Background/Discussion The proposed mining of the Plaisted Mine will impact several wetlands on site. As per the Wetland Conservation rules, these wetlands have been delineated and reviewed by the Technical Evaluation Panel (TEP). The TEP also reviewed the wetland mitigation plans as prepared for the previous tenants of the property, the TEP determined that the wetland mitigation plan remains valid, and no additional mitigation is necessary. The TEP recommends approval of both the wetland delineation and mitigation plans. Approval by the City Council is a necessary action, as the Council is the Local Government Unit (LGU). Overview Plaisted Companies seeks conditional use permit approval to mine peat and gravel out of approximately 120 acres north of 219th near its intersection with Highway 169.The 120 acres encompass two 60 acre projects approved in 2004, but since abandoned, the Schuer Mine and the J&B mine. While the land use approval has expired,it was important to review formally the wetland impacts, to ensure that prior approvals were valid. The wetland delineation was redone, to verify boundaries. The mitigation plan was deemed to be valid, and no further mitigation plans were developed. The Council is asked to approve the Notice of Decision, to be filed with the project, as recommended by the Technical Evaluation Panel Hours of operation would be 7-7 Monday through Saturday. This constitutes WSB's recollection of the meeting. If there are any edits,please let me know by December 13, 2013. In attendance at the meeting included: Keith Grow (BWSR), Bill Bronder (SWCD), Jeremy Barnhart (City of Elk River),Ben Hodapp (Anderson Engineering),Todd Plaisted (Plaisted Company), Courtney Luensman (Anderson Engineering), and Michelle Nilson (Plaisted Company). The TEP discussed the Plaisted Companies'proposal to conduct aggregate mining within their site in the same manner as outlined in the previously approved 2004 WCA application to the City. The questions reviewed by the TEP were: 1) Is the past application approval still valid and 2) Does a different operator/owner for the project change anything for the past WCA approval? These items, as well as further documentation of the project, are summarized below. Validity of 2004 WCA Approval The applicant indicated that the plan for mining is the same as the plan that was approved in 2004. This includes the plan for wetland mitigation. Different Operator The TEP indicated that the change in ownership was not an issue and this could just be documented through this process. The applicant has submitted the same mining and mitigation plans showing Plaisted Companies as the applicant on the plan sheets dated November 18, 2013 and attached. Therefore, Plaisted Companies is now the approved applicant for the WCA application and approval. Wetland Delineation The wetlands were redelineated in 2013 and reviewed by WSB on behalf of the City of Elk River. This delineation was approved on October 25, 2013. Based on this delineation, additional wetlands were identified that did not exist in the previously approved project plans. These wetlands have been determined to be incidental as they were created as part of past approved mining activities within the site. No mitigation is required for impact to these incidental wetlands. These incidental wetlands include Wetland 6 and 10 as noted in the Wetland Delineation Report and the letter dated December 3, 2013 from Anderson Engineering (attached). Surely As part of the City's review of the CUP for the project, a surety will be required for the wetland mitigation. This amount will be included in the CUP process. Expiration Date The WCA Notice of Decision has been reissued for clarity for this project (see attached), This decision simply affirms that the past 2004 approval is still valid. In addition, an expiration of the NOD has now been added to the approval_to run concurrent with the sunset date of the CUP. Possibility of Draining Additional Wetland The possibility of draining adjacent wetland with the project was investigated in 2004 and the documentation indicates that this type of impact is not anticipated to occur. However, if it does occur,the applicant will be responsible for obtaining additional wetland mitigation either on-site or through the purchase of wetland bank credits. This has been added to the NOD. This concludes the summary of the 2013 Plaisted Aggregate Mining plan with respect to the WCA approval for the City as the LGU. The City Council is anticipated to review this information at the CUP application at an upcoming December meeting. However, Bill Bronder is unsure if they have enough information to make that determination. It was discussed that the letter of credit guarantees that the wetland is supported by a shallow water table and not perched. If the plan doesn't work, the City will require them to fix it. Some of the additional wetland credits that this mine will have will be given to J & B Mining. Yvonne Berner explained that the ACOE may not accept these credits since they do not approve deep water habitats. It was discussed that there would be no dewatering at the site. The CUP for will need to be written in such a way to make sure the water levels are working. Monthly data for the monitoring wells will need to be provided to the City for the first year and quarterly data for the monitoring wells will need to be provided to the City for the second year. There may be a potential for bounce. Benchmarks will need to be established so a person can take elevations. GRO and DRO will need to be addressed. The wetland mitigation will be accomplished by removing the gravel deposits to a depth of 15 to 16 feet. Then fill will be brought back in up to grade in the Type 5 area, and 1 ft below the grade in the Type 3 area. Muck will be used to line the Type 3 area in preparation for planting. The second mitigation will be completed by removing the top 0.5 ft of existing reed canary grass and then replanting with natives. The slopes will be no greater than 5:1. A buffer area will be created averaging 25 ft in width. The Type 2 replacement is the only area that credit is wanted for. BWSR and ALOE are unsure they will be able to accept the credits because it is connected to deep water habitat. The TEP is satisfied with the wetland application for this project. Yvonne Berner emphasized to the applicant the importance of keeping their impacts under 2 acres. Also, the setbacks on the north, east and south sides for the mine will need to be changed. The setback adjoining the Schmidt mine may be already but the others will have to be 50 ft back. The setback changes will of E affect the wetland impacts so this will be looked at again at the next TEP ' meeting. There is still tNe issue of transportation for this project. It was also discussed that some of the cattails can be removed but the majority should remain because they absorb the nutrients that cause the algae bloom in the pond. It was also discussed that the association should talk to the lawn mowers about mowing the grass clippings away from the ponds. The proposed type 2 wetland replacement for credit on the east side of the property will not be used. More credits will be bought from the Schuer property for this. Along the western upland buffer area, an opportunity is available for more buffer following the edge of the transformed type 2 wetland. y It was discussed that reed canary grass should not be wasted back into the pond since the seeds will remain and the wetland could become inundated with reed canary grass and also if the pond is to be used for fish habitat, the spoils would cause the water to be cloudy and not desirable to fish. The topic of using phosphorus for fertilizer was discussed since the city has ordinance restricting phosphorus in fertilizer unless it is used for establishment on new lawn or if soil tests state that it is needed. Since natives will be planted in the area, phosphorus should not be needed. The information collected supports their earlier opinion that the wetlands at the site are supported by a shallow water table and not due to perched conditions. However, Bill Bronder is unsure if they have enough information to make that determination. It was discussed that the letter of credit guarantees that the wetland is supported by a shallow water table and not perched. If the plan doesn't work, the City will require them to fix it. Some of the additional wetland credits that this mine will have will be given to J & B Mining. Yvonne Berner explained that the ACOE may not accept these credits since they do not approve deep water habitats, It was discussed that there would be no dewatering at the site. The CUP for will need to be written in such a way to make sure the water levels are working. Monthly data for the monitoring wells will need to be provided to the City for the first year and quarterly data for the monitoring wells will need to be provided to the City for the second year. There may be a potential for bounce. Benchmarks will need to be established so a person can take elevations. GRO and DRO will need to be addressed. The wetland mitigation will be accomplished by removing the gravel deposits to a depth of 15 to 16 feet. Then fill will be brought back in up to grade in the Type 5 area, and 1 ft below the grade in the Type 3 area. Muck will be used to line the Type 3 area in preparation for planting. The second mitigation will be completed by removing the top 0.5 ft of existing reed canary grass and then replanting with natives. The slopes will be no greater than 5:1. A buffer area will be created averaging 25 ft in width. The Type 2 replacement is the only area that credit is wanted for. BWSR and ACOE are unsure they will be able to accept the credits because it is connected to deep water habitat. The TEP is satisfied with the wetland application for this project. J & B Mining Yvonne Berner emphasized to the applicant the importance of keeping their impacts under 2 acres. Also, the setbacks on the north, east and south sides for the mine will need to be changed. The setback adjoining the Schmidt mine may be already but the others will have to be 50 ft back. The setback changes will h� affect the wetland impacts sa this will be looked at again at the next TEP meeting. There is still the issue of transportation for this project. Trott Brook Farms Homeowner's Association The Trott Brook Farms Homeowner's Association was in to discuss what can be done about the vegetation in and around their sedimentation ponds. It was discussed that barley straw can be added to the ponds in April to control the algae growth. It was also discussed that some of the cattails can be removed but the majority should remain because they absorb the nutrients that cause the algae bloom in the pond. It was also discussed that the association should talk to the lawn mowers about mowing the grass clippings away from the ponds. At this time, there are no rules restricting vegetation removal from sedimentation basis only,recommendations. Bill Bronder gave them his card so they could further discuss options for vegetation. Liesch Assoc., Inc has been hired by the applicant to make this determination. They will be installing three monitoring wells. The applicant is proposing to restore the wetland and get credit s for wetland banking. It was discussed as to whether or not the ACOE would approve a wetland bank for this type of project. i Trout Brook Estates At the previous TEP meeting several changes were requested. The proposed trail at the end of Becker Trail has been relocated. Street has been shortened but the Park and Recreation Commission would like to see the trail to connect to Street E causing wetland impacts. Terry Mauer commented on the lack of accessibility to the sedimentation ponds by Outlot G. This will cause a change in Street E and the trail. Yvonne Berner stated that the ACOE is developing new criteria for trails. She also commented that if the project exceeds 10,000 sq. ft. (over 2 acres) of wetland impacts, the approval process will require a public notice and will be more difficult to receive approval. Lots 8 & 9, Block 20 were looked at since the City doesn't allow wetland fill for building sites. The road may be redesigned or the house made smaller to fit the sites. The same concerns were discussed for Lots 4 & 5, Block 15. A narrower house and retaining wall were discussed for Lot 9, Block 15. A new plan will be submitted; however, the TEP will not be discussing this project again. '. Robert Droen This homeowner is requesting a permit to dig out a wetland on his property and place the spoils on an upland area of his yard. ACOE does not regulate this activity. It was discussed that the slopes would be 4:1 and no deeper than 4-- 5 . (Bill Bronder and Rebecca Haug inspected the site on May 7, 2004. I forwarded the staff report & attachments to BWB for review. Except for a call I placed to Todd a few weeks back when BWB received notice, we haven't had any discussion on haul routes. Attached is the graphic you forwarded me &the current 2011 easement docs you asked for. Per our talk, BWB is requesting you incorporate the following items into the City's review & conditions: 1. The existing easement (blue on the attached graphic) is specifically for the benefit of the BWB parcels (graphic label 3, 4, & 5) & Outlot B (graphic label 2) -- not the parcels to the north. 2. BWB & ERX/Plaisted have been working together on a separate agreement over the past several months (noted in red on the attached graphic you put together) —this agreement does not address the existing N-S easement. BWB is not necessarily opposed to the haul route proposed by Plaisted (colored blue on the graphic), but further discussion & easement rights need to be defined/granted. Easement C (the easterly portion of what is colored red on the graphic) is proposed to be granted, but was originally intended as a means for temporary access of parcel 2 to new 215th— not as a semi-permanent easement or for mining operations/ heavy hauling. It is anticipated that there will be future mining in this area. 3. If the mining permit, haul route on the existing N-S easement (in blue), & access safety improvements are finalized & permitted, BWB would anticipate all improvement costs would be the responsibility of the applicant (BWB would not be charged/assessed).
