Action Requested
Recommend, by motion,approval of the Conditional Use Permit (CUP) request by Noodles and Co. to
operate a Class I restaurant in the Elk River Crossing Planned Unit Development (PUD)with the
following condition:
1. The Conditional Use Permit is not a building permit and the applicant must apply
for and receive approval of all required permits before construction may begin.
2. The applicant must apply for and receive approval of all required sign permits before
signage may be installed.
Background/Discussion
The subject property is located within the Elk River Crossing PUD, approved in 1996.The PUD
agreement lists Class I restaurants as a conditional use,requiring a CUP application and approval from
both the Planning Commission and the City Council.
Noodles and Company will occupy a 2,450 square foot end unit at 18130 Zane St NW. The building also
houses a UPS Store and Aveda Salon.Additionally, the applicant is proposing to modify the landscape
area south of the building to accommodate an outdoor dining area.
Noodles and Company is a casual dining restaurant that offers cooked to order noodle dishes. They also
offer soups, salads, and breads along with juices, sodas,bottled beer and wine. Orders are taken at the
counter and food is served to customers seated at their tables. The tables are bussed by employees. Patio
seating offers the same services.
Building
Plans include seating for 58 customers inside and 30 customers outside. Outside seating will be located on
a new 520 square foot patio surrounded with a metal fence. Patio access will be from a new door on the
south side of the building.
Architecture
No structural changes to the building are proposed,however the applicant proposes to replace the
existing awnings with the signature colors of the business. The awnings will not include any signage.

NATURE
Parking
The proposed use requires 27 parking spaces per city ordinance (1 space per 4 seats plus 5 more). There
are 88 proposed seats. Other uses in the building require 28 spaces,bringing the total for the building to
55 stalls. The parking lot includes 70 parking spaces. There will be approximately 1,700 square feet of
vacant space, and 15 spaces will be available for that use.
Signage
Sign plans include three internally lit wall signs, one on each building facade.Additionally, one window
sign on the front facade, and signage on the patio umbrellas are included. Proposed signage complies with
all PUD requirements.
Applicable Regulation
Conditional Use Permit
The issuance of a Conditional Use Permit can be ordered only if the use at the proposed location:
1. Will not endanger, injure or detrimentally affect the use and enjoyment of otherpropery in the immediate
vicinity or the public health, safety, morals, comfort, convenience or general welfare of the neighborhood or the city.
2. Will be consistent with the comprehensive plan.
3. Will not impede the normal and orderly development and improvement of surrounding vacant property.
4. Will be served adequately by and will not adversely affect essential public facilities and services including
streets,police and fire protection, drainage, refuse disposal, water and sewer ystems,parks and schools;and
will not, in particular, create traffic congestion or interference with traffic on adjacent and neighboring public
thoroughfares.
5. Will not involve uses, activities,processes, materials, equipment and conditions of operation that will be
detrimental to any persons orpropery because of excessive traffic, noise, smoke,fumes,glare, odors, dust or
vibrations.
6. Will not result in the destruction, loss or damage of a natural, scenic or historic feature of major importance.
7. Will fully comply with all other requirements of this Code, including any applicable requirements and
standards for the issuance of a license or permit to establish and operate the proposed use in the ciy.
If denial of such a permit should occur,it shall accompany recommendations or determinations by
findings or a report stating how the proposed use does not comply with the standards set forth in Section
30-654.
In the review of the standards for CUP as outlined,it appears that the request is consistent with all of
these standards.

Please consider this letter as formal application for a Conditional Use Permit for the operation of a
restaurant use with outdoor seating at the Elk River Crossing center at 18130 Zane Street,NW. The land
parcel is zoned PUD.
As a brief introduction to the project, Noodles and Company is in lease negotiations to occupy
approximately 2450SF end cap of an 8031 SF pad building located in the Elk River Crossing shopping
center. The existing site at Elk River Crossing is a multi-tenant building that is also home to a UPS store,
and an Aveda salon. This pad building is situated on a 2 acre parcel that contains 70 parking spaces.
[Restaurants are parked at 1 space per 4 seats +5 spaces, which(with 56 interior seats)would require 14
+4 or 18 parking spaces. Outside seating, estimated at 30, would be seasonal. Parking for the remaining
uses are calculated at 5 spaces per 1000GFA; which at 5581 SF remaining, would require 28 spaces. The
resulting total for the pad building would be 46 total parks.]
Noodles and Company is a family friendly, casual dining restaurant offering a variety of noodles dishes
from around the world,cooked to order and made with fresh ingredients to meet every taste. In addition to
the pasta selections available, fresh soups, salads and rolls are available, along with selections of juices,
soft drinks, bottled beer and wine. Orders are taken at the customer counter, and food is then served to
customers seated at their tables on ceramic dishes and flatware. Tables are bussed by Noodles employees.
Patio,or outside seating,is also available,with the same services available for those customers as well.
Noodles and Company typical operating hours are 11AM - 9PM Sunday through Thursday, and 11AM -
10PM Friday and Saturday. Employees number approximately 8-10 per shift,as needed.
Noodles is proposing no changes to the architectural appearance of the building with the exception of
replacing signage and existing awnings with Noodles signature colors and designs; please refer to the
enclosed attachments for sizes, materials and placement. Signage will meet the relevant code and
guidelines applicable to the PUD,with three signs, one on each of the three street facing facades.Noodles
will utilize the existing trash dumpster enclosure,with service on a daily or as-needed basis,as provided by
the property owner.

Noodles proposes to utilize a portion of the existing grass area contiguous to the building as a patio/outside
seating area. This use would add to the pedestrian nature of the center,creating an environment for activity
and interaction in the center. Replacing the grassy area with concrete patio,a railing,and attractive outside
tables and chairs will add an attractive character element to the building. As the tables are bussed and
maintained by the restaurant staff,no outside garbage cans are necessary.
We are confident the City of Elk River will find Noodles to be a compatible and complimentary use for the
Center and for the City as a whole.
