A Sealcoat Fee in the amount to be determined by the city engineer shall be paid to the city prior to releasing the plat for recording. 7. A Park Dedication Fee shall be paid for the one buildable lot at the rate applicable at the time the plat is released for recording. The current rate for commercial is $7,444 per acre. 8. All required wetland and grading permits must be obtained prior to commencing work on the site. 9. Grading and erosion control plan and development plan shall be submitted to and approved by the city engineer prior to the issuance of grading permits. 10. All grading shall be certified prior to the issuance of building permits. 11. A Water Availability Charge shall be paid prior to releasing the plat for recording. 12. Any item or condition found that indicates the site is likely to yield information important to prehistory or history shall be reported to the city immediately. Further, the city reserves the right to stop work authorized in its approval until the site is appropriately investigated and work is authorized. Background/Discussion The applicant is requesting CUP,preliminary plat,and final plat approval for an automobile dealership in the C-3 zoning district. The applicant proposes to construct a new KTA dealership at the southeast corner of the intersection of Highway 10 and 171 st Ave. As part of the project, a new city street, 170th Lane,will be constructed to provide access to the dealership and a future connection to Natures Edge Business Park in the south. There will be no access from Highway 10 or 171st Ave. Additionally, the Board of Adjustments approved a variance to accommodate the plat as designed. The variance was approved on January 14, 2014. Planning Commission The Planning Commission did not have any concerns with the applications and unanimously recommended approval of both the Preliminary Plat and the CUP. Public Hearing The applicant spoke during the public hearing. He expressed his concern about the costs associated with constructing the proposed 170x'Lane to a higher tonnage than his use requires. He understands that the road will connect to the Natures Edge Business Park to the south,which will include industrial traffic. He also stated that he is fine with the conditions for the CUP and Preliminary Plat. Background/Discussion The applicant is requesting Preliminary Plat and Conditional Use Permit (CUP) approval to combine four lots into two and develop one as an auto dealership. The property is zoned C3, Highway Commercial, and automobile sales is listed as a conditional use,requiring the CUP. The applicant proposes two lots, an auto dealership on the western parcel, and an oudot which includes a large wetland area with no future development plans. Plat improvements include a new city street to provide access to the dealership, access to the property south of the dealership and a future connection to Natures Edge Business Park. Staff will assign a street name to the new street and an address to the subject property. P_.8REHED 1 Y NATURE City code requires the road to end in a cul-de-sac. However, the applicant states that they need the additional space a cul-de-sac would use for stormwater treatment and as result agree to maintain the road. The city reserves the right to use the proposed parking lot for turning around emergency and maintenance vehicles. Right-of-way will be dedicated to the city,but the city will not accept it as a city street until the road is connected to 170th Court in Natures Edge Business Park.The plat does not include access to Highway 10. The project will be served by city sewer and water. Stormwater will be controlled on site per the city's permit requirements. The CUP would allow for the sale of new and used automobiles on the site. Development includes a 16,242 square foot building and includes uses as a showroom and service area.The applicant expects employment to begin with 23 employees and grow to 40 employees as business demands. Analysis Plat The preliminary plat creates two lots, one buildable and one outlot. There is additional right-of-way for a new city street. Oudot A is mostly wetland. The buildable lot,Lot 1 Block 1,will contain the car dealership. s The new city street,"170th Lane", connects to 171 st Ave NW directly=across from the driveway to Cornerstone Ford. The proposed street services the car dealership and provides a future connection to Natures Edge Business Park. The road alignment is consistent with the Focused Area Study. The Board of Adjustment is considering a variance from the lot size. If this variance is not approved,it is appropriate to recommend denial of the subsequent applications (Plat and CUP) because the variance was denied. Site Plan The dealership is located on the western parcel with frontage on Highway 10 and 171 st Ave. The dealership facility is located near the center of the buildable lot, and surface parking comprises the majority of the remaining area.Access to the site is from two driveways off of"170th Lane". There is no access to Highway 10 or 171 st Ave. There is also a driveway connecting to the Ebner's property at the proposed terminus of 170th Lane. The driveway will provide vehicular access for the Ebner's and is largely constructed on property owned by the Ebner's. Parking includes 203 parking stalls,where 115 stalls are dedicated to vehicle sales, 40 stalls are dedicated to employee parking, 30 stalls are dedicated to customer parking, and 18 stalls are dedicated to vehicle service. Proposed parking meets all city requirements. City ordinance requires one (1) landscaped parking lot island per 15 parking stalls,requiring a total of 14 landscaped islands for the project,which the site plan meets. The trash enclosure is located south of the building and within the parking lot. The trash enclosure meets all requirements. Grading and Drainage Site grading directs runoff from the parking lot and building to the north and south sides of the parking lot. Along the north and south parking lot edges the B612 curbing is replaced with ribbon curb allowing N:\Departments\Community Development\Planning\Case Files\P\P 14-01 Jabez 2nd\P 14-01 SR Jabez 2nd 01-14-2014.docx water to flow into infiltration trenches. Excess water from the infiltration trenches flows into a storm sewer system that directs water to two bio-retention ponds east of the proposed 170th Lane on Oudot A. Staff had a number of comments to the applicant in the letter dated December 19, 2013, regarding stormwater and drainage that must be addressed before issuing the CUP. This requirement is included as a condition for approval. Building and Architecture The facility will be constructed of store front glass, architectural metal panels, and precast concrete panels. The glass and metal are used on the west and north elevations to encompass the showroom, facing Highway 10,and 171st Ave. The precast panels are primarily used on the east and south facades, facing the Ebner's and"170th Lane". Horizontal reveals on the precast panels match the architectural metal panels on the front of the building,providing a consistent building design. Exterior walls are proposed to be 26 feet in height and extend four feet above the roof of the building. The mechanical equipment will be placed in the center of the roof, and the applicant anticipates the four foot parapet will adequately screen the units from the street. Staff has asked for section/elevations showing the location of the mechanical units, and line of sight drawings to verify the screening. These should be provided prior to the building permit being issued. Proposed exterior finishes comply with city ordinances. Landscaping and Lighting The landscape plan includes 23 overstory trees, 13 ornamental trees, and 13 evergreen trees. Prairie grass is used as a ground cover in areas near the infiltration trenches, along the north and south property lines, and sod is used as a groundcover on the remaining areas. Newly landscaped areas include drip irrigation. The lighting plan includes 25 light poles equipped with LED lights. Landscape and photometric plans meet applicable city ordinances. Si—gnag Plans include one 24 foot high freestanding sign at 55 square feet in sign area, and four separate wall signs.All signage meets the recently adopted sign ordinance. A sign permit is required for each sign. Applicable Regulations Subdivision These findings are necessary for approval of the preliminary plat and the final plat: 1. The proposed subdivision is consistent with the tioning regulations(article "of this chapter) and conforms in all respects with all requirements of this Code, including the tioning regulations and this article. 2. The proposed subdivision is consistent with all applicable general and specialitied city, county, and regio n al pla n s, including, but not limited to, the city's comprehensive development plan. 3. The physical characteristics of the site, including but not limited to topography, soils, vegetation, susceptibility to erosion and siltation, susceptibility to jlooding, and drainage are suitable for the type and density of development and uses contemplated. 4. The proposed subdivision makes adequate provision for water supply, storm drainage, sewage transportation, erosion control and all other services,facilities and improvements otherwise required in this article. 5. The proposed subdivision will not cause substantial environmental damage. 6. The proposed subdivision will not conflict with easements of record or with easements established by judgment of a court. The proposed subdivision will not have an undue and adverse impact on the reasonable development of neighboring land. 8. The proposed subdivision is notpremature.A subdivision is premature if any of the following exists: a. Lack of adequate stormwater drainage. b. Lack of adequate roads. a Lack of adequate sanitary sewer systems. d. Lack of adequate off-site public improvements or support systems. The proposed subdivision includes a lot that does not comply with the minimum lot size for the C3 zoning district. The applicant has applied for a variance for the non-conforming lot. Conditional Use Permit The issuance of a Conditional Use Permit can be ordered only if the use at the proposed location: 7. mill not endanger, injure or detrimentally affect the use and enjoyment of otherpropero in the immediate vicinity or the public health, safety, morals, comfort, convenience orgeneral welfare of the neighborhood or the city. 2. mill be consistent with the comprehensive plan. 3. mill not impede the normal and orderj development and improvement of surrounding vacant properly. 4. Will be served adequately by and will not adversely affect essential public facilities and services including streets, police and fire protection, drainage, refuse disposal, water and sewer gstems,parks and schools;and will not, in particular, create traffic congestion or interference with trafc on adjacent and neighboring public thoroughfares. 5. Will not involve uses, activities,processes, materials, equipment and conditions of operation that will be detrimental to any persons orproper y because of excessive traffic, noise, smoke,fumes,glare, odors, dust or vibrations. 6 1Vill not result in the destruction, loss or damage of a natural, scenic or historic feature of major importance. 7. Willfully comply with all other requirements of this Code, including any applicable requirements and standards for the issuance of a license orpermit to establish and operate the proposed use in the city. Staff prepared a number of comments to be addressed in the comment letter dated December 19, 2013, and has included the satisfaction of these comments as a condition for approval. The proposed building will be used for new and used auto sales,parts sales and vehicle repair. Requested Actions Preliminary and Final Plat—Jabez Second Addition Cornerstone Auto is requesting approval of a preliminary and final plat for the property. The subject property currently has a metes and bounds legal description. In order to obtain a building permit the property is required to be platted. The plat consists of two lots. One lot contains the proposed dealership(Lot 1,Block 1)and the second is a natural wetland(Outlot A). Because a city street will separate these two pieces of land they can't be in the same lot. Lot 1,Block 1 is the only buildable lot and it meets all dimensional regulations. As part of this plat we are required to build a city street to serve as access to properties to the south of our project. The City's Ordinance requires that we construct a temporary cul-de-sac at the end of this street. This cul-de-sac would take up space that is needed for addition storm water treatment. In lieu of the cul-de-sac, we have agreed to maintain this road. Right-of way will be dedicated to the City as part of the plat,but the City will not accept it as a city street until future development connects this road to another one further south. Variance Our neighbors to the south are Ron and Norma Ebner. The Ebners own the parcel labeled"A" on Figure 1. This parcel is a non-conforming lot of record because it is under sized for the C-3 Highway Commercial Zoning District. Cornerstone Auto plans on purchasing the portion of parcel "A"that is labeled"B"on Figure 1 and add it to our site; resulting in a new parcel label"E". What remains of parcel "A", labeled "C"on Figure 1, will be attached to another non-conforming lot of record owned by Ebners labeled parcel"F". The new Ebner lot is labeled"G"on Figure 1. Parcel"G"is .95 acres,the minimum lot size in the Highway Commercial Zoning District is one acre; therefore in cooperation with the Ebners,we are requesting a variance on the size of this lot. Criteria for granting a variance: 1) The variance is in harmony with the general purpose and intent of the ordinance. Our request eliminates one non-conforming lot and greatly lessens the non-conformity of a second lot. The request is in harmony with the general purpose and intent of the ordinance. 2) The variance is consistent with the City of Elk River comprehensive plan. The variance,if granted,will not alter the use of the property and it will remain consistent with the City's Comprehensive Plan. 3) The petitioner proposes to use the property in a reasonable manner not permitted by the zoning ordinance. The remaining Ebner lot is undeveloped at this time,but it will basically be sized appropriately for Highway Commercial uses,which is a reasonable use of the property. 4) The plight of the petitioner is due to circumstances unique to the property not a consequence of the petitioner's own action or inaction. The two non-conforming lots involved were of record prior to the C-3 lot sizes being established. 5) The variance, if granted, will not alter the essential character of the locality. The remaining lot being .05 acres shy of the minimum requirement will hardly even be noticeable let alone will it alter the essential character of the locality. Conditional Use Permit Cornerstone Auto is requesting a conditional use permit to allow new and used vehicle sales and auto repair in the C-3 Highway Commercial Zone. The following is a description of our proposed plans: Building Cornerstone Auto's proposed building is 16,242 square feet on the lower level and a 2,880 square foot upper level. The breakdown of the use of the building is as follows: Lower level Showroom 2,880 square feet Service 5,848 square feet Service reception 900 square feet Parts,technician locker room,&tool room 2,180 square feet Office and customer areas 4,434 square feet Total 16,242 square feet Upper Level Parts Storage 1,600 square feet Office 1,280 square feet Total 2,880 square feet Exterior Elevations &Roof The front of the building will face west toward Highway 10. This exterior elevation will be store front glass and architectural metal panels. These same building materials will wrap around forty feet onto the north and south elevations to encompass the showroom. The rest of the building will be architectural precast panels. The horizontal reveals on the precast panels will match the architectural metal panels on the front of the building. The exterior walls will 26 in height. This includes a parapet that extends 4 feet above the roof line. Mechanical equipment will be placed toward the center of the roof and with the 4 foot parapet they should be adequately screened. The lights will be mounted on 25 foot poles with 2 foot bases. Photometrics have been submitted for staff's review. Drainage B612 curb will be used on the entire site with the exception of the north and south curb lines. The site is designed to drain to the north and south. In these locations ribbon curb will be used to allow an evenly distributed flow into bio-retention ponds located along the entire north and south property lines. These bio-retention ponds will treat the runoff from the site and the south one will also receive water from our neighbor to the south. Two additional sedimentation ponds are also proposed that will treat runoff from the city street we are required to build prior to discharge into the natural wetland on the east side of our property. Neighbors/Driveway The natural wetland on our property is between our proposed building site and our neighbor to the east. Highway 10 and 171 St Avenue separates us from our neighbors to the west and north. Our only neighbor directly adjacent to our proposed construction is the Ebners to the south of us. We are currently letting them cross our property from 171"Avenue to access their business. As part of our grading plan, we plan to locate a new driveway for them from the end of the city street we are required to build. This new drive will only need to cross their property. The driveway will be constructed to support emergency vehicles. Sinae The KIA required signage we are requesting can be found on Figure 2 and consists of: • One 24 foot high freestanding pylon sign; 55 square feet in size. This sign meets the City's Ordinance. • Four wall signs,which will be in compliance with the City's revised standard of 15%of the wall space. A note on Figure 2;there is a sign on the front of the building that states `Cornerstone". We are in the process of changing our name to"Cornerstone KIA". This sign will still be in compliance with the City Ordinance after adding"KIA". Landscaping Our landscape plan included 14 landscape islands evenly distributed throughout our parking lot, 26 overstory trees, 13 ornamental trees and 10 conifers. The bio-retention ponds on the north and south sides of the site will be vegetated with low profile prairie grasses. Please review and address: General Comments 1. As noted in the attached File Closure letter from the MPCA,the applicant shall notify the MPCA of the presence of petroleum odor which was encountered and noted in Soil Borings 4 and 5. The MPCA may require additional testing and remediation as part of t redevelopment. Additional contamination may be present and an environmental construction contingency plan should be developed. I j2. Locate the rooftop HVAC units on the plans and provide line of sight drawings to verify screening from the street. 3. The landscape plan must be prepared by a registered landscape architect. Drainage Comments 4. Both existing and proposed stormwater models should be run using updated ATLAS 14 precipitation data. 5. 3-feet of separation between the seasonally high groundwater table and the bottom of an infiltration device is required. It appears from the site borings and plan details that the bottom of the infiltration rock storage will be less than 3-feet from groundwater.This I should be revised as necessary. 6. The new MS4 permit requires redevelopments to maintain/reduce existing discharge quantities of runoff volume,Total Suspended Solids (TSS),and Total Phosphorus (TP) on an average annual basis. The State has developed policy for meeting this requirement one of two ways.Applicants can either show calculations showing the reduction of volume,TSS, and TP on an average annual basis or design the improvements to infiltrate of the first 1.1" of rainfall over the.new impervious. (Phis 1.1" amount is accepted as the standard required to meet the limits for pollutant loads thus not requiring the pollutant load calculations) 7. The calculation should be provided indicating the required infiltration volume is met by the proposed infiltration system. 8. The continuity error in the drainage calculation simulation should be corrected for Pond 3. 9. Consistent with new MPCA regulations,the applicant should develop and submit a written maintenance program describing the post construction stormwater maintenance operations to ensure the continued function of the infiltrating system as designed and expected. Sheet 2 of 12—SWPPP 10. Sweeping of adjacent public streets shall be accomplished with 1 hour notice of the engineer or regulating agency. P O W E R E D 0 Y 1`4 U EXHIBIT B CONDITIONS OF APPROVAL 1. Access restriction shall be placed along Highway 10 and 171st Ave. 2. Development agreement shall be signed, outlining costs and responsibilities to the satisfaction of the city attorney. 3. A letter of credit or other security acceptable to the city shall be provided in the amount of 100% of the cost of public improvements. 4. Upon completion of all improvements and acceptance by the city, a warranty bond in the amount of 25% of the improvement costs shall be submitted to the city for a one-year period. 5. A Surface Water Management Fee in the amount required by the city at the time of final plat shall be paid prior to releasing the plat for recording. ($1,287 per acre, 2014 rate) 6. A Sealcoat Fee in the amount to be determined by the city engineer shall be paid to the city prior to releasing the plat for recording. 7. A Park Dedication Fee shall be paid for the one buildable lot at the rate applicable at the time the plat is released for recording. The current rate for commercial is $7,444 per acre. 8. All required wetland and grading permits must be obtained prior to commencing work on the site. 9. Grading and erosion control plan and development plan shall be submitted to and approved by the city engineer prior to the issuance of grading permits. 10. All grading shall be certified prior to the issuance of building permits. 11. A Water Availability Charge shall be paid prior to releasing the plat for recording. 12. Any item or condition found that indicates the site is likely to yield information important to prehistory or history shall be reported to the city immediately.
