Consider for adoption at a future meeting ordinance amendments pertaining to the organization of the
Energy City Commission.
Background/Discussion
The Energy City Commission was established with 15 members,representing businesses, boards,
commissions, and environmental interests in the city. A number of seats have been vacant for an
extended period of time. It seems appropriate to review the roster and organizing ordinances
occasionally.
Staff proposes modifying the membership from 15 members to 11 members as follows

The suggested changes combine the Council and the EDA seat, allow greater flexibility for the school
district representative (Spectrum has voiced interest,as has Minnesota School of Business), and removes
the seats that have been consistently difficult to fill. The modification is not expected to impair the work
of the commission. Lastly,the ordinance prohibits reimbursement for expenses. It is suggested that this
be modified to permit reimbursement for approved expenses (primarily approved training and travel.)

An Ordinance Amending Section 2-352, Membership; Officers; Compensation of
Members, and 2-355, Meetings and Rules of Procedure, Relating to the Energy City
Commission, of the City of Elk River, Minnesota, City Code
The City Council of the City of Elk River does hereby ordain as follows:
§ 2-352. Membership; officers; compensation of members
(a) The energy city commission shall consist of up to 4-5-11 members who shall be appointed by
the city council for terms of three years. The commission will consist of the following:
1. One representative from the city council/Economic Development Authority.
2. One representatives from the Elk River Municipal Utilities.
3. Up to six representatives from energy related businesses as determined by the city
council (this can include consultants, manufacturers,technology, environmental, energy
producers and/or energy providers).
4. One representative designated by independent School Distfict 728an Elk River area
school. Y.
5. One representative desig-fiated by Sherburne County Board of Commissioners.

All terms shall end on the last day of February;however, members shall hold office until
their successors have been appointed. A vacancy during the term of any member shall be
filled by city council appointment for the remainder of the term. Officers of the commission
shall consist of chair and vice-chair, as elected by the commission. The chair shall preside at
all meetings of the commission if present,and perform other duties and functions assigned
by the commission or the city council. The vice-chair shall perform these duties in the
absence of the chair. If a vacancy occurs in the chair office, the vice-chair shall assume the
chair's duties for the remainder of the year and a new vice-chair shall be elected by the
commission at the next scheduled commission meeting. A quorum shall consist of a majority
of the sitting members.
(b) The members of the commission sha14 sefve without pay or reimbursement for expenses.
§ 2-355. Meetings and rules of procedure
The energy city commission shall meet at least four times each calendar year. The dates,
times and locations shall be established by city council resolution. S ecial Additional

commissioners. Notice of the time and place of a s ecial additional meeting ,
time atid place thereo shall be communicated to theeaeh members of the c..mmissio and
publicly noticed at least three days prior to the meeting except in the event of an emergency,
posted at city hall and,if time permits,published in the city's official newspapef.
Effective Date
That this ordinance shall take effect upon adoption and be published as provided by law.
