Analysis
The subject property is located west of Elk Lake Road and north of Windsor Oak Hill 1st
Addition. The property is just outside of the City's Urban Service District in the Rla, Single
Family Residential District. Located on the property, which totals 8.7 acres, is a single-family
dwelling and a detached garage.

The zoning district requires a minimum lot area of 2 ~A acres. The applicant proposes to
subdivide the property into: Parcel A - 2.81 acres for the existing home and garage, and
Parcel B - 5.90 acres. Both parcels meet the minimum area requirements for the zoning
district.
The City Engineer has reviewed this request and finds that there are minor changes required
in the legal description. Surface water management fees will be required to be paid for one
lot. The County is limiting access along County Road 1 but will allow a new access to the
5.9-acre parcel.
The Park and Recreation Commission reviewed this request at its May 8:h meeting and
recommended cash in lieu of land for dedication purposes.
Recommendation
Staff recommends that the City Council approve the Administrative Subdivision request
with the following conditions:
1. ALL COMMENTS OF THE CITY ENGINEER SHALL BE ADDRESSED.
2. ALL COMMENTS OF SHERBURNE COUNTY SHALL BE ADDRESSED.
3. THE APPLICANT SHALL PAY PARK DEDICATION FEES FOR ONE LOT PRIOR
TO RELEASING THE SUBDIVISION FOR RECORDINGi
4. THE APPLICANT SHALL PAY SURFACE WATER MANAGEMENT FEES FOR
ONE LOT PRIOR TO RELEASING THE SUBDIVISION FOR RECORDING.

As requested, we have reviewed the proposed administrative sue

site, but given the size of Parcel B, there should be no problem findlng a buildable site.
Sherburne County should have a chance to review this administrative subdivision relative to
another driveway access onto CSAH 1.

In reviewing the legal description for Parcel B, we have noted a coUPle of changes. First, there
are two locations where the direction West is shown and we believe it should be East. The
second location is in the description of the drainage and utility easement. The description
reads, "The property lying Southerly on the following described linet.." We believe it should be
Southerly, Easterly, and Southerly to accurately reflect the property !in question.

We support Jim Nord's request for an administrative subdivision. Mi'. Nord has received written
assurance from David Schwarting, Sherburne County Public Works I)irector that we will not
oppose his request to subdivide his land along CSAH 1 and that we x~'ill grant access for a new
lot. Enclosed is the letter from Mr. Schwarting listing the conditions that must be met for this
approval. Consider these comments our complete review.
This access may encroach slightly into the wetlands, which is a conc, rn for our governing
agencies as well as Mr. Nord. I am requesting a site visit with someqne from the City, Mr. Nord
and myself before the construction of this access begins.

I have taken into consideration your verbal request for a driveway to your property on CSAH 1.
In my opinion, if you split your lot, a driveway may be installed ontc the south end of your
property under the following conditions:
The access can only serve one residential home if approved hy the City of Elk River.
The access must be 330 feet from any existing driveway.

The final alignment must be 90 degrees to CSAH 1 in order tO provide the best visibility
when entering onto CSAH 1.
The access must be closed if the property is sub-divided or u~ed for purposes other than
residential.
The access is kept free of any obstructions that would obstruct the visibility of all traffic
entering CSAH 1 or ability of traffic to see vehicles entering CSAH 1.
This letter does not preclude the need to obtain a Access Permit or a,y other permits required by
law.
