SR 05-20-2002City MEMORANDUM Item # 6.3 TO: FROM: DATE: SUBJECT: Mayor and City Council Chris Leeseberg, Planner May 20, 2002 Case No. AS 02-06 Request by Oavid Hipsag for an Administrative Subdivision Request David Hipsag is requesting an Administrative Subdivision to create two parcels. Location 11770 213th Ave Southwest corner of County Road 77 and Highway 169 Zoning/Land Use A1 (Agricultural Conservation) ? A (Agricultural) Adjacent parcels are zoned Medium Industrial with mineral excavation overlay. Attachments · Location map · Memo from City Engineer · Memo from Sherburne County · Survey Analysis The subject property is located at the intersection of County Road 77 and Highway 169. It is 20.62 acres with an existing homestead located on the property with access to County Road 77. The proposed subdivision will create two parcels, one 10.7-acre parcel for the existing home, and one 9.92-acre parcel, which will be buildable. Both parcels will have Mayor and City Council/AS 02-06 May 2O, 2OO2 Page 2 frontage on County Road 77 and will have a shared access to County Road 77. The lot lines should be adjusted so that both parcels are at least 10 acres in area. The lot width of Parcel B meets the 300-foot minimum required width, however, Parcel A does not meet the minimum requirement 300 feet at the building setback line. Parcel A does meet the required width at approximately 330' back from the right-of-way line. The two parcels will have a shared drive thus eliminating two driveways being too close to one another on the County Road. Park and Recreation The Park and Recreation Commission recommended that the City accept cash dedication for the two vacant lots as the land is in the rural district, outside of any park service areas. Drainage and Utilities The City Engineer's memo addresses site drainage and utilities. Recommendation Staff recommends that the City Council approve the Hipsag Administrative Subdivision with the following conditions: 1. ALL COMMENTS OF THE CITY ENGINEER SHALL BE ADRESSED. 2. ALL COMMENTS OF THE COUNTY SHALL BE ADDRESSED. 3. PARK DEDICATION FOR ONE LOT SHALL BE PAID PRIOR TO RELEASING THE SUBDIVISION FOR RECORDING. 4. SURFACE WATER MANAGEMENT FEES FOR ONE LOT SHALL BE PAID PRIOR TO RELEASING THE SUBDIVISION FOR RECORDING. 5. Based on our review and comments received at the Staff Review Meeting, we would offer the following comments: The Administrative Subdivision proposes to take a parcel of property located in the southwest quadrant of the intersection of Trunk Highway 169 and County Road 77 and divide it into two parcels, both approximately ten acres in size. Sherburne County should be asked to comment regarding whether or not additional right of way is needed along County Road 77 and regarding driveway access for the two parcels both of which are relatively close to T.H. 169. There is an existing house on Parcel B closest to the highway. Parcel A further to the west has no topography or spot elevations shown on it to determine whether or not there is a buildabte site and a primary and secondary septic system location. Also there are no indications whether or not there are any wetlands on the property. Enough information should be provided to ensure that there is a buildable site on Parcel A. Drainage and utility easements need to be shown around the perimeter of both parcels. The outside easements around the perimeter need to be ten feet in width and the common line between Parcel A and B needs a five-foot easement on either side of the line. Somehow through this process, limited access should be provided along the T.H. 169 frontage. The description for Parcel A on the second line where it states, "which lies west of ", needs the words ", south and west" inserted between the word "west" and "of". Similarly, on the description for Parcel B the second line where is states, "which lies east of ", the words ", north and east" need to. be inserted between "east" and "o¢'. Dear Ms. McPherson; We are not opposed to the request from David Hipsag to create a new lot along County Highway 77. We will support this request with the following conditions: No new access to County Highway 77 will be permitted. An existing access must be used and if necessary, an easement must be created to serve the property. An access permit is not required. 2.
