Overview
The applicant is requesting a conditional use permit for outdoor storage of portable
sanitation units. The applicant would like to utilize the existing building for warehouse and
office space for their business, Elite Sanitation. Elite Sanitation provides portable sanitation
facilities. From time to time some of the units may have to be stored outside. The units are
pumped/emptied off site and the waste disposed of at a licensed facility. The units are then
brought back to the 4th street site,where they are inspected, cleaned and stored for future
use. No vehicles will be stored outside
The property is zoned I2 Medium Industrial and outdoor storage is allowed as a conditional
use. If no outdoor storage were involved, there would be no conditional use permit required
for the proposed business to locate at this site. The surrounding property to the west and
north is Elk River Machine and is used for outdoor storage, to the west is Adams paints and
across the street is the old lumber yard.
Site Plan
The property is located on the north side of 4th Street,between Elk River Machine and
Adams Paints. There is a 28'X 80' (2,240 sf.) building on site. The building will be used for
parking trucks, cleaning and inspecting the units and office space. None of the area outside
of the building is improved. The west property line and 1/2 of the rear property line is fenced
with a chain link fence. The site plan indicates that the outdoor storage area will be located
to the rear and along the east side of the building.
Site Improvements
Since no part of the site is surfaced with an approved material, the area outside of the
storage area should be paved. The area to be utilized for outdoor storage should be surfaced
with Class V material. The fence should be extended so that it encloses the entire area that
will be used for outdoor storage. Because the adjacent land uses are outdoor storage, the size
of the lot and the constraints associated with working with a fully developed site, additional
screening is not necessary.
Recommendation
Staff recommends that the Planning Commission recommend approval of this request for a
conditional use permit for outdoor storage with the following conditions:
1. The area outside of the outdoor storage area shall be paved.
2. The outdoor storage area shall be surfaced with Class V or similar material.
3. The outdoor storage area shall be enclosed with a fence.
4. No pumping, storage or disposal of waste material associated with the cleaning of
the units shall be conducted at this site.

Elite Sanitation is owned and operated by the Paul family, seventeen year residents of Elk
River. The family business is very simple, providing portable sanitation facilities on an
on call basis. After acquiring a competitor, Portables Plus based in Brooklyn Park,
earlier this year, the Company would be based at the proposed Elk River facility.
The operation of the business at the proposed site in Elk River on 4111 Street will consist of
maintaining the sanitation enclosures in a clean and pre-inspected condition ready for
transport at any time to any such site as may be required. The company will be prepared
when a call for services is received to load the requested number of sanitation enclosures
onto the Company truck and transport them to; Park & Recreation, Community, and
Special events; Construction and Building sites; and Temporary or Emergency Situation
sites, based upon need or circumstance. Once the enclosures arrive at a site they are
again inspected for use, filled with water mixed with a deodorizer, stocked with
necessary supplies, and final cleaning touchups are performed. The units are then ready
for public use. The Company maintains the units when placed in service on a scheduled
basis depending on the level of need or use until temporary sanitation services are no
longer required. When a call for pickup is received the Company, upon arrival at the site
of temporary service, empties each unit of all of the waste/deodorizing water mixture and
loads the enclosures onto the truck for transport back to the Company facilities where
they are cleaned and inspection in readiness until needed again. The waste/deodorizing
water mixture is transported to a Metropolitan Council, MPCA waste dump site, usually
the site in Coon Rapids, MN off of Foley Blvd, for proper disposal under license and
permit issued and with oversight by the Met Council.
The sanitation enclosures will be the only items commonly placed outside from time to
time at the site until needed for on site service. Trucks and repair of the enclosures are
kept or performed inside the building.
The business is currently run by the Paul Family, John and Denise, their two children
along with Denise's father Ken. Future plans may include modest expansion and the
addition of several new employees although nothing is currently in the works.
