Action Requested
Recommend,by motion; approval of the Conditional Use Permit (CUP) request by Anytime Fitness to
operate a physical recreation facility in the Hillside Crossing Planned Unit Development (PUD),with the
following conditions:
1. The Conditional Use Permit is not a building permit and the applicant must apply
for and receive approval of all required permits before construction may begin.
2. The applicant must apply for and receive approval of all required sign permits before
signage may be installed.
Background/Discussion
The subject property is located within the Hillside Crossing PUD, approved in 1996.The PUD
agreement lists amusement and recreation uses as a conditional use,requiring a CUP application and
approval from both the Planning Commission and the City Council.
Anytime Fitness has existed in Elk River since 2004 and is currently located in the Elk River Crossing
PUD. The applicant states that she is relocating due to high rent and proposes to occupy a 5,389 square
foot end unit at 19437 Evans St NW. The new location gives the applicant an opportunity to expand her
operation and offer additional services and facilities to her members. The building also houses a thrift
store,paint store, chiropractor and a contractor's office.
Building
Plans include a large reception and exercise area, two tanning rooms, a separate room for classes, two
showers,and two bathrooms.The addition of showers will trigger additional SAC and WAC fees. There
are no proposed changes to the exterior of the building or site.
Signage
The applicant proposes to utilize her existing signs and transfer them to the new facility. Sign permits
need to be applied for and approved before they are put up as there are differences in the sign regulations
between the two PUDs.

Parking
The proposed use is 5,389 square feet in size and requires 27 parking spaces per city ordinance (1 space
per 200 square feet of floor area). Using current zoning regulations other uses in the building require 157
spaces,bringing the total required for the building to 184 stalls. The parking lot includes 168 parking
spaces.
While the addition of the proposed use pushes required parking over what is available, the building was
proposed as part of the PUD and parking was designed to accommodate retail uses in the entire building.
City code calculates parking for fitness facilities and retail at the same rate. Staff is comfortable with the
difference between available and calculated parking needs.
Applicable Regulation
Conditional Use Permit
The issuance of a Conditional Use Permit can be ordered only if the use at the proposed location:
1. Will not endanger,injure or detrimentally affect the use and enjoyment of other property in the immediate
vicinity or the public health, safety, morals, comfort, convenience or general welfare of the neighborhood or the city.
2. Will be consistent with the comprehensive plan.
3. Will not impede the normal and orderly development and improvement of surrounding vacant proper .
4. Will be served adequately by and will not adversely affect essential public facilities and services including
streets,police and fire protection, drainage, refuse disposal, water and sewer ystems,parks and schools;and
will not, in particular, create traffic congestion or interference with traffic on adjacent and neighboring public
thoroughfares.
5. Will not involve uses, activities,processes, materials, equipment and conditions of operation that will be
detrimental to any persons or propero because of excessive traffic, noise, smoke,fumes,glare, odors, dust or
vibrations.
6. Will not result in the destruction, loss or damage of a natural, scenic or historic feature of major importance.
7. Will fully comply with all other requirements of this Code, including any applicable requirements and
standards for the issuance of a license or permit to establish and operate the proposed use in the city.
If denial of such a permit should occur,it shall accompany recommendations or determinations by
findings or a report stating how the proposed use does not comply with the standards set forth in Section
30-654.
In the review of the standards for CUP as outlined,it appears that the request is consistent with all of
these standards.

To Whom It May Concern:
I am requesting a conditional use permit to open an exercise/gym
recreational facility in the planned unit development in Hill Side
Crossings. The PUD agreement lists recreational facilities as a
conditional use.
I have 10 plus years of running a health and fitness club in the
community of Elk River. We promote healthy life styles for the citizens
of Elk River. We are a member's only club.
I have been established since 2004 and have a well proven track record
of running my business in the city of Elk River.
I would like to move my business because of high rent where I currently
reside.
Anytime Fitness has been voted the #1 Business/Franchise in the
United States just recently.
I am greatly involved in the community of Elk River.
I served for 6 years on the Chamber of Commerce of Elk River. 3 years
with the Three Rivers Community Foundation.
