Memo to Mayor and City Council/P 02-11 July 15, 2002 Page 2 Analysis The subject property, totaling 27 acres, is currently unused farmland. This is the third phase of Mississippi Oaks originally proposed in 1993. In 1996, Mississippi Oaks 2nd Addition was approved by the City Council. Layout and Lot Configuration The preliminary plat includes an extension of Concord Street out of Mississippi Oaks 2"d Addition, connected to County Road 30 by Denver Street. Two cul-de-sacs are proposed, Riverview Court and Concord Court. The 51 lots as proposed meet the minimum lot area requirements and width requirements for the Rlb and Rlc Zoning Districts. The minimum lot area is 12,000 square feet with the minimum lot width requirement being 80 feet. The smallest lot in the plat is 12,000 square feet, Lot 21, Block 2 and the largest being 52,860 square feet, Lot 26, Block 2. The plat provides access to Mississippi Road at Denver Street and connection to the existing subdivisions on Concord Street. The final plat is consistent with the preliminary plat approved by the City Council on June 17, 2002. Grading and Utilities These are addressed in the City Engineer's memo. Park Dedication Outlot A of the plat will be dedicated for park purposes. A small cash contribution will also be required, as the detention pond located on Outlot A will be deducted from the total area. Recommendation Staff recommends that the City Council approve the final plat of Mississippi Oaks 3rd Addition with the following conditions: 1. ALL COMMENTS OF THE CITY ENGINEER SHALL BE ADDRESSED. 2. STREET LIGHTS SHALL BE INSTALLED AS REQUIRED BY ELK RIVER MUNICIPAL UTILITIES. 3. A SEALCOAT FEE SHALL BE PAID PRIOR TO RELEASING THE PLAT FOR RECORDING. The plat consists of 51 lots and is the completion of the Mississippi Oaks development. Based on our review, we would offer the following comments: Lots 19, 20, 24-29, Block 2 and Lots 1 and 2, Block 3 are along the Mississippi River bluff. The bluff line has never been designated on the grading plan. However, a settlement agreement struck between the developers of Mississippi Oaks and the City of Elk River concerning tree removal along the bluff line designates a "restricted zone" generally described as below elevation 872.0. Therefore, all areas below 872.0 should be covered by an easement. There is an easement shown in the final plat, but when the distance is scaled to elevation 872.0 on the grading plan, it does not line up with the easement line on the plat. The easement line should be farther toward the street on each of the lots by approximately ten feet. With no home construction allowed in the area covered by this easement and with the City requirement that homes have a 20-foot backyard area before bluffs and/or ponds and wetlands, the house pad restrictions on these lots would be down to approximately 30 feet in width. This width would seem to be unreasonable to build fairly expensive homes along the Mississippi River. We believe the developer should look at realigning Concord Street further away from the river to allow more depth in the building area for the lots along the river bluff. Also, the grading plan shows walk-out elevations at 871.0 on Lots 27 and 28, Block 2. Clearly, if the bluff is designated as below 872, these elevations will need to be raised above 872 so that there is no cutting of trees or excavating below 872. The grading plan does indicate some grading of the bluff which must be eliminated on Lot 2, Block 3. An Agreement About Vegetation Alterations needs to be recorded for each of the lots on the river bluff prior to any issuance of building permits on these lots. This agreement has been drafted by the developer's attorney and reviewed by the City Attorney previously for purposes of use in prior additions. This document cannot be recorded on the final plat; therefore, a separate document must be prepared for each individual lot. On Lot 19, Block 2, there is a need for a wider drainage and utility easement for the swale shown on the grading plan. There needs to be a wider drainage and utility easement on the rear of Lots 15, 16, 17, Block I to accommodate the existing storm sewer pipe in this area. There needs to be an easement provided in the rear of Lots 11 and 12, Block 2 to cover the existing wetland/ponding area. Additional drainage and utility easements will be needed for the watermain looping of the two cul-de-sacs. Outlot A is provided to meet the park dedication requirement. As discussed at the Planning Commission and City Council meeting, there is a storm sewer leading to a ponding area in the southwest corner of Outlot A. A drainage and utility easement should cover these drainage improvements in Outlot A. We will also need to determine the size of the pond so it can be subtracted from the total area of Outlot A to calculate the amount of area donated as park land.
