If denial of such a permit should occur, it shall accompany recommendations or
determinations by findings or a report stating how the proposed use does not comply with
the standards set forth in section 30-654.
Overview
The applicant would like operate a Dog Daycare and Training Center in the Avon Acres
subdivision. The location of the proposed facility will be within an existing building located
on the site.
Analysis
The center will be staffed by two full-time employees with the possibility that it might grow
to six employees. During the day care hours, 6:00 am to 6:00 pm M-F, capacity will be
limited to 15 dogs per day. The Obedience Training sessions will be from 6:30 pm to 9:20
pm, with 12 dogs per dass. Classes will be run for 50 minutes with two classes per time slot.
There will be occasional activities on Saturdays for people to drop off dogs or make up
missed classes during the week.
All activities will take place within the building and there will be no overnight boarding at
this facility. There is no state licensing required but the applicant will be required to obtain a
Commercial Kennel License from the City of Elk River.

Access to the site is off of a service road from Edison Street and there is adequate parking
for the facility.
There were no concerns raised at the staff site plan review meeting. The applicant will have
to work with the building and fire departments with regard to all building and fire codes.
Plannin= Commission Actions
The issues that were discussed were the impact of sound (barking dogs) on adjoining
neighbors (which are industrial uses), where dog feces will be disposed of and state licensing.
The applicant stated that typically when dogs are active with other dogs, they do not bark
very much. They have more of a tendency to bark a great deal when they are kenneled. As
for the disposal of the dog feces, the employees will dispose of it in the trash and there is no
state licensing requirement.
The Planning Commission unanimously recommended approval of the request.
Recommendation
Staff and the Planning Commission recommends the City Council approve the Conditional
Use Permit to operate a Dog Daycare and Training Center with the following conditions:
1. ALL CANINE TRAINING AND CARE SHALL TAKE PLACE INSIDE
THE SUBJECT BUILDING.
2. APPLICANT SHALL OBTAIN A COMMERCIAL KENNEL LICENSE
FROM THE CITY OF ELK RIVER.
3. THERE SHALL BE NO OVERNIGHT BOARDING OF ANIMALS.
4. THE TENANT SPACE SHALL COMPLY WITH ALL APPLICABLE
BUILDING CODES.
5. THE TENANT SPACE SHALL COMPLY WITH ALL APPLICABLE FIRE
CODES.

Dog Daycare and Dog Training Center
Providing a Facility that offers:
Dog Daycare:
Clients can drop off`there dog with us in the morning and pick them up on there way
home from work. During their daytime visit with us we will provide our customers pet
with one on one training, as well as, each dog learning social skills in a supervised
playtime environment, while interacting in ~oup play sessions with other compatible
pets. There will be extensive screening done on each dog before they will be accepted to
our facility, temperament testing, a full vaccination record as well as being a licensed dog
in our community. Our top priority is safety fbr our clientele. Our daycare capacity will
be limited to 15 dogs per day.
Daycare hours will mn from 6am to 6pm M-F
Saturdays 9am to 4 pm*
*Occasionally on Saturdays to provide a place to bring their pets on holiday shopping
days when they do not want to leave there pets unattended. Or when there is a family
outing were they will be away for the day and are unable to bring their pets along with
them.
Obedience Training:
More formal training will be conducted in the evening hours.
We will be offering training for our clients that just want a well behaved dog and also for
the more serious obedience competitor.
We will provide a wide range of training to suit our clients needs such as:

Advanced Beginners

Novice
Utility
Open
Agility
Intro to Retrievers
Intro to Handling
Junior Hunter
Force Fetch
Private lessons
Our classes will run 50 minutes in len~h and we will be conducting 2 classes per time
slot. Our class size has been limited to 12 dogs per class in order to give the deserved
attention to each handler.
Our time schedule is as follows;

Training Center to be closed for the day at 10:00 pm
Training Center Weekends
We will also be offering weekend classes for the client that is unable, due to various
reasons, cannot attend during weekdays but, would still love the opportunity to train their
pets.
Our Saturday Training hours will be as follows:

EVENTS
On occasion we will have the opportunity to sponsor events such as Fun Matches and
Obedience Trials.
Fun Matches: These are thai runs for the competitors in obedience. This will be
conducted as a pretend trial that people attend in getting their dogs ready for the "real"
show. They are able to work their dogs in a formal ring setting and familiarize their dogs
as well as, themselves as to what to expect and how to conduct themselves to achieve the
best possible results for their dogs' career in obedience handling.
Obedience Trials: On occasion we may offer obedience trails. This is an event where a
dog can be brought to test out for American Kennel Club titles. This is where a handler
would earn points, ribbons, and trophies to accent their Champion Companion. This is a
true accomplishment not only for the handler but, the dog itself. These are the most well
behaved dogs also known as "the cream of the crop." These trials are mainly on
weekends and run both Saturday and Sunday. Hours for trials run approximately from
8am to 6pm
We have a pre-approved elimination site within the premises in which we will take
extreme measures to ensure sanitization. We intend on being extremely strict with our
clients as to where the designated area for elimination is located. Any person(s) violating
this part of the program will be dismissed from the premises and not allowed to
participate in any further programs offered by Elk River Canine Connections.
Our location site has ample parking tbr our clients as you will notice by the print
enclosed. The building owner has given us the permission to use what space we need for
our evening & weekend classes as the other occupants are closed in the evenings and
weekends. Day hour parking will not further any issues.
There will be NO over night boarding in this facility.
Our objective to opening a facility for the canine owner is to provide a safe enclosed
environment where clients can obtain professional care for their canine companion, as
well as, professional training whether it is for c6mpetition, or just wanting to own a well
behaved dog. We believe in opening a facility that otters these attributes we can
contribute to a better, well educated community. With great honor we present this to the
City of Elk River, due to the growth of our city over the past few years, we hope that you
to, will agree that a Training Center is of high demand.

Dear Kennel Manager,
This letter is to inform you of several changes that will take place with respect to kennel licensing and records.
Beginning Inn 1, 2005, all kennel licenses will be issued annually and will be effective from Ianuary 1 until December 31.
In order!to make this transition, all kennel licenses issued during 2004 will expire on Dec 3 I, 2004. Your license fee for
this year will be adjusted accordingly. A reminder letter and application will be mailed to you approximately one month
before YOur current license expires. Your kennel license number will remain the same from year to year.
There h~is been some confusion in the past about the types of animal facilities that require a Minnesota Kennel License,
We hay6 recently received clarification from our attorneys concerning some of these issues:
· .MI~ facilities. . that house impound animals require a license, unless they are owned and operated by a political
subd~vision of the State. Aa impound animal is a stray or abandoned animal that has been seized by public
huthority and is being held for redemption by the owner. Impound animals must be held for a minimum of five
i'egular business days. Local ordinances may require a Ionger holding period. Once this holding period has been
:xceeded, the animal is no longer considered impounded.
* ~, facility that does not house impound animals may still require a license if it:
o Houses three or more unwanted or abandoned animals and advertises to receive or place these animals.
· Any person, business, or organization that houses 3 or more animals (at one time) for the facility
must have an individual kennel license. A litter of kittens or puppies less than 3 months old will
be considered "1 animal".
A facility does not require a license if it:
: o Does not house impound animals and has less than 3 unwanted or abandoned animals.
· Breeding and boarding kennels do not require a Minnesota Kennel License, unless they house stray, abandoned,
or unwanted animals as described above.
· A Minnesota State Kennel License does not exempt a kennel from local or county ordinances pertaining to
operating a kennel. These may be more restrictive than state kennel rules and statutes. It is the kennel manager's
responsibility to know and follow all local, county, and state laws pertaining to their business.
On the kennel application form, you will be asked to specify the hours your kennel is open to the public and whether the
kennel houses impound animals. In addition, all kennels must have an established Program of Veterinary Care in order to
comply with Minnesota rule 1720.1542. The details of this Program are left to the discretion of you and your veterinarian.
The enclosed form outlining your Program must be completed by you arid your wterinarian and returned to our office
along with the completed application. Please have your veterinarian contact our office if he/she has any questions.
