ACTION REQUESTED
Adopt by motion the attached resolution amending the land use of Lot 1,Block 1 Hillside Crossing from
Open Space to Highway Business.
BACKGROUND/DISCUSSION
This land use change corrects an error in the land use map.
Planning Commission Comments
The Planning Commission reviewed the request and had no issues with the proposed change and
unanimously recommended approval of the request.
Public Comments

A RESOLUTION AMENDING THE COMPREHENSIVE PLAN
TO CHANGE THE LAND USE
FROM OPEN SPACE (OS)TO HIGHWAY BUSINESS (HB)
Case No. LU 13-01
WHEREAS, Minnesota Statutes,Chapter 462.355,Subdivision 2,prescribes the procedure for
amending the Comprehensive Plan,and
WHEREAS, the Planning Commission held a public hearing on March 12, 2013, and
recommended approval regarding the Comprehensive Plan amendment request for
the property generally described as:
Lot 1,Block 1,HILLSIDE CROSSING,
Sherburne County,Minnesota
And as shown on Exhibit A attached;and,
WHEREAS, the City Council has reviewed the Comprehensive Plan amendment request and
finds the following:
1. The current use of the site is consistent with Highway Business uses.
2. The land use is consistent with the surrounding land uses.
3. The use would not have adverse impacts on the surrounding land uses.
4. The proposed changes are in general conformance to the adopted Comprehensive Plan.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River that the
Land Use Plan be amended to change the property as described above from Urban Residential to
High Density Residential.
Passed by the City Council of the City of Elk River this 18th day of March,2013.

ACTION REQUESTED
Staff recommends the Planning Commission recommend approval of the Land Use amendment.
BACKGROUND/DISCUSSION
During the last comprehensive plan update in 2004, the land use designation for the Northbound Liquor
store property was created as Open Space. Staff is unaware of why it was designated that during the last
update. The property is surrounded by the Highway Business land use and houses a retail business.
Comprehensive Plan
The Highway Business land use is the most intensive form of commercial development in Elk River.
Businesses in this category may be the largest both in terms of size and traffic generation. Market
orientation tends to be regional in nature. Development orientation tends to be toward regional
highways. Future Highway Business developments should be located within the Urban Service Boundary
and adjacent to regional highways. Examples of Highway Business uses include discount retailers,
grocery and general merchandise.
Because liquor sales are an appropriate land use for Highway Business, staff is recommending the subject
property land use be amended from Open Space to Highway Business.
