Overview
The applicant is requesting a conditional use permit to permanently stable and pasture 5
horses and temporarily shelter and pasture 5 additional horses on 17.5 acres of fenced
pasture. The keeping of horses is considered an agricultural use and is allowed as a
conditional use in the Rlc district on parcels larger than 5 acres.
The 17.5 acres is located in the floodplain between the Mississippi and Elk Rivers. The
parcel is divided into two pasture areas, one is 14.3 acres and the other is 3.2 acres. There is a

10' by 20' shed located within the 14.3 acre pasture and a 20' by 35' barn located within the
3.2 acre pasture; both will be used to provide shelter for the horses.
The Zoning Code requires one acre of fenced pasture for each horse. With 17.5 acres of
fenced pasture, the applicant could have up to 14 horses. The applicant has indicated that
they will be keeping 5 horses permanently and up to 5 additional horses on a temporary
basis. The request complies with the required minimum acreage for horses.
Planning Commission Meeting
At the Planning Commission meeting held on June 25th, one neighbor spoke at the public
hearing. He was in favor of approving the conditional use permit for the horses. He felt that
pasturing horses was an appropriate use of the property. The Planning Commission
recommended approval of the CUP.
Recommendation
The Planning Commission and staff recommend that the City Council approve the request
for a conditional use permit to allow up to 10 horses on 17.3 acres with the following
condition:
1. If more than 10 horses total are on site, the CUP shall be amended.
