SR 11-16-1998TT]~ ~7.1. ity of 'ver MEMORANDUM TO: FROM: Mayor and City Council Laurie Mezera-Kerr, ~\~ Environmental/Code Enforcement Officer DATE: November 16, 1998 SUBJECT: Regulation of Truck Tractors and Trailers on Residential Lots As requested, the Planning Commission has reviewed the proposed ordinance amendment regulating truck tractors and trailers on residential parcels. After several meetings and considerable public comment, the Planning Commission recommends approval of the proposed amendment. EXISTING CODE: Section 500.06(6) The following are declared to be a nuisance affecting public peace and safety: 6. The parking of a truck, tractor and/or trailer, or other commercial-type vehicles, excluding pickup trucks or vans, in excess of seven thousand (7,000) pounds gross weight on public property within an area zoned residential. In addition, the parking of semitractor trailers (whether standing alone or in combination with a semitractor) on residential lots except those non-City sewered lots located in A-1 and R-1/A Districts. PROPOSED CODE: Section 500.06(6) The following are declared to be a nuisance affecting public peace and safety: The parking of a truck tractor and/or trailer, or other commercial type vehicle, excluding pickup trucks or vans, in excess of seven (7,000) thousand pounds gross weight, on: a. Public property within an area zoned residential; b. Residential lots in all zoning districts, except R-lA and A-1 Districts; 13065 Orono Parkway · P.O. The idling of a truck tractor in excess of fifteen (15) minutes. Reasons for restricting commercial truck tractor and trailer operations in residential areas include the following: reduce commercial truck activity and/or traffic in residential settings · eliminate noise generated by diesel truck tractors · eliminate odor generated by diesel truck tractors · protect property values and aesthetics · reduce wear on residential roadways RECOMMENDATION: It is recommended that the City Council approve ordinance amendment No. 98- regulating truck tractor and trailer operations and/or storage on residential parcels. ORDINANCE 98- CITY OF ELK RIVER AN ORDINANCE OF THE CITY OF ELK RIVER AMENDING SECTION 500.06(6) OF THE CITY CODE OF ORDINANCES Case No. OA 98-5 The City Council of the City of Elk River does ordain as follows: Section 1. Section 500.06(6) of the City of Elk River Code of Ordinances shall be amended to read as follows: The following are declared to be a nuisance affecting public peace and safety: 6. The parking of a truck tractor and/or trailer, or other commercial type vehicle, excluding pickup trucks or vans, in excess of seven (7,000) thousand pounds gross weight, on: a. Public property within an area zoned residential; Residential lots in all zoning districts, except the R-lA and A-1 Districts; and Co Platted parcels and lots five (5) acres in size or less in the R-lA and A-1 Districts, unless a conditional use permit for a home occupation has been granted. The idling of a truck tractor in excess of fifteen (15) minutes from April 16th through October 31st; and thirty (30) minutes from November Ist through April 15th. Section 2. That this ordinance shall take effect January 1, 1999, upon publication as provided by law. Passed and adopted by the City council of the City of Elk River this 16th day of November, 1998. Henry A. Truck tractor and/or trailer parking (platted parcels or parcels less than five (5) acres in size)' Section 2. Section 900.12(5) of the City of Elk River Code of Ordinances shall be amended to read as follows: Ao Permitted Uses: x.
