BACKGROUND
The City Council granted a conditional use permit to Mr. and Mrs. Martin for a private
kennel on June 17, 2002. The Martins have five show dogs. All of the dogs have been
licensed and a private kennel license application has been completed.
ACTION REQUESTED
Council motion approving a private kennel license for Donald and Kathryn Martin for five
dogs at 19947 Polk Street.

PRIVATE KENNEL
Private Kennel: More than 3 dogs or 3 cats over the age of 6 months; or more than 10 cats
over the age of 6 months if iocated on a premises of 10 acres or more as long as the cats
have been spayed or neutered. Private kennels are allowed in the A-1 zones as an accessory
use and in the R-1 a Zone as a conditional use.

I am familiar with state laws and local ordinances regarding the care and treatment of
animals and operation of kennels and have reviewed the Code of Ordinances for the City of
Elk River, Secdon 502, and represent that the above described kennel activities will be
operated consistent with state law and local ordinances as described above. I also
understand that this permit must be renewed each year.

Analysis
The applicant, who currently resides in Cincinnati Ohio, recently purchased a home in Elk
River and will be moving in towards the end of May. They are requesting a Conditional Use
Permit for a Private Kennel in order to keep five (5) dogs, all of which will be kept inside the
home. In the Rla District, which surrounds the subject property, private kennels are
allowed as a conditional use.

Planning Commission Action
Kathy Martin, applicant, discussed the proposal and stated that they would be constructing a
six foot high privacy fence along the front and sides of the property and a chain link fence
along the rear facing the woods. She stated that they have five show dogs, which she has
raised for a very long time. They stay in the house most of the time and she does not keep
them outside in order to reduce barking.
The Planning Commission voted unanimously to recommend approval of the Conditional
Use for a Private Kennel.
Recommendation
Staff and Planning Commission recommend that the City Council approve the Conditional
Use Permit for a Private Kennel with the following conditions:
1. THAT THERE BE NO ON-SITE COMMERCIAL ACTIVITIES SUCH AS
BREEDING, BOARDING OR SELLING.
2. THAT THE ANIMAL WASTE BE DISPOSED OF PROPERLY.
3. THAT THE APPLICANT RECEIVES A PRIVATE KENNEL LICENSE
FROM THE CITY COUNCIL.
4. THE NUMBER OF DOGS OVER 6 MONTHS SHALL NOT EXCEED
FIVE.
