Approve by motion, a Conditional Use Permit (CUP) to Keith Steies for automobile sales at 11044 167th Avenue, subject to the following conditions: 1. All comments of the city planner letter dated October 16, 2013, shall be addressed. 2. Approval of a landscape plan, meeting all city ordinances. 3. Approval of a final site plan that achieves logical internal traffic movement. 4. As a CUP is not a building permit, the applicant shall obtain all required permits, including approvals from the Fire Chief, City Engineer, and MnDOT. Background On September 16, 2013, the City Council held the public hearing for a CUP request from Keith Steles who is seeking approval to operate a car dealership at 11044 167th Avenue. The CUP for the previous use, RV sales, originally issued in 1989, expired in January 2013, requiring a new CUP. The City Council continued action on the item in order to give the applicant more time to submit the required information. The applicant has since provided proposed site and grading plans, and is working towards meeting established standards. The comment letter dated October 16, 2013, explains outstanding requirements. Access Access to the site will remain the same,utilizing the existing gates. However,the driveways will be narrowed, establishing distinct entrances. Currently,pavement runs the entire length of the north side of the property along 167th Ave. Plans call for removing some pavement to narrow the entrances to a consistent driveway width. Number of stalls The site plan includes parking for 142 vehicles. Additionally,landscaped parking lot islands are required at a ratio of 1 per 15 parking stalls. The site plan includes four islands, and needs to be amended to include six additional ones. Parking lot islands must be landscaped and irrigated. P a w E R E U 6 Y NaA f RE] Building No changes are proposed to the building. Storm Water Storm water runoff is directed to two concrete spillways. Staff recommends two additional spillways along the eastern curb line to reduce runoff concentration and erosion potential. Staff also recommends expanding the 892 contour in the northwest corner of the property, expanding retention capacity. Additional Comments Staff s main concerns with the materials presented include a lack of landscaping plan,lighting plan, and a confusing site layout. The lighting plan is important because of the impact on adjacent residential parcels, and is required because the ordinance requires minimum foot-candle levels. It is not clear if the existing lighting meets these requirements. The landscaping plan is necessary from a city beautification standpoint. Both the lighting plan and landscaping plan can be reviewed and approved at the staff level. Staff proposes some changes to the parking lot layout to avoid vehicular conflicts within the parking lot, to provide for logical walking patterns, to provide internal parking lot islands, and to provide for some featured display areas. The applicant has not yet agreed to these changes. Public Hearing During the public hearing, an adjacent property owner expressed concern over vehicles and debris stored over the property line in the past. The applicant stated he would ensure nothing is placed over property line in the future,and removed any existing debris. Background/Discussion The applicant is requesting a Conditional Use Permit (CUP) to sell vehicles in a Highway Commercial(C- 3) zoning district at 11044 167`x'Ave NW. In 1989,the property received a conditional use permit to sell recreational vehicles;however, this expired in January 2013 when these sales were discontinued for more than one year. Overview The existing building will remain in place and continue to be used as the sales office. The size of the building and the vehicle display areas require 22 parking spaces. The property is located outside of the urban service district, and is served by onsite well and septic systems. The existing fence will remain in place and the applicant has plans to add a fence to the south side of the property, completely encircling the parking area. Landscaping The property includes 28 over story trees. City ordinance allow for these trees to meet up to half of the tree requirement. Access Primary access to the site is from a driveway on 167`b Ave NW, approximately 90 feet west of HWY 10. K;f—a—Wil Analysis Staff received revised drawing late in the week, not permitting full review of the revised drawings. The building is subject to building and fire codes,which may require improvements. The parking lot is of sufficient size to accommodate the needed 22 parking stalls. However, the parking lot needs to be improved,including curbing,islands, and striping. Storm water The drainage plan shows surface water being directed to a drain that connects to the septic system. This appears inaccurate,but will need to be verified and adjusted if so. Current storm water management rules apply, and surface water will need to be controlled on site. This may include the addition of a retention pond. Landscaling A landscape plan prepared by a landscape architect needs to be submitted. Based on a lot perimeter of 1,171 feet, a total of 32 trees are required. However,because of the existing trees noted above, the tree requirement is halved. Proposed trees should include 8 shade trees, 4 evergreen trees, and 4 ornamental trees. The property needs to be irrigated, and should be shown on the landscape plan. I Signage The applicant proposes to re-use the existing freestanding sign footing from the previous property owner's sign. Since the structure is permitted, non-conforming, this is permissible.
