Adopt,by motion,an ordinance amending the City Code relating to the Energy City Commission and its
membership and reimbursement policy.
Background/Discussion
On February 3, the Council discussed changes to the Energy City Commission relative to its membership
and to the reimbursement policy. As directed by the Council, staff has prepared an ordinance for
adoption.
The ordinance modifies the membership from 15 members to 11 members to include the following
representatives: 1 Council/ EDA member, 6 energy businesses, 1 Elk River Municipal Utilities, 1 school
in the City of Elk River, 1 Chamber of Commerce, and 1 Landfill member.
The draft ordinance allows the reimbursement for expenses, (primarily approved training and travel).

An Ordinance Amending Section 2-352, Membership; Officers; Compensation of
Members, and 2-355, Meetings and Rules of Procedure, Relating to the Energy City
Commission, of the City of Elk River, Minnesota, City Code
The City Council of the City of Elk River does hereby ordain as follows:
Section 1. That Section 2-52,Membership; officers; compensation of members of the City of Elk
River Code of Ordinances shall be amended to read as follows:
The energy city commission shall consist of up to 45-11 members who shall be appointed by
the city council for terms of three years. The commission will consist of the following:
1. One representative from the city council/Economic Development Authority.
2. One representatives from the Elk River Municipal Utilities.
3. Up to six representatives from energy related businesses as determined by the city
council (this can include consultants, manufacturers,technology, environmental, energy
producers and/or energy providers).
4. One representative designated by indepetidetit School Distr4ct 728a school located in
Elk River.
5. Oiae representative desig7tiated by Sherburne Couffty Board of Commissiollers.

All terms shall end on the last day of February;however, members shall hold office until
their successors have been appointed. A vacancy during the term of any member shall be
filled by city council appointment for the remainder of the term. Officers of the commission
shall consist of chair and vice-chair, as elected by the commission. The chair shall preside at
all meetings of the commission if present,and perform other duties and functions assigned
by the commission or the city council. The vice-chair shall perform these duties in the
absence of the chair. If a vacancy occurs in the chair office, the vice-chair shall assume the
chair's duties for the remainder of the year and a new vice-chair shall be elected by the
commission at the next scheduled commission meeting. A quorum shall consist of a majority
of the sitting members.

Section 2. That Section 2-355,Meetings and rules of procedure, of the City of Elk River Code of
Ordinances shall be amended to read as follows:

The energy city commission shall meet at least four times each calendar year. The dates,
times and locations shall be established by city council resolution. S eci I dal
meetings may be held at any time upon at-the call of the chair or the request of two other
commissioners. Notice of the time and place of a s eci I additional meeting ,
time and place thereo shall be communicated to theeach members of the cotnti issi. and
publicly noticed at least three days prior to the meeting except in the event of an emergency.
Section 3. That this ordinance shall take effect upon adoption and be published as provided by law.
