Adopt by motion the attached resolution vacating a portion of the drainage and utility easement over a
portion of lots 4, 5, and 6, block 4, Prestigious Woodland Hills.
BACKGROUND /DISCUSSION
The property owner is in the process of adjusting the boundary lines associated with part of Block 4,
Prestigious Woodland Hills to facilitate the sale of the new lots to new buyers. While the adjustment of
boundary lines (creating no additional lots) can be completed administratively, the existing easements
require Council approval after a public hearing to be vacated. The easements need to be vacated to
accommodate logical home construction. The easements will be replaced and relocated to the new
boundary lines in a separate document to be recorded against the properties.

RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION FOR VACATING A DRAINAGE AND UTILITY
EASEMENT
Case No. EV 13 -01
WHEREAS, the applicant has requested the City Council in a petition dated March 22,
2013, to vacate such easements according to law; and,
WHEREAS, a public hearing was held on April 15, 2013, before the City Council at the
Elk River City Hall on such petition after due published and posted notice
had been given and all persons interested were given an opportunity to be
heard; and,
WHEREAS, vacation of the easement is appropriate as it offers no existing or potential
value to the city of utilities.
NOW, THEREFORE, BE IT RESOLVED that such petition is hereby granted and
the easement described as follows is hereby vacated:

EXHIBIT A
To vacate a portion of the utility and drainage easements as dedicated on the recorded
plat of RESTIGIOUS WOODLAND HILLS situate in Sherburne County, Minnesota
being a part of Lots 4,5. and 6. Block 4, said PRESTIGIOUS WOODLAND HILLS and
being described as follows: that part of said lots 4, 5, and 6, which lies 5 feet on each side
of and adjacent to the southeasterly line of said Lot 4 and the westerly line of said Lot 6,
except the southeasterly 10 feet of said Lots 4 and 5 and the southeasterly 10 feet of said
Lots 5 and 6 and the north 10 feet of said Lots 4 and 6.
