BACKGROUND /DISCUSSION
At Open Forum during the May 6, 2013, Council meeting, Mark Leadens, owner of the Natures Dry
Cleaning and Laundromat, addressed the Council with his concern with the amount of calculated Sanitary
Sewer and Water Availability Charges (SAC and WAC).
SAC and WAC costs are often raised collectively as they are calculated the same way. For the purpose of
this discussion, staff's research focused exclusively on SAC rates and units.
Mr. Leadens raised three primary issues.
1. The SAC rate per unit was too high. The city charges $4,370 per unit.
2. An unreasonable number of SAC units were applied to his business. The city applied 16.09 units,
which reflects the three uses of the building, and the credit due to previous owner's payments.
3. Elk River Municipal Utilities has electrical utilities on his property without an easement. He
would like to trade an easement for a reduction or elimination of the SAC fee.
Responses
The purpose of the SAC program is to collect funds from new connections using capacity in the existing
sanitary sewer system. A reduction in capacity requires a volume expansion of the Waste Water
Treatment Plant. Since 2003, the city has collected $6,472,002 in SAC fees, and in 2009 a $4,412,000
plant expansion was completed. Some required expansions are not based on additional connections.
State and federal mandates require modifications to the plant, ahead of volume capacity needs. The 2013
Wastewater Treatment Plant Facilities Plan projects another $12 -22 million in necessary improvements,
due to state and federal mandates and capacity growth over the next 20 years.
SAC funds are not used for ongoing operating expenses. User fees are intended to pay operating costs, as
shown on the attached estimated sanitary sewer invoice.
SAC Rate Comparison
In 2007, Ehlers and Associates completed a Sanitary Sewer Rate Study on our behalf that included
assumptions for required plant expansion and a rate comparison with other communities.
It's a challenge to compare SAC rates between cities because each city funds installation of sewer

differently, including assessment, developer installation, and through fees not recognized by external
staff.
The attached Rate /Ratio Comparison sheet shows the SAC rate for Elk River and 8 neighboring cities,
based on their reported SAC rates and unit calculations. These rates range from $2,435 to $5,950. The
average for the Met Council cities is $2,447.80 and non -Met Council cities are $4,769.29. Elk River is
currently at $4,370. When applying each city's unit calculation to their rate, total SAC charges range from
$50,331.45 to $118,085 (see attached worksheet). Elk River is at $98,762. For ease of discussion, we did
not apply the credit for previously paid SAC units.
SAC rates for communities within Met Council's jurisdiction are generally lower, as the expenses to
improve the plants infrastructure are shared over a larger population of users and many of the
participating communities are fully built out.
SAC Unit Calculation
The number of SAC units applied to new development is calculated to consider the maximum capacity
constructed. The formula is set by ordinance and like many other cities, including Monticello, Rogers,
Ramsey, Otsego, and Big Lake, all use the Met Council model.
The Rate /Ratio attachment highlights the similarities and differences in rate calculation between 8
neighboring communities. The number of units range from 20.67 to 31.68.
The only other known Elk River coin laundry paid for 23.572 units of sewer capacity in 1985.
Alternatives
The Coin Laundry Association recently published an article that stated nationally, the average number of
cycles range from 3 to 8 turns per day. The Met Council, like Elk River, assumes 8 turns per day.
Although this report is unverified, if this assumption were to drop, the impact is drastic:

The City of Otsego has an escrow option for paying SAC charges when volume is questioned. The full
fee is collected and escrowed at the time of building permit. After three years, the water volumes are
calculated. In instances where the water usage falls below the escrowed funds, the balance is returned
without interest.
Utility Easement
The utility easement is an issue between ERMU and the property owner and was referred to ERMU.

In emails throughout the day,Mr. Leadens has requested additional documents,including the SAC/ WAC
history for the years 2007-2013 and the SAC/ WAC history for the Guardian Angels, Sportech, and
YMCA.

Mr. Leadens has expressed frustration over not receiving any information regarding the WAC. The WAC
is a fee established by Elk River Municipal Utilities based on their needs. The ratio of how many units are
applied to a given use are based on City Ordinance,based on the Met Council's ratios. These ratios are
very similar in our neighboring communities.

Attached are the reports of SAC charges from 2007 to present. All fees were paid at the time of issuance of a building
permit.
To your specific questions regarding Sportech,the YMCA, and Guardian Angels, I was able to pull their permit history
electronically.
Guardian Angels by the Lake has paid 43 SAC units over two different permits. Sportech paid 17 units, and the YMCA
paid 40 units.
WAC units are applied at the same ratio as SAC units. I did not research all guardian angels facilities,just the most
recent.

charges for what the YMCA paid the city up front copies of there bills &payments paid? showing what the
actually paid up front. All Sac and wac charges for new guardian angles facility's in Elk River, Sport Tech, I
would just like to see a list of other business and what they paid up front for wac & sac not just small business
but larger business also. since 2007. please snake sure they are split out Sac &Wac separately.

laundries.
Individual store performance varies considerably from business to business
based on a number of factors including: demographics; overall services
offered; design and general condition of store; equipment types, condition,
and vend price; hours of operation; parking; competition; and others. With
these factors in mind it can be difficult to arrive at a definitive average
applicable for every coin laundry.
National surveys, studies, interviews, and analyses indicate a wide range of
performance for individual stores. Performance is commonly expressed in
terms of TPD (turns per day) which represents the number of times each
machine is used during the given day. While this statistic varies widely
based on the factors mentioned above, the full range for washing machines is
generally from 2 TPD to 8 TPD, with a commonly reported average of 4 to 5
TPD for a successful coin laundry.
