East Elk River Public Hearing
A public hearing for the East Elk River sewer and water project is scheduled
for Monday, September 28, 1998, at 6 p.m. at City Hall. The purpose of this
meeting is to receive input from citizens and affected property owners
regarding the possible extension of utilities. The attached material from City
Engineer Terry Maurer provides background information on the project,
public hearing format, and information he plans to present at the meeting.
The City Council needs to make a decision regarding whether or not the East
Elk R/vet project is going to be the commonly discussed '%rge" or "small"
project or ff no project is going to take place at this time. The Trott Brook
Farms plat on approximately 280 acres of developable property has been
approved by the City Council conditioned upon the City Council ordering a
sewer and water project. The Main Street/Highway 169 commercial
redevelopment and Business Park project has been in the planning stages for
a number of years and it is now moving toward Planning Commission review.
The developers and landowners for both of these projects have petitioned the
city for public improvements.
After the September 28, 1998, improvement public hearing, staff supports
City Council action to move forward with the resolution approving the plans
and specifications for the project; going out for bids for the big project with
information being included in the bid package which highlights the
possibility of awarding only the small project; and, the Council calling for an
assessment public hearing for the public improvement project. Action on at
least these three items will set the stage for a final decision in early
December by the City Council on what type of public improvement project to
pursue and order for 1999.

RE: EAST ELK RIVER PUBLIC HEARING
Dear Council Members:
As you are aware, on September 28, 1998, the public hearing for the East Elk River
Project Area C is scheduled. Staff will be prepared to make a complete presentation on
the project. It is anticipated that the presentation will cover the following items:
Project History
Proposed Trunk Utility Improvements
Estimated Project Costs, including Street and Storm Sewer
Proposed Assessments for Trunk Utilities
429 Process
Future Project Schedule
We will have handouts available for the public. After the presentation, we will be
available to answer questions that the City Council and public may have.
At the close of the public hearing, there are three attached resolutions that the City
Council may want to consider adopting. After the public hearing, the first resolution
orders the improvement, giving the project the official go-ahead to proceed to the next
step. The second resolution approves the plans and specifications that were ordered on
September 14th and authorizes the advertisement for bids. If this resolution is adopted,
we would anticipate receiving bids for the trunk utilities sometime in mid to late
November. The third resolution establishes the amount to be assessed and orders the
preparation of the assessment roll. The assessment rate can be lowered at the
assessment hearing, but it cannot be raised without starting the whole process over. If
this resolution is adopted, staff would anticipate an assessment hearing being held
sometime in early December, at which time the City Council could also consider the bids
for the project.
Finally, if the City Council proceeds with bidding the utility project, staff would request
direction to work with Evergreen Land Services to pursue the necessary permanent and
temporary utility easements.

A RESOLUTION ORDERING THE IMPROVEMENT IN
THE MATTER OF THE EAST ELK RIVER PHASE I IMPROVEMENT
OF 1998
WHEREAS
WHEREAS
a public hearing relating to the East Elk River Phase I improvement was held
before the Elk River City Council after ten days mailed notice and two weeks
published notice of the hearing was given; and
the City Council has duly considered the Feasibility Report and those matters
presented at the public hearing by those persons desiring to be heard on the
matter;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River, Minnesota:
1. The East Elk River Phase I improvement is hereby ordered as recommended in the
Feasibility Report dated July 21, 1997.

A RESOLUTION APPROVING THE PLANS AND SPECIFICATIONS
AND ORDERING THE ADVERTISEMENT FOR BIDS
IN THE MATTER OF THE EAST ELK RIVER PHASE I
IMPROVEMENT OF 1998
WHEREAS
pursuant to Resolution 98 - 99, the Project Engineer has prepared plans and
specifications for the East Elk River Phase I improvement, which plans and
specifications have been reviewed by the City;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River, Minnesota:
Such plans and specifications, a copy of which is attached hereto and incorporated
herein by this reference, are hereby approved.
The City Administrator shall prepare and obtain the publication of an advertisement for
bids for the making of the improvement pursuant to the attached plans and
specifications. The advertisement shall be published once each week for three
consecutive weeks, shall specify the work to be done, and shall state that the bids will be
received by the City Administrator until 10:00 a.m. on Tuesday, November 17, 1998, at
which time the bids will be publicly opened in the Council chambers of the City Hall by
the City Administrator and the Project Engineer and will then be tabulated for
consideration by the City Council at a meeting thereof at 6 o'clock p.m. on December 3,
1998, in the City Council chambers at City Hall. No bids will be considered unless
sealed and filed with the City Administrator and accompanied by a cash deposit,
cashier's check, bid bond, or certified check payable to the City Administrator in the
amount of 5% of the amount of such bid.

A RESOLUTION DETERMINING ASSESSED COST OF
IMPROVEMENT AND ORDERING PREPARATION OF
PROPOSED ASSESSMENT ROLL IN THE MATTER OF
EAST ELK RIVER PHASE I IMPROVEMENT OF 1998
costs have been determined for the East Elk River Phase I improvement
consisting of a contract price of $9,307,328.00 and expenses incurred or to be
incurred by the City in the making of the improvement in the amount of
$3,056,052.00 for a total cost of the improvement of $12,363,380.00.
THEREFORE, BE IT RESOLVED by the City Council for the City of Elk River, Minnesota:
Based upon the City Assessment Policies, it is determined that the portion of this
improvement to be paid by the City and not assessed to benefited properties is
$7,863,380.00.
The portion of the cost to be assessed against benefited properties pursuant to the Elk
River City Assessment Policies shall be $4,500,000.00
The assessments shall be payable in equal annual installments and shall extend over a
period of seven to fifteen years, the first of the installments to be payable on or before
the first Monday in January, 2000, with interest at the rate of 8.0% per annum from the
date of the adoption of the assessment resolution.
The City Administrator with the assistance of the Project Engineer shall forthwith
calculate the proper amount to be specially assessed for such improvement against
every assessable lot, piece, or parcel of land, without regard to cash valuation, as
provided by law, and shall have available to the City Administrator's office a copy of the
proposed assessment roll for public inspection.
Upon completion of the proposed assessment roll, the City Administrator shall notify the
Council and schedule a public hearing upon the proposed assessment, causing notice of
the hearing by publication and mail to be made at least two weeks prior to the hearing.

SANITARY SEWER/WATER OTHER COSTS
There are a number of other costs associated with connecting existing homes to the City
sanitary sewer and water system. These are described as follows:
Sewer Availability Charge (SAC)
Each property owner connecting to the City's sanitary sewer system must pay a fee at the time
of the hook-up. This fee is intended to cover the individual property's "buy-in" to the
wastewater treatment plant. This SAC charge is currently $1,300 per single family residential
unit.
Water Availabili _ty Charge (WAC)
Each property owner connecting to the City's water system must pay a fee at the time of the
hook-up. This fee is intended to cover the individual property's "buy-in" to the wells, elevated
towers, and water treatment facilities. This charge is currently $1,350 per single family
residential unit.
Connection of sanitary sewer and water service from property line to home
The individual property owner is responsible for bringing the sanitary sewer and water services
from the property line to the home and connecting them. This cost will vary per property,
depending on many variables, such as how far the home is from the property line, where the
sanitary sewer and water enter the home, and what type of restoration must be done over the
service lines.
Existing Septic Tank
City code requires that the existing septic tank be pumped and crushed and filled with dirt.
This is for safety purposes.
Existing Well
City code allows wells to be used for outside irrigation, but they must be separated from the
City system.
Monthly User Charges
There is a monthly user charge for City sanitary sewer and water service. These charges are
based on water usage, and will vary according to how much water is used each month.

Duitsman and Councilmember Dietz opposed. Councilmember Dietz
his opposition was based on the fact that he-felt the Rivers Edge should
y half of the cost of the project.
East Elk River Trunk Sewer and Water Public Informational Meetinq
City Engineer Terry Maurer explained that the purpose of the public informational
meeting is to receive input from the property owners regarding the timing and
scope of project that the city should undertake regarding the extension of trunk
utilities to the eastern area of the city.
Jason Messner, Peter Patchin and Associates, Inc., indicated that the firm of Peter
Patchin was requested to perform appraisals as to the market value benefit
relating to trunk improvements for the eastern area of the city. He explained that
the appraisal revealed that the market benefit of trunk sewer and water lines into
the east Elk River urban service district is $6,000 per acre for residential and
industrial lands and $8,000 per acre for commercial lands.
City Attorney Peter Beck explained to the residents that it is the Council's
intention to take public input regarding the extension of trunk sewer and water
lines into the east Elk River urban service district in order to decide whether to
proceed with the project. He further indicated that tonight's meeting was merely
a public informational meeting and not an assessment hearing.
Mayor Duitsman opened the public hearing.
Dwight Kirkeide, 12230 173,~ Avenue NW, distributed a handout entitled Toward a
New Game Plan. Mr. Kirkeide indicated he was opposed to the proposed project
based on the increased cost to the homeowners.

Roger EuII, 18880 Boston Street, indicated he owned 80 acres that would be
affected by the proposed project. He indicated he did not feel he would receive
benefit because he did not have highway frontage. He indicated he was
opposed to the project.
Mayor Duitsman entered two letters into the record; one from Ron Ebner in
opposition to the project and one from Kemethese Motel, Inc. in favor of the
project.
Bob Vandenberg, 10811 181~ Avenue, indicated he owned 80 acres that would
be affected by the proposed project. He stated he felt that $6,000 per acre for
residential and industrial lands was a fair price and stated he was in favor of the
proposed project.
Rita Schmahl, representing Cargill, indicated that Cargill has 380 acres that would
be affected. She stated that Cargill has no intention of moving its location and
indicated that Cargill would receive no benefit from the extension of water and
sewer. She stated Cargill is opposed to the proposed project.
Joann Rousseau, Ebner's Live Bait, indicated that she was against the project
based on the fact that their business has no need for sewer and water and
therefore would receive no benefit.
Paul Bell, owner of Bridgeman's Restaurant, questioned how the cost would affect
him. City Engineer Terry Maurer reviewed the costs .associated with this type of
project and suggested that Mr. Bell contact him at City Hall for more details.
Dawn N~oyer, 16807 Highway 10, indicated her concern regarding the lapse in
time between when the trunk system is put in and when the laterals are actually
constructed.
Truman Moyer, 16807 Highway 10, displayed a map of the area showing those
residents who are in favor of trunk sewer and water and those residents who are
opposed to trunk sewer and water. He indicated that there are many more
residents opposed to the project than in favor. ~'~/'~
Ruth Brown, 10815 175th Avenue NW, indicated that she is opposed to the project.
Rolland Benson, 17276 Highway 10, indicated he was opposed to the project.
Landol Locher, 10983 171~ Avenue, indicated that he was opposed to the
proposed project.
Carol Turner, 18776 Cleveland, indicated that the map in the Star News did not
agree with the map of the urban service area.
Mary Jo Mishke, 10078 Twin Lakes Road, had some questions regarding the
calculation of trunk footage and how a farm of 160 acres would be assessed.
Kathy Specht, 16330 Highway 10, indicated that she had no intention of selling her
property and stated she was opposed to the project.

Mr. Dehn, 17369 East Highway 10, indicated he was opposed to the project and
stated he did not see any benefit for sewer and water due to the high cost of the
project.
There being no further comments, Mayor Duitsman closed the public hearing.
Mayor Duitsman indicated his appreciation to those people who showed up for
the meeting and to those people who spoke at the meeting. He stated that the
urban service area is an area that will be developed at some time in the future
and indicated that it is the city's responsibility to plan for this development and
further to inform the citizens as to what the cost may be. He stated that he will be
requesting the City Council to acquire right-of-way rights for the project, but has
no intention of moving forward with trunk improvements until petitioned for by a
developer.
COUNCILMEMBER HOLMGREN MOVED TO AUTHORIZE THE CITY ENGINEER TO DO A
DETAILED STUDY REGARDING WHERE THE TRUNK SYSTEM COULD BE LOCATED.
COUNCILMEMBER DIETZ SECONDED THE MOTION. THE MOTION CARRIED 5-0.
COUNCILMEMBER HOLMGREN MOVED TO AUTHORIZE STAFF TO OBTAIN QUOTES
FROM A FIRM TO ACQUIRE RIGHT-OF-WAY EASEMENTS WHEN THE LOCATIONS HAVE
BEEN DETERMINED. COUNCILMEMBER DIETZ SECONDED THE MOTION. THE MOTION
CARRIED 4-1. Councilmember Scheel opposed. Councilmember $cheel
indicated that she is not ready to acquire easements at this time.
7. Adjournment
There being no further business, COUNCILMEMBER FARBER MOVED TO ADJOURN.
COUNCILMEMBER HOLMGREN SECONDED THE MOTION. THE MOTION CARRIED 5-0.

Overview
As you are aware of the Arena will be installing a new dehumidifier and heater unit this
fall. The existing dehumidifiers will no longer be needed and can be sold. I have
discussed the resale value of these units with Nelson Rudie and Associates and Mutners
Dehumidifiers. The dehumidifiers in the Arena sell for about $9,000.00 each when new.
The resale value of the units according to the two companies would be about 20% to
25%, of the purchase price of new units, which is about $4500.00 for both units. Mark
Rodorigo from Commercial Refrigeration has agreed to purchase both units for
$10,000.00 this is a little over 55% of what the units sell for when new. He has also
agreed to remove the units from the Arena at his own expense.
Recommendation
I recommend that the City Council approve the sale of the two dehumidifiers to
Commercial Refrigeration for $10,000.00 as stated in the agreement.

This agreemeht is between the City of Elk River and Commercial~Refrigeration regarding
the purchasing of the two Dectron dehumidifier units in the Elk River Arena.
Commercial Refrigeration agrees to the following terms:
To purchase the Dectron dehumidifier units as is at a cost of $10,000.00 for both unites.
To cover all cost for the removal of the Dectron dehumidifier units from the Elk River
Arena.
To obtain insurance to cover any accidents that might occur during the removal of the
Dectron dehumidifiers units.
To provide payment 30 (thirty days) from the date of the invoice.
I agree purchasing the Dectron dehumidifier units following the above terms. I
understand that an invoice for the units will be issued once the units are removed from
the arena.

Dear Rich:
The existing Dectron direct expansion dehumidification units installed in thc new arena
would not be required if a desiccant based system is installed. The existing units could be
removed and sold to a reclaim company. The value of the equipment is greatly dependent
on the needs of the company reclaiming the equipment. Removing the equipment will be
difficult which will further reduce the resale value of the units. A very rough estimate of
the value would be 20% of the or/ginal equipment cost.
· The units could be left in service, which would give the arena a built in redundancy for
the dehumidification systems.
