1. Call Meetin.q To Order
Pursuant to due call and notice thereof, the meeting of the Ell< River City Council
was called to order at 5:02 p.m. by Mayor Duitsman.
2. Consider 8/10/98 A.qenda
COUNCILMEMBER THOMPSON MOVED TO APPROVE THE 8/10/98 AGENDA.
COUNCILMEMBER HOLMGREN SECONDED THE MOTION. THE MOTION CARRIED 3-
O.
3.1. Discuss Status of City Planner Selection Process
City Administrator Pat Klaers explained that a top candidate has withdrawn his
application for the city planner position. A second interview with another
candidate has been scheduled for Wednesday, August 12. Pat noted that
many metropolitan cities are in the process of completing their comprehensive
updates. He felt this may be contributing to the limited interest in the position
simply because city planners are too busy. Pat suggested that if a suitable
candidate is not found, it may be appropriate to wait until after the first of the
year and hire a consultant, such as Jim Brimeyer, for assistance in filling the
position.
It was the consensus of the City Council to wait for a recommendation from the
committee.
The City Council recessed at this time (5:12 p.m.)
Councilmember Dietz arrived at this time (5:18 p.m.)
The City Council reconvened at 5:18 p.m.
3.2. Consider Ordinance Restrictinq Parkin.q on City Streets more than 24 hours
Pat Klaers indicated that staff concurs with the police department that the no
parking from 2 a.m. to 6 a.m. should continue to be a requirement only in the

winter and felt the proposed 24 hour limitation should address the Council's
concerns. He noted that the police department is comfortable with the
proposed ordinance.
COUNCILMEMBER DIETZ MOVED APPROVAL OF ORDINANCE NO. 98-13, AN
ORDINANCE AMENDING SECTION 1100.10 OF THE CTY CODE OF ORDINANCES
PERTAINING TO PARKING REGULATIONS. COUNCILMEMBER THOMPSON
SECONDED THE MOTION. THE MOTION CARRIED 4-0.
3.3.
Consider Ordinance Amendment to Section 200 of the City Code Relatin.q to
City Council Meetin.qs
Pat Klaers indicated that the proposed ordinance was drafted in response to
the City Council discussion in July. Councilmember Holmgren questioned the
need for changing the regular meeting date to the second Monday, since they
generally meet every Monday night anyway. He felt the EDA should be given
an opportunity to provide their input due to the fact the second Monday of
each month is the EDA meeting night.
Pat Klaers indicated that the Council meeting will not stod until after the EDA has
finished all their business. He suggested the Council could meet at 5:00 p.m.
before the EDA meeting to conduct administrative business and reconvene later
if the agenda is unusually long.
Councilmember Holmgren asked if the Council packets could be sent out on
Thursday. Pat indicated that he did not foresee a problem sending out the
packet for the second Monday meeting on Thursday, but it would be difficult to
have all the information assembled on Thursday for the 3rd and 4th Monday
Council packets.
COUNCILMEMBER THOMPSON MOVED TO POSTPONE ACTION ON ORDINANCE
NO. 98-__, AN ORDINANCE AMENDING SECTION 200 OF THE CITY CODE OF
ORDINANCES PERTAINING TO COUNCIL MEETINGS, UNTIL THE AUGUST 17, 1998
CITY COUNCIL MEETING. COUNCILMEMBER HOLMGREN SECONDED THE MOTION.
THE MOTION CARRIED 5-0.
3.4. Update of Semi Tractor Issue
Victoria Lane
A discussion was held regarding the Victoria Lane semi tractor owner's request
for an entrance from County Road 32 onto his property. Pat Klaers explained
that he felt it was appropriate for the access permit from the county to be issued
to the city in order to maintain some control. He stated that if the permit is
granted, the county will supply the culved and the city will construct the
driveway. Conditions will be imposed by the cib,, for use of the driveway
regarding nuisance activities. Pat noted that a draft letter to the property
owner with city conditions will be available soon.
Councilmember Dietz felt a neighborhood meeting with the residents on Victoda
Lane should be held prior to construction of the driveway access.

Pat Klaers indicated notices will be sent to the residents advising them of a
meeting with the Council on Monday, August 24, 1998. The Councilmembers
requested that Laurie Mezra-Kerr attend this meeting if possible.
Councilmember Farber arrived at this time (5:37 p.m.)
Semi Tractor Ordinance
Pat Klaers indicated an updated nuisance ordinance will be presented later in
the year. One of the issues to be addressed is parking of semi tractors and
trailers on platted property, residential metes and bounds subdivisions, and
parcels of five acres or less in all residential zones and the A1 zone. Pat noted
that any changes in the this part of the ordinance will impact a number of local
truckers and the issue may be controversial.
Councilmember Holmgren asked that staff inspect the property at Gates and
School Street for possible code violations.

There being no further business, MAYOR DUITSMAN ADJOURNED THE MEETING.
The meeting of the Elk River City Council was adjourned at 5:40 p.m.
