Dear Council Members:
A public informational meeting with the residents along Yankton Street is scheduled for Monday
evening, February 23, 2004. Attached is a draft of the feasibility study ordered by the City Council
by motion on October 27, 2003. I have left the feasibility study in draft form for two reasons. First,
if the City does proceed to a construction project and an assessment of a portion of the costs, the
feasibility needs to be ordered by resolution. The date of the actual feasibility study should not
appear to be before the date of that resolution ordering the improvement. Secondly and more
importantly is the issue of financing. Typically, a feasibility study is prepared and presented to the
City Council for their review, comment and adoption prior to going to the public. With this project,
we are going to hold an informational meeting with the public to discuss the improvements and the
financial ramifications first.
The financial ramifications of this project are that its estimated cost is $260,650. This amount
contains some contingencies. The ability to assess the project cost is significantly less than the
total project cost. There are 11 properties abutting Yankton Street. Three of the properties do not
utilize Yankton Street for access, but rather access to the west. One individual owns two of the 11
properties, and approximately three of the properties are relatively close to Trunk Highway 10 and
the owners may not perceive that there is an issue with the width of the road. I believe there is a
significant funding issue relative to the number of properties that are assessable and how much
assessment each of these properties can bear. Even if we assume that all 11 properties are
assessable and could support an assessment of up to $10,000 each, that would leave
approximately $150,000 to be funded by the City.
I will be prepared to make a brief presentation of the proposed improvements, summarize the
project costs, and discuss the assessment issues. After City Council and resident questions, if the
City Council wants to proceed further with this project, I would recommend that you consider
adopting the attached resolution, which would officially order the feasibility study. Secondly, I
would request direction from the City Council relative to the financing of the improvements.

ORDERING A PRELIMNARY FEASIBILITY REPORT IN THE
MATTER OF THE YANKTON STREET IMPROVEMENT OF 2004
WHEREAS
WHEREAS
the City has determined that it should consider improving certain property by
reconstructing Yankton Street from Trunk Highway 10 to the north (the
Improvement); and
Council must first secure a preliminary feasibility study in order to consider
making the improvement;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River, Minnesota:
This matter shall be referred to Howard R. Green Company, who is requested to provide
to the City Council a report advising, in a preliminary way, whether the proposed
improvement is feasible and whether the improvement should thus be made as
proposed or in connection with some other improvement and the estimated cost of the
improvement as recommended.

I. Introduction
At the October 27, 2003, regularly scheduled City Council meeting, Mark Olson
of 18778 Yankton Street and Diane Thiesen of 18741 Yankton Street appeared
at open mike to request that the City widen Yankton Street from Trunk Highway
(TH) 10 to where it dead ends, in front of his property at 18784 Yankton Street.
In response to Mr. Olson and Ms. Thiesen's request, the City Council authorized
Howard R. Green Company to prepare this report to determine the feasibility of
widening and reconstructing Yankton Street. Exhibit I shows the project
location.
II. Scope
III.
The purpose of this study is to examine the feasibility of widening and
reconstructing approximately 1,450-feet of Yankton Street from TH 10 to a
proposed cul-de-sac in front of 18748 YanktgmStreet. This report will include
information on the existing conditions of th¢~,et, proposed improvements,
estimated costs, and proposed assess~'~s t'~. e benefited properties using the
City's Assessment Manual and past p~ as a guide.
Existing Conditions ~
Presently Yankton Street is ~~f(~t dead end, rural section, gravel surfaced
road with an average wi~- ~roximately 17 feet. It appears, based on the
preliminary survey, that4~i~s'~f the road are located outside of the
established right-of-way. ~rnents of the right-of-way are 66 feet wide, 20 feet
wide and 40 feet wide as d~dicated in the Alderwood Plat and the Sixth Plat of
Camp Cozy. There are no public utilities along the street. Homes in the area are
served by private wells and septic systems.
Storm Drainage System
There is a ditch on the west side of the road that conveys storm water to two
culverts (see Exhibit 2). One culvert outlets directly into the Elk River, and the
other outlets into the front yard of 18741 Yankton Street, where storm runoff
flows over land to the Elk River.
IV. Proposed Improvements
A. Street Improvements
Yankton Street is proposed to be reconstructed to a 24-foot wide bituminous
surfaced urban section with bituminous berm. A 24-foot section would not
meet the City's minimum standard width of 32 feet. This report attempts to
balance the impacts that widening the road and regrading the ditch would
have on the environment by providing a road that two vehicles can easily
pass each other on.
A cul-de-sac would be constructed on the north end of the street. The
proposed typical street section would be in accordance with the City
standards and would consist of 1-1/2 inches of bituminous wear, 2 inches of

bituminous base, and 6 inches of aggregate base. The cul-de-sac would be
paved with a 45-foot radius. No soil borings have been obtained at this time,
and the pavement section would be dependent on the findings of a
geotechnical report. Driveways would be reconstructed as necessary to
match the new street.
B. Storm Water Drainaqe Improvements
The reconstruction and widening of Yankton Street would affect the way
storm water runoff is routed along the west side of the street. Portions of the
embankment would be cut back and portions of the ditch would be filled in
(see Exhibit 3). Most of the ditch along the west side of Yankton Street may
need to be regraded to promote proper drainage to the proposed storm water
runoff system outlined below and depicted on Exhibit 4.

V. Design Issues
The four primary issues involved with widening Yankton Street are:
· Re-establishing the right-of-way.
· Possible impacts to wetlands.
· Obtaining additional easements and right-of-way.
· Clearing of trees and brush along both sides of Yankton Street, and regrading
the right-of way.
This report examines each if these issues in the following sections:
Preliminary surveys indicate some discrepancy in the relationship between
the platted right-of-way, and the existing road. Parts of the existing road
appear not to be within the platted right-of-way (Exhibit 2). Parts of the road
appear to be too far east, encroaching on the properties on the east side of
the street and parts of it appear to be too far west thus encroaching upon the
properties on the west side of the street. If this project goes forward
significant survey work will need to be done to determine exactly where the
right-of-way is in relation to the existing road.

Once the relationship between the existing road and the existing right-of-way
is determined there are two options for reestablishing the road within the
right-of-way. One option would be building the new road within the existing
right of way the other would be centering a new right-of-way on the existing
road.
The preliminary survey indicates that building a new 24-foot wide road within
the existing right-of-way could have significant negative impacts on some of
the front yards on the east side of Yankton Street and some of the backwards
on the west side of Yankton Street.
These impacts could include:
1. Moving the road closer to the houses.
2. Removing large trees that provide a visual barrier between the road and
the houses.
3. Removing landscaping near the ro~

establishing a new right-of-way would primarily be for surveying and
describing easement documents.
There appears to be a wetland on the west side of Yankton Street just north
of 187th Avenue (Exhibit 2). If this project goes forward, the City will need to
have this area delineated to determine if it is classified as a wetland.
Widening of Yankton Street would require that some of this area be filled in.
Construction projects, which involve filling in of wetlands, require review by
the Technical Evaluation Panel (TEP). The result of this permitting process
will determine whether the wetland can be filled and what mitigation
measures will be required.

way and easements for the storm water runoff system and the cul-de-sac.
Approximately 36 individual trees along Yankton Street, plus approximately
% acres of trees and brush will need to be removed in order to grade and
build the new road and accommodate the storm sewer in the alley right-of-
way. This will have a significant effect on the landscaping and change the
overall "look" of Yankton Street.

VI. Implementation Considerations
Implementation of any construction project will have an impact on the
environment of the area. Using appropriate erosion control methods and careful
monitoring of construction activities can minimize the temporary, shod-term
negative effects of construction.
The primary environmental impacts associated with this construction would be
potential erosion and loss of trees and vegetation. The potential erosion
problems can be avoided through proper planning in the design phase of the
project. Construction plans for the project would include an erosion and
sediment control plan. During construction, it will be vital that sufficient
observation of the contractor be maintained to identify and ensure correction to
any potential erosion problems.

The overhead costs include funds for administration, legal, fiscal, engineering
design, preparation of plans and specifications, and field surveying and
inspection. The contingency costs are estimated at ten percent. The unit prices
for construction costs are based on actual bid tabulations from recent local

projects of similar scope. Project cost estimates provided reflect the estimated
construction cost, which includes contractor costs for labor, equipment and
materials.
IX. Financing
There are total of eleven properties that abut Yankton Street. Three of these
properties, however, do not have access directly onto Yankton Street, but rather
access onto Zebulon Street and 201st Avenue. The frontage of the 11 properties
along Yankton Street ranges from a Iow of 112 lineal feet to a high of 611 lineal
feet.
There are typically two ways to assess these types of road reconstruction
improvements. Most recently, the City Council has utilized a per residential

the question then is what is the maximum assessment amount that could be
sustained against an assessment appeal. If we assume that that number is up to
$10,000 per unit, which is likely on the high end, that would mean that there is
$110,000 generated by assessments. This would leave approximately $150,000
of the project cost to be funded by the City.
X. Summary
The proposed street improvements will provide residents with a safe and
adequate public transportation system. The street reconstruction portion of this
project is feasible from an engineering standpoint, and with the exception of the
reduced street width, it meets all standards set forth by the City of Elk River.
The total project cost for the Yankton Street Improvements project is estimated to
be $ 260,650. The project would be funded through a mixture of special
assessments to the benefited properties and City funds.
