Request
David and Judith Dirkes are requesting an Administrative Subdivision to
separate lot 4 from 5 and adjust the common lot line.
Location
The property is located at 18402 Boston Street N.W., Elk River (lots 4 and 5,
Heath's subdivision).(Adjacent to Orono Cemetery)

Overview
David and Judith Dirkes are proposing to separate lots 4 and 5 in Heath's
subdivision and adjust the common property hne. The Dirkes home is chiefly
on lot 5 with a portion on lot 4, necessitating moving the common lot line if
the lot 4 is to be sold and built upon. The total acreage of the combined lots
is 1.57 acres. After the subdivision, the acreage of lots 4 and 5 would be .84
and .73 acres respectively, or 36590 square feet and 31798 square feet
respectively.

Boston street has been approved by the City Council to receive city sewer and
water in late Summer, 1998. With sewer and water, the zoning ordinance
requires that lots in the Rlc be a minimum of 80 feet wide and 130 feet deep,
and at least 11,000 sq. ft. (.25 acres) Both of the new lots will meet these
dimensional requirements if subdivided. The lot split and lot line adjustment
would allow the applicant to develop this property to its full potential.
Street Right-of-Way
The current width of the Boston street right-of-way is 49.5 feet. The
standard in the Rlc is 60 feet. No additional right-of-way has been
requested.
Sewer and Water
The sewer and water improvements for Boston Street are scheduled for late
Summer, 1998. With out sewer and water the lot size minimum is 10 acres.
The improvements to sewer and water allow for lots with a minimum of 80
feet wide and 130 feet deep, and at least 11,000 sq. ft.
Easements
Five foot Drainage and utility easements will need to be provided along the
side property lines and ten foot along the front of each of the parcels.
Park and Recreation Commission Recommendation
The Park and Recreation Commission has recommended a cash dedication in
lieu of land to satisfy the park dedication requirements for the one new lot
being created.
Recommendation
Staff recommends that the City Council approve the request of David and
Judith Dirkes for and an Administrative Subdivision to separate lots 4 and 5
in Heath's subdivision and adjust the common property line with the
following conditions:
THAT FIVE FOOT DRAINAGE AND UTILITY EASEMENTS BE GRANTED TO
THE CITY ALONG THE SIDE PROPERTY LINES AND TEN ALONG THE
FRONT PROPERTY LINES OF THE PROPOSED PARCELS.

PAYMENT OF PARK DEDICATION FEE IN THE AMOUNT OF $650 FOR THE
NEW LOT BEING CREATED TO BE PAID PRIOR TO RECORDING THE
ADMINISTRATIVE SUBDIVISION.

PAYMENT OF SURFACE WATER MANAGEMENT FEE IN THE AMOUNT OF
$137.50 FOR THE NEW LOT BEING CREATED TO BE PAID PRIOR TO
RECORDING THE ADMINISTRATIVE SUBDIVISION.
THAT THE ADMINISTRATIVE SUBDIVISION BE RECORDED AFTER THE
SEWER AND WATER IMPROVEMENTS ARE COMPLETED.
