Request by PlanScape Partners to Amend Section 30-1294 of
the Zoning Code Relating to Business Park District Conditional

Request
The Planning Commission is asked to consider an amendment to the Business Park District
portion of the Ordinance to allow Motor Vehicle Repair Shops as a Conditional Use.

Overview
Per the Planning Commission's direction, the applicant is proposing changes to the
ordinance to allow Motor Vehicle Repair Shops as a Conditional Use in the Business Park
zoning district with an Underlying Land Use of Industrial
Several conditions are proposed in order to address building construction, screening and
outdoor storage.
The EDA reviewed the preliminary proposal at its June 14, 2004 meeting and felt that it was
not a good"fit" for the district.

Recommendation
Staff recommends that the Planning Commission recommend approval of the proposed
language change.

1. Chair Ropp called the meeting to order at 6:30 p.m.
2. Relocation of ABRA Presented by Ron Fiscus
Ivlr. Ron Fiscus of PlanScape Partners,representing ABRA Auto Body,reviewed the issues
relating to ABRA relocating to Mulvaney Point. Mr. Fiscus reviewed the evolution of
ABRA's corporate image and why they feel it is appropriate for them to locate in the
Business Park district. Mr. Fiscus provided and overview regarding the two options to allow
ABRA to relocate to Mulvaney Point. They include a text amendment to the Business Park
District standards, or a zone change from Business Park to Ti ht Industrial.
Commissioner Anderson asked what the size of the parcel was. Mr. Fiscus stated three
acres. Commissioner Pederson asked where the access to the site would be. It was noted
that access to the site would be from 3ra Street. Commissioner Pederson also asked if the
design of the building was similar to the Ham Lake facility. Mr. Fiscus indicated yes. Chair
Ropp asked what the size of the building was. The response was 18,000 square feet.
Commissioner Anderson asked why the other sites that were offered were not selected. Mr.
Fiscus indicated that they were not within close proximity to the existing ABRA facility and
that the price of the other sites was exorbitant.
The Commission then discussed the pros and cons of both alternatives and felt that a
tightly-written text amendment would be the most appropriate choice in order to allow
ABRA to relocate within this area.
3. TML Land Holdings—Quanrud Property
The Commission heard a presentation by Hakanson-Anderson regarding a residential
subdivision south of County Road 12 and west of Kliever Lake Fields which would
subdivide 14 acres into 28 single family home sites. One access from County Road 12 has
been proposed. The engineer noted that three of the lots would potentially not meet the lot
depth requirements of the Rlc District.
The issue of access from the County Road was discussed. It was noted that the County is
responsible for regulating access onto their facility and if the County were to allow the access
point, the City would not prohibit the access and in fact would encourage it, as without the
access to County Road 12, there is an extremely long cul-de-sac and no secondary access for
emergency vehicle purposes to the subdivision.

8. Other Business
Ms. Mehelich reviewed the distributed handout regarding relocation of ABRA Auto Body to
Mulvaney Point. The Planning Commission had discussed the relocation request at their
meeting of May 11,2004 and felt that a tightly written text amendment would be the most
appropriate choice in order to allow ABRA to relocate within the Mulvaney Point area. Ms.
Mehelich stated that she understands from the Director of Planning that she anticipates the
draft language to be able to come before the EDA at its July meeting. She requested the
FDA's feedback regarding the potential change to the Business Park District ordinance.
Commissioner Klinzing stated that she feels this business may not be a fit for that area; that
she envisions that area to be an office park;it has been started that way and should continue
that way.
Commissioner Motion stated that he concurs with that and questions where the Post Office
would be relative to the subject parcel.
Ms. Mehelich stated that is located directly south of the subject parcel on Lot 1,Block 1.
Commissioner Motin stated that he feels this is an office condo area and that an auto body
shop would not be the best use of that property.
Ms. Mehelich stated that the post office project would be retail sales as well as distribution
facility. She stated the ABRA Auto Body building design is of a very high standard.
President Gongoll stated that he understands the concern but hopes that we look at the
quality of the development and the type of construction that may go on as one of the
determining factors. He feels favorable about the project.
9. Updates
Ms. Mehelich stated that the HRA received an initial request from Arrow Building Center
for redevelopment of their site with removal of five buildings. However,this did not come
together. This prompted the HRA to schedule a work session for June 30 at 4 p.m. Arrow
Building Center may be moving out of the community since the only site to fit their needs
would be the Cascade Industrial Park,which is completely sold. This is unfortunate because
it involves 15 jobs in the downtown area. The company does have a letter of intent with
another community.
10. Adjournment
There being no other business,the meeting of the Elk River Economic Development
Authority adjourned at 6:40 p.m.
