Approve by motion an ordinance amendment regarding the redemption and disposition of impounded
animals.
Background/Discussion
A recent change in the business practices of the impound center used by the city prompted staff to review
the state statutes and ordinances regulating animal impound periods. It was discovered that state statute
and city ordinance had different requirements and the ordinance actually specified that an impounded
animal be held for a longer period of time than is required by state statute.
A number of other communities were polled and it was found that most have ordinance language that
mirrors state statute. A request was made to the city attorney,who then drafted language changes
reflecting the intent of Minnesota State Statutes, Section 346.47, subd.2,which regulates the impound
times for animals.
Financial Impact
A minor publishing fee will be incurred by the city,but an overall savings will be realized due to the
decrease in the time required to hold impounded animals.

An Ordinance Amending Section, 10-53, Regarding the Redemption and
Disposition of Impounded Animals of the City of Elk River, Minnesota, City Code
The City Council of the City of Elk River does hereby ordain as follows:
§ 10-53, Redemption of impounded animals; disposition of unredeemed animals.
(b) If, at the end of seve five regular business days after such impounding, as defined by Minn.
Stat. 346.47, the animal has not been redeemed,it may be sold at private sale, or the keeper
of the pound may dispose of the animal in a humane manner as permitted by law Of
pursttant to the terms of Afinn. Stats. 535-.74.
Effective Date
That this ordinance shall take effect upon adoption and be published as provided by law.
Passed and adopted by the City Council of the City of Elk River this 21" day of October,2013.
