Consider a request by Chuck and Tina Allard for an administrative
subdivision to subdivide approximately 15 acres into 2 lots.

Overview
The applicant's property is located on the north shore of West Twin Lake.
The property is split by 201st Avenue with 3.8 acres on the south side,
adjacent to the lake, and 11.35 acres on the north side of the road. They are
proposing to create 2 lots, one on each side of the street.
Physical characteristics
Parcel B, which is on the south side of the street, is wooded and relatively
low. Because of the low elevation in relation to the lake, the water table is

high and there has been some difficulty finding a location suitable for a septic
system. Prior to recording the subdivision the applicant will have to show a
suitable location for a primary and secondary system.
Parcel A, which is on the north side of the street, is a mix of wetland and row
crops. The crop field is located on the west and north side of the parcel. The
wetland covers the center, eastern and southern portion of the lot. Because of
the extent of the wetland along 201st Avenue, access to the lot could be
difficult.
Wetland
There is a substantial wetland on Parcel A. A drainage easement will be
needed over the wetland. The location of the wetland also limits access to the
buildable portion of the parcel. The approximate boundaries of the wetland
are shown on the survey. A site visit was conducted with representatives of
the Soil and Water Conservation District and it was the consensus of the
group that the wetlands did not have to be delineated and a driveway could
be constructed and stay within the de minimis exception for filling a wetland.
Right-of-way and easements
Drainage and utility easements will be needed along all property lines. A 60
foot right-of-way will also have to be dedicated for 201st Avenue. There is a
drainage ditch that connects the wetland on the north side of 201st with West
Twin Lake; this drainage ditch needs to be covered by a drainage and utility
easement.
Shoreline Management Ordinance
Because the property is within 1000 feet of West Twin Lake it is included in
the Shoreline Management Ordinance. The ordinance requires a minimum
lot size of 2.5 acres and a minimum lot width of 200 feet. Both lots meet these
requirements. Buildings and septic systems have to be setback a minimum
150 feet from the ordinary high water level, the 150 foot setback is shown on
the survey. The subdivision was sent to the DNR for their review and
comments.
Park and Recreation Commission
The Park and Recreation Commission recommended cash dedication in lieu of
land to satisfy the park dedication requirements for the one new lot being
created.

Recommendation
It is recommended the City Council approve the Allard's request for and
administrative subdivision to split 15 acres into two lots with the following
conditions:
1. Any necessary wetland permits obtained prior to doing any work in the
wetlands.
2. Drainage and utility easements be provided along all property lines, over
the wetlands and the drainage ditch connecting the wetland and the lake.
3. A 60 foot right-of-way be dedicated for 2018t Avenue.

Suitable locations for a primary and secondary septic systems be shown
on Parcel A and Parcel B prior to recording the subdivision with the
county.
5. Comments from the DNR be addressed prior to recording the subdivision.
6. Park dedication in the amount of $650 be paid prior to recording the
subdivision.
7. Stormwater management fee in the amount of $68.83 be paid prior to
recording the subdivision.

Subject: WCA Technical Evaluation Panel Review
Chuck and Tina Allard Property
Bill Bronder, MN SWCD; Keith Grow, BWSR; Scott Harlicker, City of Elk River; and
Stephen Rohlf, City of Elk River visited the above reference proposed building site on
August 8, 1998. It was the consensus of the group that a driveway within five feet of the
western property line and approximately ten feet wide could be constructed and stay
within the de minimis exception for filling wetland. Although the wetland involved is a
type II, it is within the Shoreland District of West Twin Lake, therefore the de minimis is
400 square feet.
