Overview Plaisted Companies seeks conditional use permit approval to mine peat and gravel out of approximately 120 acres north of 219th near its intersection with Highway 169. The 120 acres encompass two 60 acre projects approved in 2004,but since abandoned,the Schuer Mine and the J&B mine. While the land use approval has expired,it was important to review formally the wetland impacts, to ensure that prior approvals were valid. The wetland delineation was redone, to verify boundaries. The mitigation plan was deemed to be valid, and no further mitigation plans were developed. The Council is asked to approve the Notice of Decision, to be filed with the project, as recommended by the Technical Evaluation Panel. Hours of operation would be 7-7 Monday through Saturday. Crushing of rock may occur. This constitutes WSB's recollection of the meeting. If there are any edits,please let me know by December 13, 2013. In attendance at the meeting included: Keith Grow (BWSR), Bill Bronder (SWCD),Jeremy Barnhart (City of Elk River), Ben Hodapp (Anderson Engineering),Todd Plaisted (Plaisted Company), Courtney Luensman (Anderson Engineering),and Michelle Nilson (Plaisted Company). The TEP discussed the Plaisted Companies'proposal to conduct aggregate mining within their site in the same manner as outlined in the previously approved 2004 WCA application to the City.The questions reviewed by the TEP were: 1) Is the past application approval still valid and 2) Does a different operator/owner for the project change anything for the past WCA approval? These items,as well as further documentation of the project,are summarized below. Validity of 2004 WCA Approval The applicant indicated that the plan for mining is the same as the plan that was approved in 2004. Different Operator The TEP indicated that the change in ownership was not an issue and this could just be documented through this process. The applicant has submitted the same mining and mitigation plans showing Plaisted Companies as the applicant on the plan sheets dated November 18, 2013 and attached.Therefore, Plaisted Companies is now the approved applicant for the WCA application and approval. Wetland Delineation The wetlands were redelineated in 2013 and reviewed by WSB on behalf of the City of Elk River. This delineation was approved on October 25, 2013. Based on this delineation, additional wetlands were identified that did not exist in the previously approved project plans. These wetlands have been determined to be incidental as they were created as part of past approved mining activities within the site. No mitigation is required for impact to these incidental wetlands.These incidental wetlands include Wetland 6 and 10 as noted in the Wetland Delineation Report and the letter dated December 3,2013 from Anderson Engineering (attached). Surety As part of the City's review of the CUP for the project,a surety will be required for the wetland mitigation. This amount will be included in the CUP process. Expiration Date The WCA Notice of Decision has been reissued for clarity for this project (see attached). This decision simply affirms that the past 2004 approval is still valid. In addition,an expiration of the NOD has now been added to the approval to run concurrent with the sunset date of the CUP. Possibility of Draining Additional Wetland The possibility of draining adjacent wetland with the project was investigated in 2004 and the documentation indicates that this type of impact is not anticipated to occur. However, if it does occur,the applicant will be responsible for obtaining additional wetland mitigation either on-site or through the purchase of wetland bank credits. This has been added to the NOD. This concludes the summary of the 2013 Plaisted Aggregate Mining plan with respect to the WCA approval for the City as the LGU. The City Council is anticipated to review this information at the CUP application at an upcoming December meeting. These plans are attached and show wetland impact areas and wetland mitigation areas. Since mitigation is expected to occur after the mining is complete,it is understood that the mitigation will take time to be implemented. Attached to this NOD are the following: • City meeting minutes from 2004 approval • Impact and mitigation site plans,dated 11/18/13,which show the same impact and mitigation, but have been updated to show Plaisted Companies as the applicant. • Memo from WSB dated December 3,3013,summarizing the TEP meeting and other wetland findings. • Letter dated December 3,2013 from Anderson Engineering summarizing Wetland 6 and 10 as BWSR Forms 7-1-10 Page 1 of 3 incidental wetlands. A surety in the amount of$1 per square foot of New Wetland Credit is required until the mitigation i completed. The New Wetland Credit amount is 155,318 SF. While not anticipated,if additional wetland impact occurs due to draining or other activities,the applicant will be responsible for providing additional wetland mitigation. The wetland impact and mitigation plans as originally approved and shown in the attached figures dated 11/18/13 are hereby continued to be approved per the WCA. This approval will be valid and run concurrent with the approval and sunset date of the Condition Use Permit. This permit will continue to be valid as long as the CUP is valid. If the CUP expires and is not updated,a new wetland replacement application will need to be submitted if work is to continue. Mr.Rohlf stated that approximately 1,190,000 cubic yards of material is proposed to be mined,about 1/3 of which is peat.Mr.Rohlf explained the traffic,groundwater,wetland,and setback issues as presented in his staff report. Mr.Rohlf noted that gravel from the J&B Mining site will be hauled through the Schuer,Inc. site to Elk River Bituminous. Mr.Steve Rohlf stated that the public hearing on this issue is scheduled for September 20, 2004 and Council action will be required at that time. 5.4. Consider Environmental Assessment Worksheet for J&$Mining • Building and Zoning Administrator Stephen Rohlf explained the Environmental Assessment Worksheet(EAW)for J&B Mining.He stated that the purpose of the EAW is to describe the project and gather information to identify any potential environmental effects.Mr.Rohlf reviewed the comments received to the EAW as presented in his staff report. Mr.Rohl£stated that the Mineral Excavation Overlay District is designed to allow the excavation of resources as an interim use,prior to a more permanent land use on the property,as long as it doesn't conflict with surrounding land uses.He stated that the property to the north,south,and west of the J&B site is currently being mined and there are no sensitive land uses to the immediate east of the site. Cleanup Week: October 11-16.2004 Environmental Assistant Rebecca Haug stated that due to the amount of participation at the city's spring clean-up day,staff has decided to do a pilot fall clean-up week October 11-16, 2004.Ms. Haug stated that rather than residents bringing their items to the Public Works garage as they have in the past,they would obtain a voucher at City Hall and bring the items directly to the Elk River Landfill. She noted that the number and type of materials that the resident will be bringing to the landfill will be written on the voucher and the voucher will have the city embossed seal as to not be reproduced.She indicated that residents will have to pay a minimal fee as they have in the past and staff is recommending that the City Council approve funding the remaining amount from the city's landfill abatement fund. — Acting Mayor Motin questioned how the event will be publicized.Ms.Haug indicated that the event will be advertised in the Star News,on ERTv Channel 12,and through flyers. City Administrator Pat Klaers stated that the Council suggested having a fall clean up event when the Annual Reports were discussed. TEP Minutes — June 8, 2004 Attending: Brad Wozney, BWSR; Paul Diedrich, DNR-Fisheries; Yvonne Berner, ACOE; Terry Mauer, City Engineer; Roger Schmidt & Glen Johnson, Schmidt Gravel Mine; Jon Blaha and Warren Tuel, Liesch Assoc, Inc; Wayne Jacobson, Applied Environmental Services; Jason Bebeau & Michelle Christensen, J & B Mining; Donald Wester, Bill Saaranen, Duane Betker, Dean Mealhouse, Trout Brook Farms; Rebecca Haug and Steve Rohlf, City of Elk River Schuer Gravel Mine Leisch Assoc, Inc installed three monitoring wells and took soil borings. The information collected supports their earlier opinion that the wetlands at the site are supported by a shallow water table and not due to perched conditions. However, Bill Bronder is unsure if they have enough information to make that determination. It was discussed that the letter of credit guarantees that the wetland is supported by a shallow water table and not perched. If the plan doesn't work, the City will require them to fix it. Some of the additional wetland credits that this mine will have will be given to J & B Mining. Yvonne Berner explained that the ACOE may not accept these credits since they do not approve deep water habitats. It was discussed that there would be no dewatering at the site. The CUP for will need to be written in such a way to make sure the water levels are working. Monthly data for the monitoring wells will need to be provided to the City for the first year and quarterly data for the monitoring wells will need to be provided to the City for the second year. There may be a potential for bounce. Benchmarks will need to be established so a person can take elevations. GRO and DRO will need to be addressed. The wetland mitigation will be accomplished by removing the gravel deposits to a depth of 15 to 16 feet. Then fill will be brought back in up to grade in the Type 5 area, and 1 ft below the grade in the Type 3 area. Muck will be used to line the Type 3 area in preparation for planting. The second mitigation will be completed by removing the top 0.5 ft of existing reed canary grass and then replanting with natives. The slopes will be no greater than 5:1. A buffer area will be created averaging 25 ft in width. The Type 2 replacement is the only area that credit is wanted for. BWSR and ACOE are unsure they will be able to accept the credits because it is connected to deep water habitat. The TEP is satisfied with the wetland application for this project. J& B Mining Yvonne Berner emphasized to the applicant the importance of keeping their impacts under 2 acres. Also, the setbacks on the north, east and south sides for the mine will need to be changed. The setback adjoining the Schmidt mine may be already but the others will have to be 50 ft back. The setback changes will affect the wetland impacts so this will be looked at again at the next TEP meeting. There is still the issue of transportation for this project. Trott Brook Farms Homeowner's Association The Trott Brook Farms Homeowner's Association was in to discuss what can be done about the vegetation in and around their sedimentation ponds. It was discussed that barley straw can be added to the ponds in April to control the algae growth. It was also discussed that some of the cattails can be removed but the majority should remain because they absorb the nutrients that cause the algae bloom in the pond. It was also discussed that the association should talk to the lawn mowers about mowing the grass clippings away from the ponds. At this time, there are no rules restricting vegetation removal from sedimentation basis only recommendations. Bill Bronder gave them his card so they could further discuss options for vegetation. • . II' I' t Item # 5.5. Memorandum TO: Mayor and City Council FROM: Rebecca Haug,Environmental Tech. DATE: September 7,2004 SUBJECT: Wetland Conservation Act Decision—J& B Mining -WCA 04-08 Proposal—J&B Mining to impact 85,294 square feet of Type 2 wetland all in one locations to accommodate the excavation of peat and gravel. A map showing the proposed wetland impact and replacement is attached. The Elk River City Council is the Local Unit of Government charged with decision-making authority for the Wetland Conservation Act(WCA). Schuer,Inc. is proposing to expand a gravel mining operation adjacent to the J&B Mining site. That proposal also has wetland impacts. The wetland restoration for the project ties into the mitigation for the J&B Mining project. Wetland restoration can't be deemed complete for either project until both are finished. Further, J &B Mining is purchasing some of the excess wetland credits from the Schuer site. FINDINGS Liesch Companies prepared a Wetland Delineation Report for the property dated, May 17, 2004. Combined notification of the proposed wetland impact and replacement plan was mailed out to the appropriate governmental agencies on July 1, 2004. The Technical Evaluation Panel (TEP)reviewed the delineation and replacement plan July 8, 2004. The minutes of that meeting are attached. The comment period on this issue ended on July 21, 2004. The appeal period for this issue is 15 working days after the Council's decision. RECOMMENDATION Staff recommends approval of the filling and mitigation plan for this project with the following stipulations: 1. A restrictive covenant and drainage and utility easement be recorded over the mitigation and buffer areas. 2. The petitioner secures letter of credit in favor of the City of Elk River,which covers the cost of the mitigation work. 3. Monitoring of the wetland mitigation will commence as soon as restoration is completed on both this site and the Schuer,Inc. site and continue for a period of 3 to 5 years, as needed,as determined by city staff. The petitioner shall submit a written monitoring report on the replacement wetlands to the city after the first year of monitoring. Upon approval of this report by city staff the letter of wetland credit may be released. 4. Proof of purchasing wetland credits from Schuer,Inc shall be provided to the City. This is important when it comes to getting a permit from the Corp. The project does not need to go through the banking process since the mitigation will be on-site. Excess credits will be on the Schuer site however, the applicant is not proposing to bank them, only use them as enhancement. The upland buffer will be at least 25 ft. The proposed type 2 wetland replacement for credit on the east side of the property will not be used. More credits will be bought from the Schuer property for this. Along the western upland buffer area, an opportunity is available for more buffer following the edge of the transformed type 2 wetland. It was discussed that reed canary grass should not be wasted back into the pond since the seeds will remain and the wetland could become inundated with reed canary grass and also if the pond is to be used for fish habitat, the spoils would . cause the water to be cloudy and not desirable to fish. The topic of using phosphorus for fertilizer was discussed since the city has ordinance restricting phosphorus in fertilizer unless it is used for establishment on new lawn or if soil tests state that it is needed. Since natives will be planted in the area, phosphorus should not be needed. The method of seeding was also discussed and it was determined that harrowing is not required since the seed will be packed. Consider Schuer Gravel Mine Conditional Use Permit Case No.CU 04-2,3 Environmental Assistant Rebecca Haug stated that Schuer,Inc is requesting approval of a Conditional Use Permit for mineral excavation.Ms.Haug stated that the applicant has an existing mining permit that allows them to mine 14.81 acres of a 66.06 acre site.The applicant is requesting approval to mine an additional 5.5 acres of the same site. Ms.Haug explained the traffic,groundwater,wetland,and setback issues as presented in her staff report. Ms.Haug also noted that gravel from the J&B Mining site will be hauled through the Schuer site to Elk River Bituminous and in order to keep this haul route open, this 5.5 acres of the Schuer site will not be restored for 5-10 years. City Attorney Peter Beck suggested that the requirement to keep the haul route open should be included as a condition with the Conditional Use Permit.Mr.Rohlf indicated that a condition could be added to the J &B Mining permit that requires them to have an agreement with Schuer Mining for the haul route to remain open. Building and Environmental Administrator Stephen Rohlf stated that the public hearing on this issue is scheduled for September 20,2004 and Council action will be required at that time. 5.2. He stated that the purpose of the EAW is to describe the project and gather information to identify any potential environmental effects. Mr.Rohlf reviewed the comments received to the EAW as presented in his staff report. Mr.Rohlf stated that staff believes the EAW adequately reflects the project and the potential environmental effects.He indicated that staff recommends a negative declaration on the , need for an Environmental Impact Study(EIS). DATE: September 7,2004 SUBJECT: Wetland Conservation Act Decision— Schuer,Inc.-WCA 04-07 Proposal—Schuer, Inc. is proposing to impact 8,280 square feet of Type 2 wetland,all in one location,to accommodate the excavation of gravel. A map showing the proposed wetland impact and replacement is attached. The Elk River City Council is the Local Unit of Government charged with decision-making authority for the Wetland Conservation Act(WCA). Schuer, Inc. is proposing to expand a gravel mining operation adjacent to the J&B Mining site, which also has wetland impacts. The wetland restoration for the two projects ties together. Wetland restoration can't be deemed complete for either project until both are finished. Further,J &B Mining is purchasing some of the excess wetland credits from the Schuer site. FINDINGS Liesch Companies prepared a Wetland Delineation Report for the property. Combined notification of the proposed wetland impact and replacement plan was mailed out to the appropriate governmental agencies on June 2, 2004. The Technical Evaluation Panel(TEP)reviewed the delineation and replacement plan on May 5, 2004 and June 8, 2004. The minutes of these meetings are attached. The comment period on this issue ended on June 23, 2004. The appeal period for this issue is 15 working days after the Council's decision. RECOMMENDATION Staff recommends approval of the filling and mitigation plan for this project with the following stipulations: 1. A restrictive covenant and drainage and utility easement be recorded over the mitigation and buffer areas. 4 2. The petitioner secures letter of credit in favor of the City of Elk River,which covers the cost of the mitigation work. 3. Monitoring of the wetland mitigation will commence as soon as restoration is completed on both this site and the Sehuer, Inc. site and continue for a period of 3 to 5 years,as needed,as determined by city staff. The petitioner shall submit a written monitoring report on the replacement wetlands to the city after the first year of monitoring. Upon approval of this report by city staff the letter of wetland credit may be released. TEP Minutes — June 8, 2004 Attending: Brad Wozney, BWSR; Paul Diedrich, DNR-Fisheries; Yvonne Berner, ACOE; Terry Mauer, City Engineer; Roger Schmidt & Glen Johnson, Schmidt Gravel Mine; Jon Blaha and Warren Tuel, Liesch Assoc, Inc; Wayne Jacobson, Applied Environmental Services; Jason Bebeau & Michelle Christensen, J & B Mining; Donald Wester, Bill Saaranen, Duane Betker, Dean Mealhouse, Trout Brook Farms; Rebecca Haug and Steve Rohif, City of Elk River Schuer Gravel Mine Leisch Assoc, Inc installed three monitoring wells and took soil borings. The information collected supports their earlier opinion that the wetlands at the site are supported by a shallow water table and not due to perched conditions. However, Bill Bronder is unsure if they have enough information to make that determination. It was discussed that the letter of credit guarantees that the wetland is supported by a shallow water table and not perched. If the plan doesn't work, the City will require them to fix it. Some of the additional wetland credits that this mine will have will be given to J & B Mining. Yvonne Berner explained that the ACOE may not accept these credits since they do not approve deep water habitats, It was discussed that there would be no dewatering at the site. The CUP for will need to be written in such a way to make sure the water levels are working. Monthly data for the monitoring wells will need to be provided to the City for the first year and quarterly data for the monitoring wells will need to be provided to the City for the second year. There may be a potential for bounce. Benchmarks will need to be established so a person can take elevations. GRO and DRO will need to be addressed. The wetland mitigation will be accomplished by removing the gravel deposits to a depth of 15 to 16 feet. Then fill will be brought back in up to grade in the Type 5 area, and 1 ft below the grade in the Type 3 area. Muck will be used to line the Type 3 area in preparation for planting. The second mitigation will be completed by removing the top 0.5 ft of existing reed canary grass and then replanting with natives. The slopes will be no greater than 5:1. A buffer area will be created averaging 25 ft in width. The Type 2 replacement is the only area that credit is wanted for. BWSR and ACOE are unsure they will be able to accept the credits because it is connected to deep water habitat. The TEP is satisfied with the wetland application for this project. J & BMining Yvonne Berner emphasized to the applicant the importance of keeping their impacts under 2 acres. Also, the setbacks on the north, east and south sides for the mine will need to be changed. The setback adjoining the Schmidt mine may be already but the others will have to be 50 ft back. The setback changes will • affect the wetland impacts so this will be looked at again at the next TEP meeting. There is still the issue of transportation for this project. Trott Brook Farms Homeowner's Association The Trott Brook Farms Homeowner's Association was in to discuss what can be done about the vegetation in and around their sedimentation ponds. It was discussed that barley straw can be added to the ponds in April to control the algae growth. It was also discussed that some of the cattails can be removed but the majority should remain because they absorb the nutrients that cause the algae bloom in the pond. It was also discussed that the association should talk to the lawn mowers about mowing the grass clippings away from the ponds. At this time, there are no rules restricting vegetation removal from sedimentation basis only recommendations. Bill Bronder gave them his card so they could further discuss options for vegetation. Liesch Assoc., Inc has been hired by the applicant to make this determination. They will be installing three monitoring wells. The applicant is proposing to restore the wetland and get credit for wetland banking. It was discussed as to whether or not the ACOE would approve a wetland bank for this type of project. Trout Brook Estates At the previous TEP meeting several changes were requested. The proposed trail at the end of Becker Trail has been relocated. Street has been shortened but the Park and Recreation Commission would like to see the trail to connect to Street E causing wetland impacts. Terry Mauer commented on the lack of accessibility to the sedimentation ponds by Qutlot G, This will cause a change in Street E and the trail. Yvonne Berner stated that the ACOE is developing new criteria for trails. She also commented that if the project exceeds 10,000 sq. ft. (over 2 acres) of wetland impacts, the approval process will require a public notice and will be more difficult to receive approval. Lots 8 & 9, Block 20 were looked at since the City doesn't allow wetland fill for building sites. The road may be redesigned or the house made smaller to fit the sites. The same concerns were discussed for Lots 4 & 5, Block 15. A narrower house and retaining wall were discussed for Lot 9, Block 15. A new plan will be submitted; however, the TEP will not be discussing this project again. Robert Droen This homeowner is requesting a permit to dig out a wetland on his property and place the spoils on an upland area of his yard. ACOE does not regulate this activity. It was discussed that the slopes would be 4:1 and no deeper than 4— 5'. (Bill Bronder and Rebecca Haug inspected the site on May 7, 2004.
