Background/Discussion The design and installation of a new pedestrian bridge for the winter walking trails at Woodland Trails Park is being completed by Ryan Herrboldt as an Eagle Scout project. Jim Nystrom from the Parks Commission, a registered PE,is supervising the project. The county is required to allow the placement of pedestrian bridges at country ditch crossings. The need and plans for a bridge as an Eagle Scout project were discussed at the Parks and Recreation Commission meeting last fall. The design for the bridge was presented and approved by the County Ditch Authority. The approval is based on certain conditions as outlined in the attached agreement. The County Drainage Technician or his designee will inspect the bridge when it is completed. Financial Impact A recording fee of$46 payable to the Sherburne County Recorder's Office is required with the agreement. The agreement requires that any maintenance of the bridge shall be the responsibility of the city. The supplies and materials to construct the bridge project are the responsibility of the Eagle Scout project and are usually donations from within the community. City vehicles, equipment and certain support supplies may be required in the completion of this project as is the case in all Eagle Scout projects in the city. Attachments ■ County Ditch Crossing Agreement and Exhibit A location P a w E A E U s r NaA f RE] Woodland Trails Park County Ditch Crossing Agreement The City of Elk River, a political subdivision of the State of Minnesota (owners) own land legally described as: Northeast Quarter of Section 20, Township 33, Range 26, Sherburne County, Minnesota lying west of the westerly right of way line of Burlington Northern Railroad and except the South 283.71 feet of said Northeast Quarter as measured at a right angle to the south line of said Northeast Quarter. And have requested that a public crossing for a pedestrian bridge located in the Woodland Trails Park be placed at GPS coordinates: Begin : Northing - 231572.25 Easting - 574254.44 End : Northing - 231537.96 Easting - 574295.44 on County Ditch identified as Number 31 (main ditch). In order to allow the placement of the pedestrian bridge, the Sherburne County Ditch Authority has approved the same on the 18th day of June, 2013. This approval was given based upon the following conditions: 1. The pilings of the bridge will not obstruct the flow of the waters in the ditch and the design is subject to the approval of the Sherburne County Public Works Director or his designee; 2. The Ditch bottom shall not be altered in any manner by the placement of the bridge; 3. The City and any of its successors in title shall be responsible for all maintenance and replacement in perpetuity and shall maintain the bridge to allow the continued flow of the waters in the county ditch. Any costs associated with the maintenance of the bridge shall be borne by the landowners. If the County Ditch Authority is required to remove any obstructions or the bridge itself for the failure to maintain the same, the cost shall be borne by the landowners. 4. If the owners or their successors in title chose to remove the bridge, it shall first notify the ditch authority's representative and any costs associated with the removal shall be borne by the owners.
