Review of Snowmobile/ATV Information Meeting
The informational meeting held on September 24,2002 was well attended by members of
the public. Over 1,000 notices were mailed to registered sled owners within Elk River's
corporate boundaries, and the River City Snow Riders distributed flyers (attached)
throughout the City. Attendees were asked to sign in; 110 did sign the attached sheets. Of
those attending, the majority were Elk River residents; nine were from other cities like
Zimmerman, Rogers, or Otsego.
Those attending were able to talk with City staff and Commissioners Polston-Hork and
Anderson. They were asked to fill out comment cards regarding the proposed regulations.
The comments submitted can be summarized in the following manner:
1. Allow snowmobiling on private property regardless of lot size.
2. Allow snowmobiling on County Road 1 from Highway 10 to County Road 33.

3. Allow snowmobiling within the curb lines of City streets so that a resident living four
blocks from the trailhead does not need to trailer their sled.
4. Focus on more on enforcement and ticketing those who violate the rules.
In general,those who attended were angry that the City was proposing regulations because
of the violations that have been experienced by the City. The attendees did not feel that they
violated the ordinance and that they were being punished by the change in regulation.
Reviewing the comments received, staff would suggest a change to the ordinance allowing
snowmobile riding within your own property regardless of size,and to recommend adoption
of Option 2 of the snowmobile map (the smaller no snowmobile zone).
Recommendation
The draft ordinance reflects that above comments regarding snowmobiling on your own lot.
Staff recommends that the Commission recommend that the City Council adopt the
attached ordinance and snowmobile map Option 2.

SECTION 1104 - SNOWMOBILES AND ALL TERRAIN VEHICLES (ATVS)
1104.00 - APPLICABILITY
This ordinance applies to the operation of snowmobiles and all terrain
vehicles (ATVs) on public lands and waters, and private property
within the jurisdiction of the City and on streets and highways within
the boundaries of the City.
1104 . 02 - DEFINITIONS
The words, combination of words, terms or phrases used in this
ordinance and defined in Minnesota Statutes, Section 84 . 81, shall have
the meanings given them by that section.
1104.04 - ADOPTION OF STATE LAW BY REFERENCE
The provisions of Minnesota Statutes, Sections 84 . 82 pertaining to
registration, 84 . 87 pertaining to snowmobile operation and regulations
by municipalities, 84 . 871 pertaining to equipment requirements, 84 . 872
pertaining to youthful snowmobile operators, 84 . 88 pertaining to
penalties are adopted and made a part of this ordinance as if set out
in full .
The provisions of Minnesota Statutes, Sections 84 . 9 et.al . pertaining
to ATV regulations are adopted and made a part of this ordinance as if
set out in full .
1104.05 - OPERATION WITHIN THE CITY LIMITS, SNOWMOBILES
For defining where snowmobiles are permitted to operate, the City has
been divided into two parts:
a. No Snowmobile Zone
b. Snowmobile Zone.
The City Council, may, from time to time, adopt an official map
defining the boundaries of the No Snowmobile Zone.
A. No Snowmobile Zone:
The operation of a snowmobile within the No Snowmobile Zone is
permitted:
i . ) On designated and marked snowmobile trails during
periods when trails are open
ii . ) Over Lake Orono (when safely iced over) , when
legally accessed as defined in this ordinance and
not closer than 100 feet from the shoreline,
skating rinks, fish houses, and pedestrians.
iii . ) Over the Elk River (when safely iced over) , when
legally accessed as defined in this ordinance.
B. Snowmobile Zone:
The operation of a snowmobile within the snowmobile zone is
permitted:
i . ) On designated and marked snowmobile trails during periods
when trails are open.
ii . ) Within the curblines of a public street in order to
access an approved trail or ditch.
iii . ) In the bottom or outside slope of a ditch of County Roads
1, 13, 21, 32 or 33 or a state highway.
iv. ) On private property of another that you have been given
permission from the landowner or occupant to ride .
v. ) On property you own.
Anywhere within the corporate limits of the City of Elk River,
snowmobiles shall not be operated:
1 . On public lands, including but not limited to : public
parks, playgrounds, trails, sidewalks, paths, open
spaces, scenic and historic sites, schools, golf
courses, and other public buildings and structures .
2 . Within one hundred (100) feet of any fisherman, fish
house, shelter, pedestrian, skating rink, sliding area
or in any other area where such operation would
conflict with the use or endanger other persons or
property.
3. At any place, while under the influence of
intoxicating liquor, narcotics or habit-forming drugs
4 . At a rate of speed greater than reasonable or proper
under all the surrounding circumstances
5 . At any place in a careless, reckless or negligent
manner so as to endanger the person or property of
another or to cause injury or damage thereto
6. In any tree nursery or planting in a manner which
damages or destroys growing stock
1104.06 - OPERATING REQUIREMENTS
In order to operate a snowmobile lawfully within the City' s corporate
limits, a snowmobile must have :
1 . A lighted headlight and taillight.
2 . A muffler in good working order which blends the exhaust noise
into the overall snowmobile noise and which is in constant operation
to prevent excessive or unusual noise .
3 . Without any noise-making device which amplifies noise emitted from
the snowmobile, including, but not limited to, tuned exhausts cut-outs
or straight pipes .
1104 .08 - UNATTENDED SNOWMOBILES
It shall be unlawful for the owner or operator of a snowmobile to
leave a snowmobile in a public place without locking the ignition,
removing the key and keeping the same in his possession.
1104 . 09 — OPERATION WITHIN THE CITY LIMITS, ATVS
•
For defining where all terrain vehicles (ATVs) are permitted to
operate, the City has been divided into two parts:
a . No ATV Zone
b. ATV Zone
The City Council, may, from time to time, adopt an official map
defining the boundaries of the No ATV Zone .
A. No ATV Zone :
The operation of an ATV within the No ATV Zone is permitted:
i . ) On designated ATV trails accessed from established
trailheads .
ii . ) On platted lots greater than . 75 acres that you own or
which you have permission on your person to ride. On
lots smaller than . 75 acres, ATVs may be operated for the
purposes of loading and unloading or for mechanical
repair.
iii . ) In the winter, on Lake Orono not closer than 100 feet
from the shoreline, skating rinks, fish houses and
pedestrians.
iv. ) For agricultural or utility use as per State Statute and
after issuance of a City permit.
B. ATV Zone :
The operation of an ATV within the ATV Zone is permitted:
i . ) On designated ATV trails access from established
trailheads .
ii . ) On property you own or which you have permission on your
person to ride.
iii. ) On a private track in compliance with the following
standards (County rules here)
iv. ) For agricultural or utility use as per State Statute and
after issuance of a City permit.
v. ) In the ditch or outside slope of County Roads 1, 13, 21,
32, and 33 if they can be accessed directly from your
property.
Anywhere within the corporate limits of the City of Elk River, ATVs
shall not be operated:
1 . On public lands, including but not limited to: public parks,
playgrounds, trails, sidewalks, paths, open spaces, scenic and
historic sites, schools, golf courses, and other public
buildings and structures.
2 . Within one hundred (100) feet of any fisherman, fish house,

1104 . 10 - PENALTY
Any person violating any provision of this ordinance shall be guilty
of a misdemeanor, and upon conviction thereof, shall be punished by a
fine of not more than $1, 000 . 00 or by imprisonment of not more than
ninety (90) days, or both, plus costs of prosecution in either case .
1104. 11 - APPLICATION OF OTHER LAWS
The provisions of Minnesota Statutes, Chapter 169, pertaining to
traffic regulations, which relate to the use and operation of
snowmobiles, shall apply to the use and operation of snowmobiles upon
the streets and highways of the City. However, those provisions which
by their nature have no application shall not apply.

Dear Mayor Klinzing and Mr. Engstrom,
Proposed Elk River Ban on Snowmobiling
As a future resident of Elk River and Sherburne County, I am appalled about the
proposed Elk River city ban on the use of snowmobiles.
I am just in the process of closing on a 2 acre property in the Ridgewood Subdivision of
Elk River(19872 Watson Circle). I specifically purchased this property in order to be
able to ride my snowmobile from my house to County Road 77 (Proctor Street) and
access County Road 33 and the trails from Highway 169. As my house is just south of
County Road 33, but not in the Urban Services District, I am affected by this ban which
means I cannot access the trail system just near my new home. The ban would effectively
mean I could not also ride my snowmobile in the yard of my property to test it after
working on it. This is a considerable infringement on my personal right to utilize a not
inexpensive piece of equipment. I have a number of friends in the Elk River area who
will be likewise affected.
There are 22,000 miles of trails in Minnesota and snowmobiling is a major boon to the
economy of this state. I believe snowmobiling contributes something like $2 billion to the
earnings of Minnesota. Sherburne County itself advertises Sand Dunes State Forest as
being a beautiful area in which to ride a snowmobile.Access to Sand Dunes State Forest
will be restricted by the ban as people will not be able to travel through the Elk River area
to access the northern trail system.
An outright ban on snowmobiling in the Elk River area is an inconsiderate knee jerk
reaction that needs to be considered carefully as it will have a significant adverse impact
the registered snowmobile owners in Elk River, as well as visitors to the area.
At the 18 March 2002 Elk River City Council meeting a non-resident of Elk River
indicated that getting across Elk River on a snowmobile is a problem. It was reported that
the prohibition of all snowmobiling south of County Road 33 makes it impossible for
them to get across Elk River without getting stopped by the police. Elk River Police are

reported to have stopped 228 snowmobiles during the 8 hour period following the last
snowstorm prior to the meeting. Elk River is effectively becoming a road block to the rest
of the snowmobiling community in the Twin Cities area.
The City of Elk River in conjunction with the River City Snowriders Club should
establish clearly marked trails and routes that allow access both in and out of the city.
I am all for consideration of other peoples rights and safety and believe that significant
fines, and in some cases forfeiture of the offending snowmobile, need to be established as
a deterrent to any potential offenders. Parents of juvenile snowmobilers who ride without
a permit or in breach of the city ordinance need also need to be held accountable for their
children's operation of the vehicle. There needs to be recognition for multiple offences as
well.
I have just examined the draft Snowmobile Ordinance I located on the City of Elk River
website (http://elkriver.aovoffice.com/vertical/Sites/%7B18493844-E9A7-4BC5-BA1B-

3C105E895575%7D.PDF). I found no further drafts with the other alternatives
mentioned in the initial information from Michele McPherson, Director of Planning:
1. Implement an outright ban (simplest),
2. Provide no regulation, or
3. Allow limited use in specific areas (either south of 33 or limiting uses to the
Urban Service District).
This draft ordinance clearly shows that the City has made a decision (Option 1) with
respect to how it wishes to proceed on this subject. The "consultation"to be held tonight
is therefore a farce. Option 3 is the more reasonable one and is a compromise for all
concerned.
The River City Snowriders snowmobile club is working hard to make Elk River a safe
place for the community whilst still allowing snowmobilers to enjoy an activity which
makes Minnesota winters bearable for many people. They therefore deserve the
opportunity to be appropriately consulted in the process of rewriting the ordinance.
As a future resident of this area I request that fair consideration be given to a suitable
compromise which will respect the rights of both snowmobilers and other residents.
