Consider Ordinance Restricting
Overnight Parking on City Streets
Attached is some material from the police department regarding parking
restrictions. Also attached is a draft ordinance from the city clerk which
limits the parking of motor vehicles (this includes licensed motor vehicle
related items such as trailers and boats) on city streets to no more than 24
hours in one location. Please note that this ordinance does not replace the 2
a.m. to 6 a.m. no parking requirement during the winter months which is
still necessary due to snow removal concerns.
I concur with the police department that the no parking 2 a.m. to 6 a.m.
should not be a requirement year round, and this 24 hour limitation should
address City Council concerns.
Action Requested
The City Council is requested to consider and approve the attached ordinance
imposing a 24 hour limit for parking on city streets.

AN ORDINANCE OF THE CITY OF ELK RIVER
AN ORDINANCE AMENDING SECTION 1100.10 OF THE CITY CODE
OF ORDINANCES PERTAINING TO PARKING REGULATIONS
The City Council of the City of Elk River does hereby ordain as follows:
Section 1. That Section 1100.10, of the City of Elk River Code of
Ordinances - entitled "Parking Regulations" shall be amended by adding a
new Section 10 entitled "Overnight Parking" and by changing the existing
Section 10 entitled "Petty Misdemeanor; Penalty," to Section 11.
10. Overnight Parking.
It shall be unlawful for any person to
leave, park, permit or allow any motor vehicle to stand or remain upon
any city street or right-of-way for more than twenty-four hours at any
time.
· Qll. Petty Misdemeanor; Penalty. Any violation of any of the
provisions of Section 1100.10 shall constitute a petty misdemeanor
punishable by payment, upon conviction, of a fine as determined by
resolution by the City Council. The fine shall be doubled if the fine
is not paid within seven (7) days, and/or if the violator has received a
parking violation within the last thirty (30) days.
Section 2. That this ordinance shall take effect and be in full force
from and after the date of its publication.
Passed and adopted this 10th day of August, 1998 by the City Council of the
City of Elk River.

Overnight parking restrictions
The police department has previously discussed the problem of overnight or extended
vehicle parking on city streets. The police department was directed to survey other cities
to see what their laws were regarding on-street parking. The survey Was done and is
attached for your reference.
There are also examples for the cities actual ordinances pertaining to parking included
with this report.
Of the eighteen (18) cities surveyed, ten (10) had restrictions which prohibited vehicles
from parking on the street between the hours of 2:00 a.m., and 6:00 a.m. on any night.
The cities surveyed had ten (10) which had restrictions on length of time a vehicle can
remain unmoved. Two (2) of these had a &hour restriction, three had a 24-hour
restriction, one (1) had a 48-hour restriction, and three (3) had a restriction but the
exact time was not specified. (They did not have time to send copies of their ordinances
and did not know the exact time limitations by heart.. )
It would appear that when the department had a 2-6am restriction, they normally did
not follow up by having additional time constraints. There were several however that
had both.
In reviewing this matter with staff, the consensus was that a 24-hour limitation would
best suit our city and the areas of concern. There does not appear to be a need to
totally restrict any overnight parking at this point in time.
Attached is a recommended ordinance regarding parking restrictions and the 24-hour
limitation. It is similar to those enacted and enforced by other cities.
We would ask that the council consider this ordinance for enactment.

person shall park or permit to be p0rked any vehicle on any
highway, street, or alley between the hours of 2:00 a.m. and 7:00
a.m. without an emergency parking permit ia.sued by the Blaine
Police Department. Any vehicle parked in violation of this sec-
tion may be removed as provided by section 19-35. The words
"highway, street, or alley" shall be construed to mean the entire
width of the right-of-way. (Code 1963, § 3.01; Ord. No. 86-942,

Sec. 19-31. Time limilation on parking after commencement
of snowfall.
No person in charge of any vehicle shall park or permit

parked any vehicle upon a public street when such parking interferes with the snow removal
operaxio~ of the city and any vehicle so parked may be removed by the city at the owner's e,,pense
in acco~,~-ce with the provisions of City Code §6.03.16, provided that the owner of said vehicle
is notified of th~ city's intrmtion ~n remove snow by the placement of a waning tag on such vehicle

General ly.
It shall be unlawful for any person to leave, park, permit or
allow any motor vehicle to stand Or remain upon any City street

Legislative Findings.
The City Council of the City of Spring Lake Park finds that the
parking of large trucks, tractors and other con~nercial vehicles
on the streets and rights-of-way within the City, for other than
temporary parking for delivery or unloading, creates an unnecessary
risk of personal injury, and often produces excessive noises.
Proh i b i ti on.
It is a violation of this ordinance for any person to leave,
park, permit or allow any motor vehicle described below upon any
public street or right-of-way:

{c) Trailers (the type pulled by tractor}.
(d) Commercial buses, except that school buses used in the
transportation of children to and from school may be
parked upon the street or public right-of-way between
the hours of 9:00 A.M. and 2:00 P.M. during the school
year.
Temporary parking of such motor vehicles for delivery or unloading
is excepted from this ordinance.

No property of any kind or description, except motor vehicles,
together with property lawfully attached thereto, may be parked,
stored or permitted to stand upon any City street or rioht-of-way
at any time, except as the same may be permitted by Act of the
City Council.

motor vehicle to be parked in front of or in such manner or place,
as to interfere with or hinder access by persons or vehicles to

VEHICLES WITHIN THE CITY OF CHAMPLIN, MINNESOTA.
D~FINITIO~ - Vehicle means every device in, upon, or by
which any person or.property is or may be transported or
drawn upon a highway, excepting devices used exclusively
upon stationary rails or tracks.
Every vehicle parked upon any street with a curb, shall
be parked parallel thereto and with the right hand wheels
within 12 inches of the curb. On streets without curbs,
vehicles shall be parked only to the right of the.
travelled portion of the roadway and parallel thereto and

Police shall have the authority to remove or provide for
the removal of any vehicle found parked in violation of.
this Ordinance or applicable state law, to the nearest
convenient garage or place of safety. All towing charges
and storage fees shall be paid by the owner of the
vehicle.
Any person violating any provision of this ordinance
shall be guilty of a misdemeanor and upon conviction
thereof shall be punished by'a fine of not more than
$700.00 or by imprisonment of not more than 90 days, or
both, plus the.costs of prosecution in either case.

The Council may also upon applicaIion by Ihe Fire Marshal or an owner, l~sse, e or
operator o£ any building, which building generally at~ract~ numerous numbers of the
public, d~ignat'e and thus establish a fire lane or fire lanes upon private property. Said
application shall be reviewed and approved or disapproved by the Fire Marshal prior to
being present~ to the City Council for Council approval. The designated area when
approved by the City Council shall effectively become a fire lane.
All designated zones pursuant to this Section shall be appropriately mm'ked at the
direction of the City, at the property owner's expeme when on private property, and the
City's expense when on public property; and unless otherwise provided within the
resolution or application approval, such restrictions shall apply every day of the week,
including Saturdays, Sundays and Holidays.

vehicle 'moved a distance of not more than one (1) block during the limited parking period shall be

Subd. 4. (~it'y Parks and Otl~r Public Property. No person shall stop, stand, or park a
vehicle in any place in a public park or on other public property except in designated parkin8

Subd. 5. Snow Emergency. After a snowfall of at least 2 1/2 inches in the City, parking
is prohibited on any public street or alley until and ai~r that particular street or alley has been
plowed and the snow removed to the curb line. It is unlawful to deposit snow or ice, plowed or
removed from private property, onto the traveled portion of a street, alley or public way.

subject to Subdivision 1. For purposes of this Section, the term 'truck' means a self-propelled
motor vehicle not operated on rails, having a capacity Of one and one-half tons or more, or any
tractor or trailer or combination thereof,

any vehicle on any street in from of the entrance to, or exit from, any church, hospital, school,
theaU;r, dance hall, ho~el or motel for the full width of such entrance or exit durin{ [he hours that
such buildings are in use by the public. Upon approval by The Chief of Police, the owner of any
such buildiu8 used for any of such purposes shall cause to be placed at such entranc~ or exit one
hour before such building is opeued to public use proper, adcquau: and visible signs giviu{ notice
to the public that parkin{ is prohibited during the hours of such public use. Such si~ shall be
removed when such public use of the building ceases.
1310.11. Towawav of Vehicles; Contractors. Subdivision 1. ~. A vehicle
parked in violation of this Code may be removed from any public sweet, alley or public way or
grounds by any police officer or City official. The owner or driver of the vehicle shall be
notified, if present or readily available, to remove the vehicle. Otherwise the vehicle may be
towed away to any garage, service station or other plaCe of safckeepin~ and impounded as herein
provided, to facilitate snow removal, street malntentnce, thc orderly flow of traffic, fire fighting,
or other lawful purpose. The owner shall pay the costs of such towin~ and storage. The removal
of a vehlclc by or under the direction of thc police officer or other City official docs not prevent
the prosecution of a violation of this Section.
Subd. 2. _proposals for Towin_~ ¢olutracto{'~. The City Manager shall solicit proposals
from persons dcsirir~ to act as towing contractors for vehicles impounded under this Section, and
the Council may, by resolution, accept the proposal of one or more of the proposers as official
towing contractors of the Cit);.

Section 725:31.24 Hour Limitation. No person shall park a vehicle on any street in the City
or · period longer than twenty-four (24) consecutive hours.
Section 725.32. TruGk. Bus. Trailer. and Eoui0ment Parkln_= In Residentlal Areas. No parson
shall park and/or store on any street immediately in front of a property used as · 'place of
residence, and on the same si~e of the street as a prope~y that is used as a place of
residence, any commercial vehicle, or any trailer, farm vehicle or farm equipment, or
construction equipment except es provided below.
Subd. 1. For the purpose of this section, a commercial vehicle shall be defined as:
Any vehicle with Minnesota license plates carrying a designatin of 'BY' (bus,
except as provided below), 'CZ" (commercial zone 'Truck); or
Any vehicle with Minnesota license plates carrying a designation of "Y' {truck
with Minnesota base plate) or 'T" (farm truck}, and displaying on the lower
right corner of the license plate any gross vehicle weight designation of "F'
through "T"; or
c. Any vehicle with a gross vehicle weight in excess of 9,000 lbs.
Commercial vehicles described above shall Include but are not limited to buses, dump
trucks, tow trucks, truck-tractorS, step vans, cube vans, delivery trucks and the like.
Subd. 2. Commercial vehicles, trailers, farm vehicles, farm equipment, and
construction equipment shall be subject to ali other provisions of this ordinance;
however, the prohibitions of this Section shall not apply to the following:
Commercial vehicles that are actually in the process of being loaded or unloaded
in the due course of business.

Section 27-~21~ REMOVAL OF ILLEGALLY PARKED VEHICLES. Any vehicle parked in
violation of the ordinance of the C[=y or in violation of any S=a~e law may be
removed by towfn~ a= :he direction of the City police to a suitable place for
s~orase until claimed by ~he owner or his assnt, and the owner or other person
responsible for such parkin~ of =he vehicle shall be liable for the reasonable cost
of such cowing and storage.
