Action Requested
No action is required. Staff will provide an update on the status of the Elk River Landfill permit through
the Minnesota Pollution Control Agency (MPCA).
Background/Discussion
The MPCA is in the process of finalizing a new draft of the Elk River Landfill's permit for public
comment. The MPCA allowed staff to provide comments on a preliminary draft of the permit. The city
provided informal comments on the compliance boundary and water quality issues. Staff has been
informed that the comments will not change the permit and the compliance boundary will remain in the
location proposed on the preliminary draft permit.
The formal comment period is scheduled to open in mid to late August. Staff will be preparing
comments to be submitted to the MPCA once the formal comment period is open. Staff will also plan to
attend the MPCA Board meeting to reiterate the city's concerns with the permit.
