I, Duane Peterson, Park and Recreation Commission Chair,hereby request a special
meeting of the Park and Recreation Commission Tuesday,December 9,2003 at 6:30 p.m.
at Elk River City Hall, 13065 Orono Parkway, Elk River,Minnesota.
The purpose of the meeting is to meet jointly with the Planning Commission to discuss and
vote on amendments to the Comprehensive Plan.
In accordance with State Statute, I hereby request the city clerk to post this notice at least
three days prior to the meeting date. I further request the city clerk to notify each member
of the Park and Recreation Commission of this special meeting,in writing, at least one day
before the meeting.

Meeting Purpose
A special joint meeting has been called in order to prepare a recommendation to the City
Council for implementation of the Comprehensive Plan. Information has been attached to
this memo to provide a basis for the discussion.
Background Information
Hoisington Koegler Group, Inc prepared, by traffic analysis zones, information about the
land composition for the entire city for the transportation plan. We have utilized this
information to do an analysis of the land north of 33. The total land area north of County
Road 33 is 9,218 acres. Of that, 4,063 acres are vacant and developable (i.e.,minus wetlands,
easements, and right-of-way) and do not include the mining area between the railroad grade
and Highway 169,the landfill nor the area south of the landfill. The percentage of vacant
developable land is 44 percent.
To further determine the impact of a change in density from 10-acre lot minimums to 2 '/-
acre density, staff utilizing the Sherburne County plat book, identified the parcels eligible for

development totaling 60 or more acres. Those parcels are identified on the attached map.
The following table provides the calculations under the current rules includi g cluster

""As of May 2003,there were 4,759 single family homes in the city and as of April 2003,
there were 772 detached single family lots available.
The above numbers need to be evaluated in light of the topographic and biologic conditions
of the properties in question. Please refer to the excerpt of the greenway map as the
foundation for development potential. The areas in green on the map indicate wetlands,
heavily forested areas, or areas with steep slopes,which would limit development potential.

While a site may be eligible for a given number of lots,it may not be physically able to
support that number.
Given the current market and the number of available lots within the City, staff does not
believe that there will be an "avalanche" of plat applications should the plan be adopted as
written with the lands north of County Road 33 changing to Rural Residential with a density
of 2.5 acres.
Recommendation
The Commissions will need to review the options outlined in the November 25th memo and
be prepared to come to consensus on a recommendation for implementation of land use
changes north of County Road 33. This recommendation will be voted on by the
Commissions and forwarded to the City Council for their consideration on December 15th.

At the joint meeting with the Park and Recreation Commission of November 12, 2003 the
Commissions discussed the usefulness of establishing a development moratorium to allow
addition study time for implementation of the Comprehensive Plan official controls (zoning
code, zoning map, and subdivision ordinance changes). During the Comprehensive Plan
discussion at the November 17, 2003 City Council meeting,the Council discussed at length
the need to "phase in" the 2 1 acre changes north of County Road 33. To that end, a
special meeting of the Planning and Park and Recreation Commissions has been
scheduled for the December 9,2003 Planning Commission Workshop.
Implementation Components
The following is a list of changes to the City's Official Controls (zoning and subdivision
ordinances) that will be need to be considered during the implementation phase of the Plan:
Greenways - necessitating changes to the subdivision ordinance
Zoning Map Changes
New Zoning Districts - Old Town,Public Facilities, and Mixed Use
Comprehensive Wastewater Treatment Plan
Transportation Corridor Planning
Focus Area Studies (gravel mining area, redevelopment areas)

Options for Implementation
There are two options to consider in order to allow time for the City to implement changes
in the Official Controls:
1. Development Moratorium
2. Phasing Plan within the Land Use Plan for properties North of County Road
33.
Development Moratorium
In order to make a recommendation to the City Council regarding a development
moratorium,the Commissions should discuss the following components:
A. Length of the moratorium—Minnesota Statute 462.355, Sub. 4 allows for the
adoption of an interim ordinance which may "regulate, restrict, or prohibit any use,
development, or subdivision within the jurisdiction or a portion thereof for a period
not to exceed one year from the date it is effective." Said interim ordinance may be
extended for such periods not to exceed a total of eighteen months.
B. Applications which would be affected by the adoption of an interim ordinance
moratorium)
C. Purpose for implementing the interim ordinance -During the discussion, staff heard
concerns regarding natural resources inventory, implementation of subdivision
ordinance changes to encourage greenway implementation,transportation review
and planning, and new zoning ordinances relating to Old Town and Public Facilities
districts.
Phasing Plan
During a conversation with the City Attorney,City Administrator, and Mayor, the Mayor
identified the attached option for a phasing plan. The plan would provide,in tiers by
sections, lands to become guided for 2 1 acre density in 1, 5, and 7 year increments. The
tiers would start closest to County Road 33.
An alternative phasing plan would be to allow all lands north of County Road 33 to become
guided for 2 'h acre density in say, 2006. This would allow the City to complete its future
study work in 2004 and 2005.
December 9, 2003 Special Meeting
At the special meeting, staff will present information regarding the available developable
acreage north of County Road 33,the current lot inventory, and any other information
requested by the members of the Commissions. The discussion will revolve around the
points in this memo. It is anticipated that after the discussion,the Commissions can make a
recommendation on the most appropriate implementation option, including identifying work
plan priorities.
