Item Description Reviewed by
Consider request by RJ Ryan for a variance allowing Chris Leeseberg,Park Planner—Planner
a dumpster enclosure in a front yard, Case No. V Reviewed by

Action Requested
Approve by motion the variance request from City Code Section 30-1294 (e) 2 to allow refuse enclosure
to be located in the front yard.
Background/Discussion
Preferred Powder Coating is proposing a 100,000 square foot manufacturing facility in the newly created
Natures Edge Business Center. Conditional use permit approval was granted in July of 2013 to allow the
garage doors to be located in in the front yard. During that meeting, the location of the dumpster
enclosure was noted on the east side of the building. Since the east side fronts Twin Lakes Road,it is
considered a front yard. The Planning Commission is scheduled to review the building design at their
meeting on August 13, 2013 to review the project for consistency with the design criteria applicable to the
project, based on the most recent plan iteration.
The proposed refuse enclosure is 26'8" by 12'by 8' tall. Dumpsters will be located within, and be
accessed via garage doors from the building, and from the cedar sided gates from the parking lot. The
sides of the structure will be tilt up panels to match the building, all protected by painted concrete
bollards.
A variance may be granted by the Board of Adjustments if it meets the following criteria:
1. The variance is in harmony with the general moose and intent of the ordinance.
The intent by the prohibition of dumpsters in front yards (and the design guidelines in
general) is to improve the street scape appearance of the city industrial areas. The distance
between the dumpster enclosure and Twin Lakes Road negates any negative impact
associated with a dumpster in a `front'yard.
2. The variance is consistent with the City of Elk River comprehensive plan.
The variance will not affect future development or plans in the area.
3. The petitioner proposes to use the properly in a reasonable manner not permitted by the zoning ordinance
The dumpster is located in the least obtriusive area of the project that does not impact the
operations of the site, or the existing gas easement.
P O I E N E A 11
NATURE
4. The plight of the petitioner is due to circumstances unique to the property not a consequence of the petition's
own action or inaction
The fact that the adjacent Twin Lakes Road is greater than 480 feet away, coupled with the
site plan designed to avoid the gas easement confirms staffs assertion that these attributes
are unique, and given the improvement sought, warrant a variance.
5. The variance, ifgranted, will not alter the essential character of the locality.
The enclosure is adequately screened by the mass of the building, the distance from Twin
Lakes, the building materials, and the landscaping. These factors protect the character of the
locality.
Conclusion
Staff recommends approval of the variance as it meets all five requirements.

None
