MEMORANDUM TO: FROM: DATE: Mayor & City Counc~l~ Pat Klaers, City Ad~l~i~or August 17, 1998 SUBJECT: School Street Easement School Superintendent Dr. Flannery has advised me that at the August 11 School Board meeting, action was taken on the city's request to obtain an easement for the expansion of School Street. The action taken was to grant the city the easement conditioned upon assessments being levied on an equal basis to all taxpayers on both sides of the street, and, if the city financially participates in the project, then the participation must benefit all parties equally. I have not seen the draft minutes to have the exact wording of the motion, but I believe that the above sentence reflect the general content of the motion. (i.e. The District Board wants the south property owners to pay what the school is paying.) The city cannot accept the easement under these conditions. It is recommended that the City Council formally reject the easement with these conditions. This Council action will then be relayed to Dr. Flannery and he will present this information to the School Board at its August 25 meeting. If different action is not taken by the School Board on August 25 in order to provide the city with the necessary easement, then the opportunity to do the construction project on the west side of Proctor Avenue will be lost for 1998. Additionally, ff the city does not obtain this easement without conditions in the not too distant future, then staff will be recommending that the city begin the eminent domain process to obtain the easement or right-of-way for the 1999 improvement project. Action on beginning the eminent domain process is not requested or desired at this time as I think it is fair to see how the School Board will respond to our action at their August 25 meeting. The School Board met on August 11, 1998, and, accordingly, we should have some update available on the status of the easement and the School Street improvement project on the west side of Proctor.
