MEMORANDUM FROM: DATE: Mayor and City Council Pat Klaers, City Administrato~ September 14, 1998 SUBJECT: East Elk River Improvement Project The City Council has requested a public hearing to be held on September 28, 1998, on the East Elk River public improvement project. All the public improvements associated with this project are outlined in the July 1997 feasibility study. The main component of the proposal under discussion on September 28th will be the trunk sewer and water project and its proposed assessment amount of $6,000 per acre. The City Council can review and discuss any street assessments at a later date as these improvements are included in the overall project and will be part, although a minor part, of the public hearing presentation. It is assumed after the September 28th meeting that a City Council decision will be made on whether or not the City is going to pursue a large public improvement project or initially a smaller project, which expands into the large project in phases. Before the September 28th public hearing, the City Council should discuss the components of the project, the progress and current status of the project, and some of the outstanding issues associated with the proposal. This discussion is intended to take place at the September 14th City Council meeting. It bears repeating that the Council held a public informational meeting on July 29, 1996, for the East Elk River trunk sewer and water project. These minutes are attached for your reference. It should be noted that a number of the speakers at this meeting are owners of single family homes and according to the proposed assessment roll, will not receive an assessment for the trunk utility project. Additionally, it should be noted that some of the speakers are from outside of the public improvement project. The city has done a great deal of preliminary work in evaluating this project and estimating the costs of the project. Attached for your information is a projected assessment roll for the large project. This list includes properties between Highway 10 and the river. The last page of this attachment includes some notes and a comparison to the smaller project. It is in the best 13065 Orono Parkway · P.O. Box 490 · Elk River, MN 55330 · TDD & Phone: (612) 441-7420 · Fax: (612) 441-7425 Memo/East Elk River Project September 14, 1998 Page 2 interest of the city to ultimately complete the larger project and accordingly, the smaller project would be viewed as the first phase of the larger project with a second phase needing to be undertaken within 2-3 years. This material provides information on how much trunk sewer and water and storm sewer assessments can be collected. It should be noted that Cargill got notice for this September 28th public hearing, but were excluded from the draft assessment roll, as their property is in a land conservatory. Assuming a final assessment roll is prepared and this project moves forward, they will be included in the assessment roster. The first step in the 429 assessment process is to order a feasibility study. This action has been taken. The second step in the 429 process is to formally receive the feasibility report by resolution and call for the public hearing on the project. This action is scheduled to take place on September 14th and the Council should see the attached material and resolution from the City Engineer on this topic. The September 28th public hearing is the third step in the 429 assessment process. Additional steps in the 429 process include: A resolution ordering the improvement and preparation of plans and specifications (to be done on September 28th?) A resolution determining the costs to be assessed and ordering the preparation of the assessment roll (on September 28th? or in October) Holding an assessment hearing for the proposed project (November 23ra?) A resolution adopting the final assessment roll (November 23rd?) A resolution approving the plans and specifications and ordering the advertisement for bids (November 23rd?) The city has had two limited appraisals completed regarding the benefit for trunk sewer and water being extended into East Elk River. Parts of both of these 1996 and April 1998 reports from Patchin and Associates are attached. These lowest value identified in each report is for industrial lands and is $6,000 an acre. Staff is comfortable recommending that this amount be applied to all land uses in the eastern area and recommends the $6,000 per acre assessment amount. While this amount is substantially more than the $3,800 amount we used out west, it is clearly an amount that can be defended in court during assessment appeals. It is the intention of the staff that this amount be used in future phases of the project (i.e., extension down to 165th Avenue along Highway 10) with a modest inflation amount being added annually. \\elkriver\sys\shrdoc\council\easter2.doc Memo/East Elk River Project September 14, 1998 Page 3 On the 14th it is appropriate to review the trunk sewer and water, street, and storm sewer components of the project. By this, I mean we need to review the cost estimates and revenue sources to finance the improvements. The vast majority of the trunk sewer and water will be financed through assessments. The major part of the street project will be financed with federal and state funds. The developers, either directly or indirectly through TIF, will have obligations for parts of the project. A majority of the storm sewer project will be financed over time with the city surface water management fund, although some assessments to benefited property owners are expected. It should be noted that both the small and larger projects are closer to cash flowing due to revised estimates and state/federal funds being available for the street. The East Elk River project is incredibly complex in trying to put all of its financial components in order. The narrative in this paragraph is just a listing of a very few of the issues involved in this overall project. The street project can be divided into sections north and south of County Road 12, with state funding allowed only to the north, and federal funds only to the south. Making the project more complex, federal funds can be used for land acquisition on the south side of 12, but state funds cannot be used for land acquisition on the north side of 12. Accordingly, city MSA funds may be needed to acquire land north of County Road 12 for the project. The residential developer will be required to finance some of the road north of 12, while the developer on the south side of 12 will be also required to finance some of the street and storm drainage public improvements, but their financial commitment may be taking place by way of tax increment financing. When we get involved in tax increment financing, we also get involved with a local match requirement and the source of this is uncertain. Regarding the public improvements, the Council is reminded that it has authorized Evergreen Land Services to negotiate right-of-way acquisition between 175th and 171st. In this regard, Evergreen has completed negotiations with three property owners and is ready to present its recommendations to the Council. Staff supports the recommendations but there is a concern over when the city should formally accept the proposals and sign purchase agreements based on the ultimate funding source for this land acquisition. At this time it is uncertain whether this land acquisition should be with federal funds or if we should use city municipal state aid street funds. Information on the Evergreen recommendations will be presented to the Council on September 14th. Evergreen also continues to work with the Browns on negotiating a price for their property. At this time, Evergreen has not yet been authorized to work the Kirkeide family who owns \\elkriver\sys\shrdoc\council\easter2.doc Memo/East Elk River Project September 14, 1998 Page 4 property along the right-of-way of the project (the Kirkeide family property is completely surrounded by the Brown property). As the Council knows, the Trott Brook Farm residential project has been approved contingent upon utilities being ordered by the City Council. The Highway 169/Main Street commercial redevelopment and business park project has not yet been presented for formal review at the Planning Commission level. Trunk utilities need to go through this project before it can get to the Trott Brook Farms project. If this commercial/business park project does not move forward, then either the city needs to use its power of eminent domain to get access across this property to provide utilities to the Trott Brook Farms property, or, the city will have to re-evaluate trunk alignments and try to go around this property. Under ideal conditions, this commercial/business park project would move forward in a timely fashion to accommodate the residential project, but there are still many uncertainties and issues that need to be worked out regarding this project and this is especially true for the commercial redevelopment component. Staff is concerned about the reality of this commercial redevelopment project being under construction in 1999. Another concern with the project has to do with the market for business park property. The large project goes down to 171st and across Highway 10. A large 30+ acre business park site is coming on line (Vandenberg property), but also south of the Vandenberg property is business park land which the Browns own and business park land which the Eulls own. The market can only absorb only so much business park property at one time and this is a concern. Additionally, there is a concern about the city potentially buying the Brown business park property. At this time, staff does not believe the city has sufficient funds available for this acquisition. However, staff is comfortable dealing with the Browns in the same manner that we are dealing with the owners of the Vandenberg property. Once the city gets into the land acquisition for business park sites on a major scale, then we are being forced into competition with property owners we are trying to work with. This makes the situation very difficult. This East Elk River memo has gotten much longer than I intended, but the complexities if the issue require lots of discuss and once I get started on the topic, it is hard not to flow into issue after issue. Councilmember Dietz his opposition was based on the fact that he felt the Rivers Edge should y half of the cost of the project. East Elk River Trunk Sewer and Water Public Informational Meeting City Engineer Terry Maurer explained that the purpose of the public informational meeting is to receive input from the property owners regarding the timing and scope of project that the city should undertake regarding the extension of trunk utilities to the eastern area of the city. Jason Messner, Peter Patchin and Associates, Inc., indicated that the firm of Peter Patchin was requested to perform appraisals as to the market value benefit relating to trunk improvements for the eastern area of the city. He explained that the appraisal revealed that the market benefit of trunk sewer and water lines into the east Elk River urban service district is $6,000 per acre for residential and industrial lands and $8,000 per acre for commercial lands. City Attorney Peter Beck explained to the residents that it is the Council's intention to take public input regarding the extension of trunk sewer and water lines into the east Elk River urban service district in order to decide whether to proceed with the project. He further indicated that tonight's meeting was merely a public informational meeting and not an assessment hearing. Mayor Duitsman opened the public hearing. Dwight Kirkeide, 12230 173rd Avenue NW, distributed a handout entitled Toward a New Game Plan. Mr. Kirkeide indicated he was opposed to the proposed project based on the increased cost to the homeowners. Special City Council Meeting July 29, 1996 Page 5 Roger Eull, 18880 Boston Street, indicated he owned 80 acres that would be affected by the proposed project. He indicated he did not feel he would receive benefit because he did not have highway frontage. He indicated he was opposed to the project. Mayor Duitsman entered two letters into the record; one from Ron Ebner in opposition to the project and one from Kemethese Motel, Inc. in favor of the project. Bob Vandenberg, 10811 181~ Avenue, indicated he owned 80 acres that would be affected by the proposed project. He stated he felt that $6,000 per acre for residential and industrial lands was a fair price and stated he was in favor of the proposed project. Rita Schmahl, representing Cargill, indicated that Cargill has 380 acres that would be affected. She stated that Cargill has no intention of moving its location and indicated that Cargill would receive no benefit frOm the extension of water and sewer. She stated Cargill is opposed to the proposed project. Joann Rousseau, Ebner's Live Bait, indicated that she was against the project based on the fact that their business has no need for sewer and water and therefore would receive no benefit. Paul Bell, owner of Bridgeman's Restaurant, questioned how the cost would affect him. City Engineer Terry Maurer reviewed the costs .associated with this type of project and suggested that Mr. Bell contact him at City Hall for more details. Dawn Moyer, 16807 Highway 10, indicated her concern regarding the lapse in time between when the trunk system is put in and when the laterals are actually constructed. Truman Moyer, 16807 Highway 10, displayed a map of the area showing those residents who are in favor of trunk sewer and water and those residents who are opposed to trunk sewer and water. Carol Turner, 18776 Cleveland, indicated that the map in the Star News did not agree with the map of the urban service area. Mary Jo Mishke, 10078 Twin Lakes Road, had some questions regarding the calculation of trunk footage and how a farm of 160 acres would be assessed. Kathy Specht, 16330 Highway 10, indicated that she had no intention of selling her property and stated she was opposed to the project. Special City Council Meeting July 29, 1996 Page 6 Mr. Dehn, 17369 East Highway 10, indicated he was opposed to the project and stated he did not see any benefit for sewer and water due to the high cost of the project. There being no further comments, Mayor Duitsman closed the public hearing. Mayor Duitsman indicated his appreciation to those people who showed up for the meeting and to those people who spoke at the meeting. He stated that the urban service area is an area that will be developed at some time in the future and indicated that it is the city's responsibility to plan for this development and further to inform the citizens as to what the cost may be. He stated that he will be requesting the City Council to acquire right-of-way rights for the project, but has no intention of moving forward with trunk improvements until petitioned for by a developer. The analysis of this report is limited in both the scope of data researched and the depth of analysis. An analysis of far greater depth would have to be performed before a complete' appraisal can be rendered. As this is a limited appraisal, we have invoked the Departure Provision of USPAP. This departure is as follows: · The scope of research and depth of analysis are not sufficient to be considered a complete appraisal. This appraisal does not value a specific property, rather it estimates the benefit of trunk sewer and water lines to properties by class (residential, commercial and industrial). Also, the benefits indicated in this appraisal are those which would accrue to bare land. Since many of the parcels along the Highway 10 corridor (southeast of Highway 169) are improved, specific benefit of sewer and water trunks to improved properties would vary based on existing improvements (i.e. private wells and septic systems). In Elk River trunk utilities are understood to convey to following property ri§hts. Access to municipal water sources and waste water treatment plants. a. Additional SAC (sewer access charges) and WAC (water access charges) are assessed upon hook up. Trunk water and sewer lines will be constructed to serve those lands being assessed. a.
