1. Call Meeting To Order
Pursuant to due call and notice thereof, the meeting of the Elk River Planning Commission
was called to order at 7:25 p.m. by Vice Chair Westberg.
2. Consider 7/9/13 Planning Commission Agenda
MOVED BY COMMISSIONER ERIC JOHNSON AND SECONDED BY
COMMISSIONER KONIETZKO TO APPROVE THE JULY 9,2013 PLANNING
COMMISSION AGENDA WITH THE FOLLOWING CHANGE:
• - ITEM 3—JUNE 11,2013 MINUTES, REMOVED FROM AGENDA
MOTION CARRIED 5-0.
4.1 Request by Aggregate Industries for Conditional Use Permit to amend existing permit hours
of o.eration Case No. CU 13-09—Public Hearin
The staff report was presented by Rebecca Haug. She stated that staff has received no
complaints about noise. She noted that the same traffic patterns will be used as stated in the
original agreement. An open house was held by Aggregate Industries on June 26 with 10
residents in attendance. No issues were identified at the open house.
Commissioner Jeremy Johnson asked what is the process would be to revert back to the
original hours of operation,if there were complaints. Ms. Haug explained that if there were
complaints,staff would first work with the applicants to try to resolve the issue. If that
failed,the City Council would act on changing the hours back to the prior limits.
Vice Chair Westberg opened the public hearing. There being no public comment,Vice
Chair Westberg closed the public hearing.
MOTION BY COMMISSIONER KONIETZKO AND SECONDED BY
COMMISSIONER JEREMY JOHNSON TO RECOMMEND APPROVAL OF
THE REQUEST BY AGGREGATE INDUSTRIES FOR AN AMENDMENT TO
THEIR EXISTING CONDITIONAL USE PERMIT WITH THE FOLLOWING
CONDITIONS:

1. OPERATION DOES NOT CAUSE A NUISANCE TO SURROUNDING
PROPERTIES AS DEFINED BY SEC.46.36 OF THE CITY CODE. •
2. PROCESS AND PRACTICE REMAIN THE SAME AS OUTLINED IN 1994
ENVIRONMENTAL IMPACT STUDY(EIS)
3. TRAFFIC GENERATION REMAINS CONSISTENT WITH PREVIOUS
YEARS
4. DUST CONTINUES TO BE CONTROLLED VIA WATER SUPPRESSION
MOTION CARRIED 5-0.
4.2 Request by Preferred Powder Coating for Conditional Use Permit to allow overhead doors
facing street. 10846 170th Court NW. Case No. CU 13-08—Public Hearing
The staff report was presented by Zach Carlton. Staff recommended approval of the
request with the six conditions listed in the staff report.
Vice Chair Westberg asked if the long expanse shown on the building elevations with no
break is allowed. Mr. Carlton stated that he believes the plans meet the ordinance.
Vice Chair Westberg opened the public hearing. There being no public comment,Vice
Chair Westberg closed the public hearing.
MOTION BY COMMISSIONER JEREMY JOHNSON AND SECONDED BY
COMMISSIONER ERIC JOHNSON TO RECOMMEND APPROVAL OF THE
REQUEST BY PREFERRED POWDER COATING FOR A CONDITIONAL USE •
PERMIT, CASE NO. CU 13-08,WITH THE FOLLOWING CONDITIONS:
1. VEGETATIVE SCREENING PLANTED AS INDICATED IN ATTACHED
LANDSCAPE PLAN.
2. PLANTINGS IDENTIFIED ON THE LANDSCAPING PLAN DATED MAY
15,2013 SHALL BE MAINTAINED AND REPLACED AS NECESSARY.
3. AS A CONDITIONAL USE PERMIT IS NOT A BUILDING PERMIT,THE
APPLICANT SHALL APPLY FOR ALL REQUIRED PERMITS.
4. SAMPLING MANHOLE AS REQUIRED BY UTILITIES.
5. PARKING LOT ISLANDS AS DESCRIBED.
6. THE OVERHEAD DOORS ARE OF SIMILAR COLOR TO THE BUILDING
FACADE.
MOTION CARRIED 5-0.
5.1 Consider Use of City-owned Property to be sold(Lot 1.Block 1 Natures Edge Business
Park) for consistency with Comprehensive Plan
Mr.Leeseberg explained that Lot 1,Block 3 of Natures Edge Business Park,owned by the
city,is proposed to be sold to Preferred Powder Coating. The Planning Commission is
required to make a determination whether or not the proposed use of the proposed property
is consistent with the Comprehensive Plan.

6.1 Announcements—None
6.2 Comprehensive Plan Update
Commissioner Konietzko stated that the Comprehensive Plan review process is going well.
He noted that the group is working on a visioning statement. Mr.Leeseberg noted that
there are two public meetings to be held,with a public open house to be held in July. Mr.
Leeseberg noted that the open house will be held July 24th from 3—8 pm. at City Hall.
