No action is being requested at this time. The Commission,at the September meeting,will review a formal proposal by the applicant. There were also a variety of small open spaces to be utilized for green space and recreational areas. The "big picture" concept behind Elk River Station is to promote transit-oriented development in response to the Northstar Corridor commuter parking lot and eventually rail. The residential units were comprised of 4 60-unit apartment buildings and back-to-back and row townhomes. The concept has been changed in order to reduce the amount of vehicle trips per day out of the site. The number of apartment buildings have been reduced to one, and more townhomes have been added. ELK RIVER STATION City of Elk River MEMORANDUM TO: Park and Recreation Commission FROM: Michele McPherson, Director of Planning DATE: August 8, 2001 SUBJECT: P 01-05 Preliminary Plat of Elk River Station — Park Dedication Attachments • Location Map • Master Park Plan Excerpt • Project Overview Map • Park Descriptions—Submitted by Applicant Overview At the July 11, 2001 Commission meeting staff and the developer heard the following from the Commission: 1. A concern regarding how"public" the proposed parks would be. 2. The desire to get to a cash dedication of at least 50% of the total for development of parks elsewhere in the City. Analysis Level of Public" A number of commissioners expressed concern that this subdivision would act like a "gated community" and that the general public would not be welcome in the proposed parks. In all subdivisions within the City, the Commission has attempted to provide neighborhood parks for a specific number of residents that are not intended to draw from far corners of the City. Some neighborhood parks serve a several hundred residents while others may serve less than a hundred. In this case, there will be eight"neighborhood" parks sewing a population of approximately 1,000 people. Memo to Park and Recreation Commission/Elk River Station August 8,2001 Page 2 It is possible that some residents may feel that these areas are "their" parks, but the same could be said for residents living near Trott Brook Park with its refurbished barn. As residents living within Elk River Station make friends in the community, these residents will access the parks that are available there. Park Dedication The applicant has submitted a narrative and detailed park drawings for the Commission to consider. Also included is the detailed budget of amenities. Staff will note that items such as boulevard trees and sidewalks are normal items for all developments and therefore should not be considered for park dedication credit. Starting with the overall cash dedication amount, staff would suggest the following"credits" to the applicant: Total Cash Dedication: $755,640.00 (1/2 equals $377,820.00) Credits: Park Green 2 $ 63,300.00 (.28 acres) Park Green 4 $ 70,660.00 (.44 acres) Park Green 5 $154,200.00 (.53 acres dry) Park Green 7 $ 95,800.00 (1.27 acres) Park Green 8 $ 69,600.00 (.45 acres) Asphalt Trail $ 43,200.00 Total Credits: $453,560.00 (2.97 acres) Total Cash to City: $302,080.00 The above credits are based on the amenities budget. To add back the 75,740.00, staff would suggest deleting credit for the mailbox structures, shrubs, and flowers that are included above. This adds back to the total cash to the City$82,900.00; making the total cash to the City $384,980.00. Staff is assuming no credit for the land at this juncture. The above green areas would become public parks, with the exception of the water in Green #5. Maintenance Staff met with the applicant to discuss maintenance issues. It was agreed that the homeowner's association would maintain the irrigation system, the flowers, and mow the green areas not accepted as parks. City staff would plow the public street, the primary sidewalk adjacent to the street, and mow the boulevards. Recommendation Staff recommends that the Commission accept either of the two amounts identified by staff above or provide further direction staff regarding this issue. Prototypes for Park Signs Phil Hals presented to the Commission with two prototypes of signs:Vinyl-coveres aluminum and anodized aluminum blank with reflective vinyl. They both . • •.ually as durable,but not vandal free. Several different color samples for : odized sign were presented. Mr. Hals has been working with Mr. Leeseber o variations of presenting the signs in the parks;i.e.,using pillar posts or even fa. wooden posts.The anodized sign with the reflective vinyl is also much easie • ee at night as it does reflect light. The signs can be made in any size and any • ..rtion, and can also be made two-sided making this easy to identify from bot de es of the road.The signs presented were 2'X3'. The ma o' consensus from the Commission was for the anodized sign,bur requested cost e aces of the signs.The signs can be erected as early as this fall or next spring. 9.B.1. Elk River Station Case No. P 01-05 Ms. McPherson presented a brief summary of the Elk River Station Parks report. Mr. Len Pratt presented for the developers of Elk River Station. He presented a detailed slide show of the existing parks in the city today, as well as city parks to be developed and how the Elk River Station Parks will incorporate some of those ideas. Elk River Station LLC proposes to dedicate 8.46 acres of land (approximate value$338,000) with improvements totaling approximately$1.2 million. They will also commit homeowner association fees for maintenance which would significantly reduce the City of Elk River's park maintenance costs. They would also like to set up a cooperative agreement with the City of Elk River for park maintenance in this development. Chair Kuester asked for clarification of the dedication proposal which would be a counter- proposal to the staff recommendation,which was 2.97 acres of land would be partly amenities and cash. Mr. Pratt's proposal included the 8.46 acres of land and amenities, shared maintenance and no cash. Commissioner Dave Anderson asked to hear from Mr. Hals, Street and Parks Superintendent, for his thoughts. Mr. Hals felt that this is a new concept and he had some concerns with regard to maintenance of some of the parks, as they also serve as drainage ponds and sediment ponds, and the maintenance and appearance of which is a challenge. The other concerns are geared toward the streets. He saw no concerns with the city maintaining the bituminous pathways. He had some reservation with maintenance in regard to the tennis court and volleyball court area. He felt that these court areas will serve the residents of Elk River Station and not the general public. The purpose of the storm water ponds (spaces #3, 5 and 6) was discussed as well as ground water contamination and the safety of children and animals. Mr. Hals reiterated that these are designed to be wet water ponds and to collect the sediment from run-off to clarify the water before it reaches the Mississippi River. One of the ponds is designed to be 10'deep with retaining walls,and it was recommended that the pond be fenced to keep the children and animals out. Park&Recreation Commission Minutes August 8,2001 Page 5 Chair Kuester raised two concerns from July's meeting: A sense that this would be a public park, and that there would be a cash contribution towards city parks with not all monies being allocated to Elk River Station development. Ms McPherson reiterated the staff recommendation of 2.97 acres and amenities which is worth $453,560.00 with the total cash to the City of Elk River being$302,080.00. There are essentially three options to consider: -Adding back the$75,740.00 to be at 50% of the total park dedication,which would total$377,820.00. -Delete the credit for mailbox structures, shrubs, and flowers,which would total $82,900.00,making the total cash dedication to the City$384,980.00. -Developer's proposal of total land dedication of 8.46 acres and no cash. The general consensus from the Commission is that the parks at Elk River Station are a new concept to Elk River, and the concern is this concept would not benefit the entire community of Elk River,but would rather only benefit the immediate surrounding residents of Elk River Station. Another concern is the acquisition of enough cash dedication which would benefit all parks in the City of Elk River. COMMISSIONER DAVE ANDERSON MOVED TO RECOMMEND TO THE COUNCIL TO ACCEPT THE STAFF RECOMMENDATION TO ACCEPT 2.97 ACRES OF LAND WITH NO CREDIT, $384,980.00 CASH DEDICATION AND SHARED MAINTENANCE AS NEGOTIATED BY STAFF AND DEVELOPER. COMMISSIONER DANA ANDERSON SECONDED THE MOTION. COMMISSIONER BRIGGS ABSTAINED. MOTION PASSED 5-0. 9.B.2. Kliever Lake Hills. Case No. P 01-09 Ms. McPherson presented an overview of Kliever Lake Hills,located 1/4 mile sout • County Road 12 and Y mile west of Fillmore Street. This property totals 39. ' .cres with Kliever's Marsh located in the southwest corner. Kliever's Marsh is a Na Environment Lake;as such, the developer has separated the lots adjacent to the M. from the water in order to reduce the lot area from 40,000 to 20,000 square feet. The proposed plat includes 39 lots and three streets. Th- developer is proposing to dedicate Outlot B for park dedication. Outlot B that is above .ater is 3.18 acres,just under the 10% requirement. Commissioner Dana Anderson asked if e number of lots had been changed since the last meeting. Ms.McPherson replied the number of lots has been significantly reduced from 65 to 39 lots. Commission Dana An. son also expressed concern that the City may not be getting a dry- land dedication as -re was no outline of where the flood plain resides on the map. He also expressed ad• -..nal concern with run-off from asphalt, shingles,etcetera,within the developm. Ms. McPherson explained that there will be run off but the flow will not exceed • e rate of what currently exists due to vegetation and the two storm water ponds 1•-.ted at both north corners of the development.
