Call Meeting To Order Pursuant to due call and notice thereof, the meeting of the Elk River Planning Commission was called to order at 6:30 p.m. by Vice Chair Westberg. 2. Consider 2/12/2013 Planning Commission Agenda MOVED BY COMMISSIONER ERIC JOHNSON AND SECONDED BY COMMISSIONER KONIETZKO TO APPROVE THE FEBRUARY 12,2013 PLANNING COMMISSION AGENDA. MOTION CARRIED 5-0. • 3. Consider 1/08/13 Planning Commission Minutes MOVED BY COMMISSIONER ERIC JOHNSON AND SECONDED BY COMMISSIONER KONITEZKO TO APPROVE THE JANUARY 8,2013 MINUTES. MOTION CARRIED 5-0. 4.1 Request by The Bank of Elk River for a Conditional Use Permit to Allow Single Family Use of Property Zoned C2 Office District. Located at 230 Evans Avenue. Case No. Cu 13-02, Public Hearing Planning Manager Jeremy Barnhart stated that the applicant,The Bank of Elk River, requests a Conditional Use Permit in order to convert the C2 commercially-zoned property at 230 Evans Avenue back to a single family residential use. Approval of the CUP will allow the applicant to obtain a building permit for improvements to convert the structure back to residential,including replacing the garage doors and adding egress windows in the basement level. Vice Chair Westberg opened the public hearing. Corey Wemple, representing the applicant, stated he was present to answer any questions. • There being no public comment,Vice Chair Westberg closed the public hearing. Planning Commission Minutes Page 2 February 12,2013 MOTION BY COMMISSIONER ERIC JOHNSON AND SECONDED BY • COMMISSIONER KONIETZKO TO RECOMMEND APPROVAL OF THE REQUEST BY THE BANK OF ELK RIVER FOR A CONDITIONAL USE PERMIT TO ALLOW SINGLE FAMILY USE FOR PROPERTY ZONED C2 OFFICE DISTRICT, 230 EVANS AVENUE,WITH THE FOLLOWING CONDITIONS: 1. AS A CONDITIONAL USE PERMIT IS NOT A BUILDING PERMIT,THE APPLICANT SHALL APPLY FOR ALL REQUIRED PERMITS. 2. THE DEVELOPMENT SHALL MEET ALL APPLICABLE FIRE CODES. 3. NO ACCESS ONTO MAIN STREET IS PERMITTED. MOTION CARRIED 5-0. 4.2 Confirm Consistency with Comprehensive Plan for EDA Sale of Outlot A. Northstar Business Park Mr. Barnhart stated that the Planning Commission is asked to confirm that the sale of Outlot A,Northstar Business Park is consistent with the Comprehensive Plan. He reviewed the staff report. Commissioner Eric Johnson stated that the property is adjacent the Northstar Corridor. He asked if the proposed buyer would be allowed to alter the "streetscape" of the property. Mr. Barnhart stated that the property is not buildable, • so no building permits could be issued for structures or signs. Vice Chair Westberg asked it the status of the oudot could be changed. Mr. Barnhart stated that a future property owner could apply for a change,but that a deed restriction will be placed on the property to prevent future platting. Vice Chair Westberg asked if any structures could be placed on the property, such as a wind turbine or a hunting shack. Mr. Barnhart stated no. Commissioner Konietzko asked if a portable deer hunting stand could be used. Mr. Barnhart stated that he was not sure. He stated that he would convey the Commissioners' concern that they did not want to see structures of any type on the property, nor did they want storage or junk to accrue. Commissioner Konietzko asked if storage would be an allowed use. Mr. Barnhart stated no, since storage is an accessory use, and must be tied to a principal use of which there is none. Commissioner Eric Johnson asked if the wetlands were regulated by the city or the state. Mr.Barnhart stated that both agencies are involved; the stormwater pond is regulated by the city, and the wetlands are regulated by the state. Commissioner Eric Johnson asked if the property could be tilled up. Mr. Barnhart stated no. MOTION BY COMMISSIONER ERIC JOHNSON AND SECONDED BY COMMISSIONER KONIETZKO TO CONFIRM THAT THE SALE OF OUTLOT A,NORTHSTAR BUSINESS PARK IS CONSISTENT WITH • Planning Commission Minutes Page 3 February 12,2013 • THE COMPREHENSIVE PLAN,WITH THE FOLLOWING CONDITIONS: 1. THE PROPERTY MAY NOT BE PLATTED OR SUBDIVIDED. 2. THE WETLAND MAY NOT BE ALTERED. 3. NO STRUCTURES ARE ALLOWED. THE MOTION CARRIED 5-0. 5. General Business—None 6. Announcements 6.1 —A Planning Commission workshop will be held on February 26,2013 at 6:30 p.m. Items for discussion include concept review of a convenience store and proposed ordinance amendments. 6.2—The Comprehensive Plan update process will be starting soon. A consultant is expected to be named sometime in the beginning of April. 6.3 -The Planning Commissioner are invited to attend the Volunteer Recognition event to be held on March 6th. 6.4—Commissioner Paul Bell's term is expiring shortly and he is not seeking reappointment. Jeremy Johnson has been appointed by the City Council to fill this vacancy. His term begins after being sworn in at the February 26th meeting.
