ACTION REQUESTED
Approve by motion a special event permit for Broadway Bar and Pizza to hold a car show on May 19,
2013,with the following conditions:
1. The fire burnout event is not allowed.
2. On-street parking to be used for customers only.All display vehicles must be confined to
Broadway Bar and Pizza property.
3. 167`''Avenue to remain open to 2-way traffic.
4. Liquor is only permitted inside the building and on the patio, and strictly enforced by bar
staff.
5. Exterior sound systems/music must comply with city noise ordinance.
6. Applicant must notify area residents of event and anticipated increase in street parking.
7. Prior to display, all temporary signage shall receive the appropriate permit.
8. Applicant must contact Fire Marshal Cliff Anderson at 763.635.1110 or 763.238.3489 during
event set up for a walk-thru inspection of the property to ensure property accessibility to the
buildings and adjacent properties is maintained during the event.
9. Applicant must provide portable toilet facilities as outlined in the application.
BACKGROUND/DISCUSSION
Broadway Bar and Pizza has submitted a special event application to hold a car show on Sunday,May 19,
2013, from 9 a.m. until 3 p.m.
Mr. Kurth has requested to hold a fire burnout event as part of the car show. The Police Chief
recommends denial of the fire burnout citing safety and noise concerns due to the close proximity to a
residential area as well as an ordinance prohibiting exhibition driving. Mr. Kurth is aware of the
recommendation for denial of the burnout event and has decided to eliminate the contest from the event.

Sec. 74-61. - Exhibition driving.
No person shall turn, accelerate, decelerate or otherwise operate a motor vehicle within the city on
any street, highway, roadway, private road, public or private parking lot or other public or private property in
a manner which causes unnecessary engine noise or backfire, squealing of tires, skidding, sliding, swaying,
or throwing of sand, gravel or other loose debris, or in a manner simulating a race. Unlawful acceleration of
a motor vehicle under this section is hereby prohibited and defined as acceleration which spins a tire
resulting in the breaking of traction between a tire and the surface in such a manner as to cause a
squealing or screeching sound by the tire or the throwing of sand, gravel or other loose debris by the tires
of the vehicle or both. Squealing or screeching sounds emitted by the tires or the throwing of sand, gravel
or other loose debris by the tires is prima facie evidence of a violation of this section.
