10-12-1998 CC MINMEETING OF THE ELK RIVER CITY COUNCIL HELD AT THE ELK RIVER CITY HALL MONDAY, OCTOBER 12, 1998 Members Present: Mayor Duitsman, Councilmembers Dietz, Thompson, Farber, and Holmgren Members Absent: None Staff Present: Pat Klaers, City Administrator; Sandra Peine, City Clerk; Lori Johnson, Assistant City Administrator; Steve Rohlf, Building and Zoning Administrator; Terry Maurer, City Engineer; Bruce West, Fire Chief; Phil Hals, Street/Park Superintendent 1. Call Meetinq To Order Pursuant to due call and notice thereof, the meeting of the Elk River City Council was called to order af 6:45 p.m. by Mayor Duitsman. 2. Consider Aqenda COUNCILMEMBER HOLMGREN MOVED TO APPROVE THE 10/12/98 CITY COUNCIL AGENDA AS PRESENTED. COUNCILMEMBER FARBER SECONDED THE MOTION. THE MOTION CARRIED 5-0. 3. Consider Consent Agenda COUNCILMEMBER FARBER MOVED TO APPROVE THE CONSENT AGENDA AS FOLLOWS: 3.1. 3.2. 3.3. 3.4. CHECK REGISTER - APPROVED 9/28/98 CITY COUNCIL MINUTES - APPROVED MAYORAL PROCLAMATION PROCLAIMING THE WEEK OF OCTOBER 12-16 AS MINNESOTA MANUFACTURERS WEEK - APPROVED RESOLUTION 98-110 CALLING FOR A PUBLIC HEARING BY THE CITY COUNCIL ON THE MODIFICATION OF THE BUDGET IN THE PLAN FOR TAX INCREMENT FINANCING DISTRICT NO. 9 - APPROVED COUNCILMEMBER HOLMGREN SECONDED THE MOTION. THE MOTION CARRIED 5-0. 4.1. Consider Resolution Canceling the 1998 Victoria Lane Overlay Assessments City Administrator Pat Klaers explained that the Council previously decided to delay the overlay project due to a semi truck in the area that would be using the newly overlaid road. The City Administrator stated that the Planning Commission is in the process of reviewing an ordinance amendment relating to the parking of semi truck trailer/tractors in residential areas. He recommended that the Victoria Lane overlay assessment be canceled at this time. He suggested that the project be considered in the future when other overlay assessments are planned. Elk River City Council Minutes October 12, 1998 Page 2 COUNCILMEMBER FARBER MOVED TO ADOPT RESOLUTION 98-111 CANCELING THE VICTORIA LANE OVERLAY ASSESSMENTS FOR THE 1998 IMPROVEMENT PROJECT. COUNCILMEMBER HOLMGREN SECONDED THE MOTION. THE MOTION CARRIED 5-0. 4.2. Review Heritaqe Preservation Commission Request Building and Zoning Administrator Steve Rohlf explained that a group of citizens interested in the heritage of Elk River are requesting the City Council to consider the establishment of a Heritage Preservation Committee for the City of Elk River. Steve Rohlf requested the Council to authorize staff time for the research of potentially establishing a Heritage Preservation Commission. COUNCILMEMBER HOLMGREN MOVED TO AUTHORIZE STAFF TO RESEARCH THE ESTABLISHMENT OF A HERITAGE PRESERVATION COMMITTEE. COUNCILMEMBER FARBER SECONDED THE MOTION. THE MOTION CARRIED 5-0. 4.3. Request by Irwin and Mar.claret Olson for Waiver to Fees City Administrator Pat Klaers indicated that the Olsons have been approved for an administrative subdivision. He stated that the approval was contingent upon the Olsons paying the current park dedication fee of $650 and storm water management fee of $61.80. Irwin Olson requested the Council to waive the park dedication and storm water management fee for the newly created lot. COUNCILMEMBER DIETZ MOVED TO DENY THE REQUEST TO WAIVE THE FEES. MAYOR DUITSMAN SECONDED THE MOTION. THE MOTION CARRIED 4-1. Councilmember Farber opposed. 4.4. Ordinance Establishin.cl Fire Prevention Bureau Fire Chief Bruce West requested the Council to consider an ordinance establishing a Fire Prevention Bureau. The ordinance would address the issue of inspections and the use of the current uniform fire code as adopted by the State of Minnesota. COUNCILMEMBER FARBER MOVED TO ADOPT ORDINANCE 98-20 AMENDING SECTION 1000, STATE BUILDING CODE, AND ESTABLISHING A NEW SECTION 207, FIRE PREVENTION. COUNCILMEMBER HOLMGREN SECONDED THE MOTION. THE MOTION CARRIED 5-0. 4.5. Consider Purchase Aqreement between John Lenz and the City of Elk River COUNCILMEMBER FARBER MOVED TO ADOPT RESOLUTION 98-112 EXECUTING THE PURCHASE AGREEMENT AND AUTHORIZING THE SALE OF LAND BETWEEN JOHN LENZ AND THE CITY OF ELK RIVER FOR LOT 1, BLOCK 1, PARKVIEW ADDITION. COUNCILMEMBER HOLMGREN SECONDED THE MOTION. THE MOTION CARRIED 5-0. Elk River City Council Minutes October 12, 1998 Page 3 4.6. 4.7. 4.8. 5.1. Consider Request to go out for Bids for Street Department Trucks Street/Park Superintendent Phil Hals requested authorization to go out for bids for two vehicles: one in 1999 and one in 2000. COUNCILMEMBER HOLMGREN MOVED TO AUTHORIZE STREET/PARK SUPERINTENDENT PHIL HALS TO GO OUT FOR BIDS FOR A SELECT-SHIFT TRANSMISSION VEHICLE FOR 1999 AND AN AUTOMATIC TRANSMISSION VEHICLE FOR THE YEAR 2000. COUNCILMEMBER FARBER SECONDED THE MOTION. THE MOTION CARRIED 5-0. Request for Contribution for 1999 Herita.qe Festival COUNCILMEMBER THOMPSON MOVED TO OFFER ASSISTANCE TO THE HERITAGE FESTIVAL COMMITTEE FOR THE 1999 HERITAGE FESTIVAL BY PAYING FOR POSTAGE AND GARBAGE PICK UP. COUNCILMEMBER DIETZ SECONDED THE MOTION. THE MOTION CARRIED 5-0. Request to For.qive Interest on Assessments Assistant City Administrator Lori Johnson stated that Mr. Joe Bickman has requested the city to forgive interest which has accrued on his assessments which were deferred under the Green Acres provision of Minnesota property tax laws. Lori Johnson explained that assessments on Green Acres parcels are deferred automatically by the county when the property owner applies for Green Acres status. She further indicated that if a parcel is already Green Acres deferred, the assessments are automatically deferred when certified to the county. She stated that property owners often do not realize that there is an outstanding assessment accruing interest on their property. Lori Johnson indicated that several years ago the city requested that a sentence be added to the Green Acres card stating that assessments are automatically deferred unless the property owner requests otherwise. She indicated that Sherbume County opted not to add this notice to the Green Acre cards. Lori Johnson indicated that although Chapter 429 does allow for the deferral or forgiveness of interest on assessments, the Green Acres statute does not contain such a provision. Therefore, the city has no authority to forgive interest on any assessments deferred under the Green Acres statute. Mr. Joe Bickman was present and requested the Council to forgive the interest on his assessments. Mayor Duitsman indicated that he understands Mr. Bickman's situation, however the city does not have the authority to forgive interest on assessments deferred under the Green Acres statute. 171~t/Hi.qhway 10 Signal Update Terry Maurer indicated that the documents needed from MnDOT to bid this project will not be received until January and the project would likely not be bid until February 1999. Terry Maurer indicated that MnDOT will pay 60 percent of the improvements including the signal and driveway closure at Houles and the installation of the concrete median along 171,t Avenue. Review Auburn Street Proposal Terry Maurer indicated that the City Council authorized the installation of two speed bumps on Auburn Street. He stated that the bumps have not been installed due to opposition from the neighbors in the area. Terry Maurer indicated that he met with a few of the neighbors who are interested in exploring other opportunities to alleviate the amount and speed of traffic on Auburn Street. One of the issues discussed was the possibility of installing cul-de-sacs in the street from the nodh and the south, eliminating the cut through traffic. Terry Maurer indicated that an issue with the installation of cul-de-sacs would be the responsibility for payment of the improvement. Terry Maurer indicated that the developer is not interested in paying for the installation of cul-de-sacs. After discussion it was the consensus of the Council to hold a neighborhood informational meeting to determine whether the residents are in favor of this option and if they would be willing to pay for the installation of cul-de-sacs. COUNCILMEMBER THOMPSON MOVED TO HOLD AN INFORMATIONAL MEETING FOR RESIDENTS ON AUBURN STREET REGARDING THE AMOUNT AND SPEED OF TRAFFIC ON AUBURN STREET. COUNCILMEMBER HOLMGREN SECONDED THE MOTION. THE MOTION CARRIED 5-0. Stop Si,cln Study on Dod.qe Street/189th Avenue City Engineer Terry Maurer indicated that the City Council authorized an all-way stop sign warrant study for the intersection of 189th Avenue and Dodge Street. Terry Maurer stated that after the study was completed it was determined that none of the warrants for multi stop control were met and recommended that stop signs on Dodge Street are not warranted. COUNCILMEMBER THOMPSON MOVED TO DENY THE INSTALLATION OF A FOUR WAY STOP SIGN AT DODGE STREET AND 189TM AVENUE BASED ON THE RECOMMENDATION FROM THE CITY ENGINEER. COUNCILMEMBER DIETZ SECONDED THE MOTION. THE MOTION CARRIED 5-0. Stop Si,qn Study on 3rd Street and Gates Avenue City Engineer Terry Maurer indicated that the City Council authorized a stop sign study to be conducted at the 3~d Street and Gates Avenue intersection. Terry Maurer indicated that after the study was completed it was determined that none of the warrants for the multi way stop control were met at this intersection. He recommended that stop signs not be added at northbound and southbound Gates Avenue at this time. COUNClLMEMBER DIETZ MOVED THAT NO STOP SIGNS BE ADDED AT THE INTERSECTION OF 3"D STREET AND GATES AVENUE BASED ON THE RECOMMENDATION OF THE CITY ENGINEER. COUNCILMEMBER THOMPSON SECONDED THE MOTION. Park and Recreation Bond Referendum Update The City Administrator updated the Council on recent public informational activities for the park and recreation bond referendum. 8.
