RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION FOR VACATING DRAINAGE EASEMENT
Case No. EV 96-3
WHEREAS,
the property owner abutting the drainage easement has requested
the City Council in a petition dated August 14, 1996, to vacate such
e-'.:s~ment according to law; and,
WHEREAS,
a public hearing was held on September 16, 1996, before the City
Council at the Elk River City Hall on such petition after due
published and posted notice had been given as well as personal
notice to affected property owners on August 27, 1996, and ail
persons interested were given an opportunity to be heard; and,
WHEREAS, it appears that it will be in the best interest of the City to approve
such petition.
NOW, THEREFORE, BE IT RESOLVED that such petition is hereby granted and
the drainage easement described as follows is hereby vacated:

Description for a vacation of the drainage easement on that part of Lot 10, Block 4, DEERFIELD
SECOND ADDITION, Sherbume County, Minnesota, according to the recorded plat thereof
described as follows: Beginning at a point on the south line of said lot distant 110.00 feet easterly
of the southwest comer of said lot; thence northerly perpendicular to said south line a distance of
113.00 feet; thence southeasterly deflecting to file right 107 degrees 26 minutes 50 seconds a
distance of.110.06 feet; thence southerly deflecting to the right 72 degrees 33 minutes 10 seconds
a distance of 80.00 feet to a point on said south line; thence westerly along said south line a
distance of 105.00 feet to the point of beginning.
Description for a drainage and utility easement over, under and across the south 15.00 feet of Lot
10, Block 4, DEER.FIELD SECOND ADDITION, Sherbume County, Minnesota, according to
the recorded plat thereof lying easterly of a line drawn perpendicular to the south line of said lot
from a point on said south line distant 110.00 feet easterly of the southwest corner of said lot and
lying westerly ora line drawn perpendicular to said south line from a point on said south line
distant 360.00 feet easterly of said southwest comer.
