Request
The applicants Del and Sandi Bauers request an administrative subdivision
to create a new lot.

Background
The applicants are requesting an Administrative Subdivision to subdivide an
existing 5.85 acre parcel into a new 2.73 acre lot (lot E) and a 3.10 acres lot
(lot D&C). The neighbors, the Hommes, presently have a driveway easement
on the north 33 feet of the applicants property. The driveway easement is no
longer needed since 210th Avenue NW was recently built and provides access
to the proposed lot and the Hommes lot. Concurrently with the subdivision,
the Hommes are going to release the driveway easement on the applicants
property in exchange for the eastern ½ acre of the applicants property,

labeled "C", with a lot line adjustment. After the administrative subdivision
and lot line adjustment, the applicants property will be roughly 2.59 acres
and all the lots will conform with the 2.5 acre minimum lot size in the Rla
zone. The applicants home presently sits in the proposed lot D, and the
remainder of the two lots are wooded.
Street Right-of-Way
The Proposed new lot, E, shows a 33 foot road easement along the west
property line for Ogden Street NW. Sherburne County could not find record
of the easement. The City will require the easement be granted to the City
prior to deeded to the City prior to recording the administrative subdivision.
Drainage and Utilit~ Easements
Neither of the new lots, E or D show drainage and utility easements. The
City requires that 10 foot drainage and utility easements be placed along the
front and rear property lines, and 5 foot along the side property lines and be
granted to the City prior to recording the administrative subdivision.
Septic
The lots are in the Rla zone and have no sewer or water service. The newly
created lots will be required to have a well and septic.
Park and Recreation Commission Recommendation
On November 18th, Staff will be recommending that the Park and Recreation
Commission recommend a cash dedication in lieu of land to satisfy the park
dedication requirements for the one new lot being created.
Recommendation
Staff recommends that the City Council approve the request by Del and
Sandi Bauers for and an Administrative Subdivision to subdivide a 5.85 acre
parcel into a 2.73 acre lot and a 3.10 acres lot with the following conditions:
1. THAT THE PROPOSED 33 FOOT OGDEN ROAD EASEMENT BE GRANTED TO
THE CITY PRIOR TO RECORDING THE ADMINISTRATIVE SUBDIVISION.
THAT FIVE FOOT DRAINAGE AND UTILITY EASEMENTS BE GRANTED TO
THE CITY ALONG THE SIDE PROPERTY LINES AND TEN ALONG THE
FRONT AND REAR PROPERTY LINES OF THE PROPOSED PARCELS.

PAYMENT OF PARK DEDICATION FEE IN THE AMOUNT OF $650 FOR THE
NEW LOT BEING CREATED TO BE PAID PRIOR TO RECORDING THE
ADMINISTRATIVE SUBDIVISION.
PAYMENT OF SURFACE WATER MANAGEMENT FEE IN THE AMOUNT OF
$137.50 FOR THE NEW LOT BEING CREATED TO BE PAID PRIOR TO
RECORDING THE ADMINISTRATIVE SUBDIVISION.
