Concord Street needs to be looped. The
actual placement of hydrants and valves through out the development will be reviewed with the fire chief
and the general manager of the Elk River Municipal Utilities when final construction plans are submitted
for review.
Based on the total length of street in the proposed development the seal coat impact fee should be
$5,55O.OO.

Anderson, brought up the discussion of connecting Concord Street with Mississippi Roa&
The issue of Concord Street within the Mississippi Oaks, Third Addition also raises the issue
of the extended cul-de-sac and its len~h from Denver Street of which exceeds 800'.
The Elk River Fire Department would like to see Concord Street extended to Mississippi
Road that would facilitate response time in reference to any emergency incident in the area
of Mississippi Oaks, Third Addition.

plat issues being resolved including Letter of Credit, Developers
Agreement, and the plat being recorded.

3.4. Park Dedication for the Plat of Mississippi Oaks
Dave Anderson, Park and Recreation Commission representative, indicated
that the Park and Recreation Commission recommended the dedication cf a
20 foot wide trail corridor from the trail in the southeast corner of
the plat of Heritage Landing to the right-of-way of Riverview Drive in
Palmer's First Addition, with the trail to continue in future phases of
Mississippi Oaks from Riverview Drive east to the right-of-way of the
future Concord Street. Dave Anderson indicated that the Park and
Recreation Commission also recommended that one acre of the northern
portion cf the floodplain included in the plat be dedicated as park in
a future phase and that Lots 1, 2, 3, and 4,~ Phase 2, be dedicated as
park during the first phase.
Gordon and ltv Moldenhauer both stated that they offered three lots,
Lots 1, 2, and 3, cf Block 2, to the Park and Recreation Commission,
however, the Park and Recreation Commission requested four lots. He
stated that Lots 1, 2, and 3, e~cfual at least an acre of land and the
fourth lot puts the amount well over one acre of land.
Councilmember Scheel indicated that the Council should take into
consideration the portion cf the floodplain land which is being
donated.
