Background/Discussion Westwood subdivision was platted in the 1950's. During that process, a portion of the subdivision was indicated as "park". It is shown on the plat exhibit as the area south of Lot 10,Block 5, and north of Lake Orono. It is unclear as to the ownership of this parcel but staff is working with the county to identify the owner. This section was platted when that area was in the township. Since then,this area has become part of the City of Elk River. Two streets were indicated on the plat as Western Avenue and Park Avenue giving access to the "park" and other properties. The "Park Lane" street right-of-way provides no benefit to the City or Elk River Municipal Utilities. Staff has no concern with vacating a portion of this street. The "Western Avenue" street right-of-way may provide access to what might be parkland. Staff has concern with vacating this street,as it is unclear what the status of the property shown as "park"is an how it may be accessed. Further,private improvements have been made in the area that suggest ownership has previously transferred. Parks and Recreation Commission Based on the limited information presented,the Parks and Recreation Commission recommended the street be vacated as shown on Exhibit A. Recommendation Because of the lack of ownership information and actual property line placements, staff recommends postponing action until further information can be obtained. If the City Council believes it is in the best interest of the city not to vacate the rights-of-way at all, that direction may be given.
