Action Requested
Staff recommends approval of the Conditional Use Permit (CUP) request to amend the PUD agreement
to allow a drive-thru lane and window at the subject property with the following conditions:
1. As a Conditional Use Permit is not a Building Permit, the property owner shall receive all
required permits for any building or structure modifications, including all exterior
signage.
2. Informational signage shall be posted indicating to motorists what vehicles will not make
it through the lane.
3. The applicant will be replacing any woodbine ivy plantings along the fence removed
during the construction.
4. The applicant/owner shall be responsible for 100% of Elk River Municipal Utilities costs
to relocate the transformer.
5. The trash enclosure shall be constructed with the same materials as the building.
6. Approval of a landscape plan, meeting all city ordinances and requirements.
7. The concrete slab located in the island where the video drop box used to be shall be
removed and replaced with landscaping consistent with what is already in place.
Background/Discussion
The current structure was built in 1998 and is part of the Elk Park Center Planned Unit Development
(PUD). The proposed use is allowed in the PUD but any site plan changes require a CUP.
Starbucks will utilize 1,700 square feet of the 5,000 square foot east end cap of the building facing
Highway 169.
In addition to the drive-thru lane and window, they are proposing moving the existing trash enclosure to
a stand-alone location in the parking lot, adding new landscaping,creating a new entryway,installing new
awnings, and adding a small concrete patio in front of the building.
Parking and Circulation
The subject site has 70 parking stalls and two access points onto Freeport Avenue. Two stalls will be
utilized for the new trash enclosure. The number of stalls and the onsite circulation are adequate for the
site.
POWERED 1Y
NATURE
The proposed drive-thru lane has enough stacking room for eight standard cars before it would impede
site circulation.
The drive-thru lane appears to have enough room to allow a 19' foot long vehicle pulling a 23' foot long
trailer. A larger pickup truck pulling a camper might not be able to navigate through the lane. Staff
recommends that some informational signage be posted indicating to motorists what vehicles will not
make it through the lane.
Landscaping
The internal island of the drive-thru lane will utilize transplanted plants from the site and two new trees
and other planting are also being introduced in the island and around the area. The applicant will be
required to replace any woodbine ivy plantings along the fence removed during the construction.
The trash enclosure is proposed to be concrete masonry units with a brick veneer to match the building.
The gate shall be metal framed with wood slats.
A concrete slab located in the island where the video drop box used to be should be removed and
replaced with landscaping consistent with what is already in place.
Signage
There is an existing freestanding sign on site. They are proposing one menu board, on directional sign,
and one clearance bar. Again staff recommends that some information signage be posted for what can or
cannot make it through the lane.
Utilities
An electrical transformer will need to be relocated to allow for the project to be completed. The
applicant/owner will be required to pay 100% of Elk River Municipal Utilities costs to relocate the
transformer. They will also need to hire an electrician to relocate/extend the secondary underground
electric service entrance and conduit, consistent with applicable codes.
Storm-water
No issues were raised regarding the drainage plan or storm water calculations, although no water may
drain to the MnDOT ROW. The lane will be constructed to funnel storm water through the parking lot
to existing catchbasins.

Re: Conditional Use Application for Starbucks drive-thru
Dear Jeremy,
We are submitting our official application for the adding of a drive-thru at 19179 Freeport Street
Elk River,MN 55330.
We have secured a Lease agreement with Starbucks for 1,700 square feet on the east end cap of the building
facing Highway 169. Starbucks will join LeAnn Chin on the opposite end of the retail building. This will
leave approximately 3,300 square feet vacant in a space of 5,000 square feet that was formerly occupied by
Hollywood Video. This Lease is contingent upon receiving approval from the city to construct a drive-thru
on the east side of the building.
Installation of the drive-thm will require us to move the existing trash enclosure to a stand-alone location in
the parking lot as shown on our site plan. In addition to the ctrive-thru we will be adding new landscaping,
new glass and aluminum entryway,new forest green awnings and a small concrete patio/sitting area in front
of the coffee shop.
We are very excited to bring a new business into Elk River and hope that you will approve our request.

Dear Mr. Barnhart:
The Minnesota Department of Transportation(MnDOT)has reviewed the above-referenced
Conditional Use, located adjacent to and abutting U.S. Highway 169. MnDOT would like to
offer the City of Elk River the following comments:
1. There can be no structures or encroachments into the state highway right of way.
2. There shall be no net increase in storm water runoff to the U.S. Highway 169 right of way
from said property. Contact Bob Nibbe,District 3 Hydraulics Engineer, at 218/828-5792
for additional information.
3. We will allow the temporary removal of the fence to construct new back slope. Fencing
must be replaced following construction along with the woodbine ivy plantings presently
skirting the fence. Any other plantings and vegetation impacted by construction must also
be restored.
4. A permit is required to perform work within the right of way, construct any entrances or
