ACTION REQUESTED
Adopt by motion the attached ordinance rezoning certain property from Single Family Residential to
Highway Commercial.
BACKGROUND/DISCUSSION
This zone change corrects an error in the zoning map. The property is zoned C-3 to give clarity to future
uses.
Planning Commission Comments
The Planning Commission reviewed the request and had no issues with the proposed change and
unanimously recommended approval of the request.
Public Comments
No comments for or against the request have been received.

CITY OF ELK RIVER
AN ORDINANCE AMENDING THE
CITY OF ELK RIVER ZONING MAP TO REZONE CERTAIN PROPERTY
FROM R1C SINGLE FAMILY RESIDENTIAL TO C3 HIGHWAY
COMMERCIAL
CASE NO. ZC 13-02
The City Council of the City of Elk River does hereby ordain as follows:
Section 1. That the duly adopted Zoning Map of the City of Elk River is hereby
amended to rezone the property described on attached Exhibit A from Single Family
Residential (R1C) to Highway Commercial (C3) as shown on Exhibit B.
Section 2. That the rezoning approved by this Ordinance is based on the following
findings:
1. THE REZONING IS CONSISTENT WTH THE CITY OF ELK RIVER
LAND USE PLAN ADOPTED AS PART OF THE CITY OF ELK RIVER
COMPREHENSIVE PLAN.
Section 3. That this Ordinance shall take effect and be in full force from and after the
date of its publication.
Passed and adopted this 18th day of March,2013 by the City Council of the City of Elk
River.

ACTION REQUESTED
Staff recommends the Planning Commission recommend approval of the Zone Change request.
BACKGROUND/DISCUSSION
The subject property has been shown on the zoning map as Planned Unit Development (PLTD) for some
time. Upon review of past rezoning's in the area, the subject property never was rezoned from Single
Family Residential (R1-c) to PUD, so the current zoning map is in error.
With this recent discovery, staff is recommending the subject property be rezoned from R1-c to Highway
Commercial(C-3)which is consistent with the underlying land use of Highway Business. Staff is not
recommending a zone change to PUD as the C-3 gives more clarity to the development community as to
what the City is looking for the subject parcel.
