RE: ORONO PARKWAY IMPROVEMENTS
Dear Council Members:
As We discussed with you at the last City Council meeting, we have attempted to negotiate a
change order with the Iow bidder on the Orono Parkway Improvements to eliminate the
reinstallation of the lighting system. Thus far, we have been unable to negotiate what we
believe to be a reasonable price for the removal of the existing lights or, in other words, a
reasonable deduct for not reinstalling the lights. The Contractor is insistent that he receive one-
third of his bid amount, approximately $33,000, for removing the lights. We believe this amount
is far in excess of what the work is actually worth. Therefore, we would recommend rejecting all
of the bids received for the Orono Parkway Improvements and directing staff to re-advertise for
the bidding of the project minus the reinstallation of the lighting component. Attached is a
resolution which will accomplish both items: rejecting the bids and authorizing re-advertisement
for the bid on the revised project.
For your information, Phil Hals and I have been looking at a small street maintenance project at
the intersection of 193rd Avenue and Evans Street in the vicinity of the City liquor store. Evans
Street is showing significant rutting as the southbound lane approaches the stop sign. We
assume that this is due to the relatively heavy vehicles that this intersection sees. There is also
some deterioration of the bituminous surface on the edge of westbound 193rd Avenue as it
approaches Trunk Highway 169. Therefore, the maintenance project would be to remove by
milling a portion of the blacktop and overlay the area. There is also some deterioration of the
concrete cross gutter which we believed should be replaced. We are planning to bid this work
with the Orono Parkway Improvements since it is very similar in the type of work.
If you have any questions regarding this information, I will be in attendance at your July 8, 2002,
City CounCilr meeting.

A RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION REJECTING ALL BIDS AND
APPROVING THE REVISED PLANS AND SPECIFICATIONS
AND ORDERING THE ADVERTISEMENT FOR BIDS
IN THE MATTER OF THE ORONO PARKWAY
IMPROVEMENT OF 2002
WHEREAS
the City Council has determined that all bids received for the Orono Parkway
Improvement are too high and the project needs to be redesigned eliminating the
lighting component; and
WHEREAS
pursuant to City Council direction, the Project Engineer has prepared plans and
specifications for the revised Orono Parkway improvement, which plans and
specifications have been reviewed by the City;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River, Minnesota:
1. All previous bids received for the Orono Parkway improvement are hereby rejected.
Such plans and specifications, a copy of which is attached hereto and incorporated
herein by this reference, are hereby approved.
The City Administrator shall prepare and obtain the publication of an advertisement for
bids for the making of the improvement pursuant to the attached plans and
specifications. The advertisement shall be published once each week for three
consecutive weeks, shall specify the work to be done, and shall state that the bids will be
received by the City Administrator until 10:00 A.M. on July 25, 2002, at which time the
bids will be publicly opened in the Council chambers of the City Hall by the City
Administrator and the Project Engineer and will then be tabulated for consideration by
the City Council at a meeting thereof at six o'clock p.m. on July 29, 2002, in the City
Council chambers at City Hall. No bids will be considered unless sealed and filed with
the City Administrator and accompanied by a cash deposit, cashier's check, bid bond, or
certified check payable to the City Administrator in the amount of 5% of the amount of
such bid.
